This Order is entered after an in camera review of certain documents delivered to<br />

this Court pursuant to orders entered as result of hearings before the court on July 20,<br />

2004. The Defendant presented arguments to the Court upon his Brady Motion, seeking<br />

to obtain a complete copy of the Personnel File of Officer Jamey G. Blalock from his<br />

employer, the Gastonia Police Department <strong>and</strong> the investigative file from Internal Affairs<br />

pertaining to the incident involved in these proceedings.<br />

In order to balance the interests of (1) the Defendant in obtaining favorable <strong>and</strong><br />

material information to assist him in his defense <strong>and</strong> (2) the confidentiality <strong>and</strong> privacy of<br />

Officer Blalock as to matters contained in his personnel files <strong>and</strong> the Internal Affairs<br />

investigation, the undersigned conducted an in camera review of the complete files as<br />

described above. From each of the said files, the undersigned has identified certain<br />

documents that may contain information material to the preparation of a defense on<br />

behalf of the Defendant. Other documents have been identified as not containing<br />

information material to the Defendant’s preparation of his case <strong>and</strong> constituting<br />

information that should not be released from Officer Blalock’s files. The documents<br />

from these files have been separated, with documents containing information material to<br />

the Defendant’s case having been designated as “Package A” <strong>and</strong> documents not<br />

containing such information having been designated as “Package B.”<br />

It is, therefore, ordered:<br />

1. The documents contained in Package A shall immediately be provided to the<br />

Defendant’s counsel, with a copy to the State. The Clerk shall make a copy of<br />

the documents contained in Package A <strong>and</strong> retain such documents in the file,<br />

under seal, with a notation “These documents shall not be opened except upon<br />

Order of the Superior or Appellate Courts.”
