statement were made;<br />

3. No threat or suggested violence or show of violence to persuade defendant<br />

to make a statement were made;<br />

4. Each of the statements made by defendant to Sgt. F.C. Reynolds <strong>and</strong> Maj.<br />

J.R. Phillips on September 7, 1999, was made freely, voluntarily, <strong>and</strong><br />

underst<strong>and</strong>ingly;<br />

5. The defendant fully understood his constitutional right to remain silent <strong>and</strong><br />

his constitutional right to counsel <strong>and</strong> all other rights;<br />

6. The defendant freely, knowingly, intelligently, <strong>and</strong> voluntarily waived each<br />

of those rights <strong>and</strong> thereupon made the statement to the above-mentioned officers.<br />

IT IS, THEREFORE, ORDERED that the Defendant’s Objection to the admission<br />

into evidence of the h<strong>and</strong>written statement provided by the Defendant to Officer D.M.<br />

Seery on August 22, 1999, is hereby OVERRULED. The Defendant’s Motion to<br />

Suppress such evidence is DENIED.<br />

IT IS FURTHER ORDERED that the Defendant’s Objection to the redaction of<br />

the Defendant’s statement is OVERRULED <strong>and</strong> the Motion to Suppress is DENIED.<br />
