STATE OF NORTH CAROLINA LINCOLN COUNTY IN THE GENERAL COURT OF JUSTICE SUPERIOR COURT DIVISION 99 CRS 6076 STATE OF NORTH CAROLINA ) ) vs. ) ORDER ) ) AARON STUART VANCAMP ) Defendant ) ___________________________) This Order is entered upon a hearing conducted on Defendant’s Objection raised at trial concerning a search of a vehicle in which the Defendant was a passenger, arising from a stop of the vehicle at a license checking stop. Upon making the objection, Defendant’s counsel requested an opportunity to examine the state’s witness outside the presence of the jury. Whereupon, a hearing was conducted in the absence of the jury. . From the evidence presented, the undersigned finds as facts the following by at least a preponderance of the evidence: 1. Defendant was placed under arrest on August 4, 1999, by Brian Huffstickler (formerly of the Lincoln County Sheriff’s Department, now a Trooper with the North Carolina Highway Patrol), and charged with carrying a concealed weapon and trafficking in cocaine. 2. On August 4, 1999, the Lincoln County Sheriff’s Department, acting in conjunction with the North Carolina Highway Patrol, set up a drivers license checking station on ____________ Road in Lincoln County during the evening hours. Upon setting up the checkpoint, the officers proceeded to stop each vehicle traveling on the roadway and checked for valid drivers licenses, vehicle inspection stickers, seat belts and other violations. 3. At approximately 9:40 p.m., a 1989 black Acura Legend approached the checkpoint, being driven by David Cook. Upon approaching the checkpoint, the driver of the vehicle did not stop, despite gestures and instructions by the officers directing him to stop. The vehicle went through the checkpoint and continued for approximately 60 feet before the officers finally got the vehicle stopped. 4. As the Acura drove through the checkpoint, Officer Huffstickler was able to see the occupants of the vehicle. He recognized the Defendant as being the passenger riding in the right front seat of the vehicle, which was being driven by David
