9 Administration<br />

29 Transitional arrangements<br />

29.1 From 1 July 2011 signatories must not enrol or continue to enrol young international students who are not<br />

living with a parent, without approval from <strong>the</strong> Administrator as set out in clauses 15.5, 27.3, and 27.4.<br />

29.2 From 31 December 2011 signatories may place or continue to place international students aged 10 and under<br />

in a licensed hostel only if <strong>the</strong> student is enrolled in Years 1-6 <strong>of</strong> a school, <strong>the</strong> hostel is a school hostel, and<br />

<strong>the</strong> signatory has approval from <strong>the</strong> Administrator as set out in clauses 15.5, 27.3, and 27.4.<br />

29.3 Complaints brought to <strong>the</strong> attention <strong>of</strong> <strong>the</strong> IEAA or <strong>the</strong> Review Panel prior to <strong>the</strong> coming into <strong>for</strong>ce <strong>of</strong> <strong>the</strong><br />

<strong>Code</strong> (Revised 2010) will be dealt with under <strong>the</strong> <strong>Code</strong> as revised in 2003.<br />

30 Amendments to <strong>the</strong> <strong>Code</strong><br />

30.1 The Administrator must give signatories written notice <strong>of</strong> any intention to amend any <strong>of</strong> <strong>the</strong> provisions<br />

<strong>of</strong> <strong>the</strong> <strong>Code</strong>, and provide <strong>the</strong>m with at least 20 working days to make submissions about <strong>the</strong> proposed<br />

amendment(s).<br />

30.2 After receiving submissions, <strong>the</strong> Administrator must seek <strong>the</strong> approval in writing <strong>of</strong> <strong>the</strong> Minister to <strong>the</strong><br />

proposed amendment(s).<br />

30.3 Any amendment(s) to <strong>the</strong> <strong>Code</strong> will be notified in <strong>the</strong> New Zealand Gazette.<br />

31 Transfer <strong>of</strong> <strong>the</strong> administration <strong>of</strong> <strong>the</strong> <strong>Code</strong><br />

31.1 The administration <strong>of</strong> <strong>the</strong> <strong>Code</strong> may be transferred from <strong>the</strong> current Administrator to ano<strong>the</strong>r body with <strong>the</strong><br />

agreement <strong>of</strong> that body.<br />

31.2 A representative industry body may propose to <strong>the</strong> Minister that <strong>the</strong> administration <strong>of</strong> <strong>the</strong> <strong>Code</strong> be<br />

transferred.<br />

31.3 The current Administrator must give signatories notice <strong>of</strong> its intention to transfer <strong>the</strong> administration <strong>of</strong> <strong>the</strong><br />

<strong>Code</strong>, and any consequential amendments to <strong>the</strong> <strong>Code</strong> arising from <strong>the</strong> transfer, and provide <strong>the</strong>m with at<br />

least 20 working days to make submissions about <strong>the</strong> proposal.<br />

31.4 The Minister will make a decision on <strong>the</strong> proposed transfer and <strong>the</strong> consequential amendments to <strong>the</strong> <strong>Code</strong><br />

after considering <strong>the</strong> advice <strong>of</strong> <strong>the</strong> current and prospective Administrator, and any submissions made by<br />

signatories to <strong>the</strong> <strong>Code</strong>.<br />

31.5 Any transfer <strong>of</strong> <strong>the</strong> administration <strong>of</strong> <strong>the</strong> <strong>Code</strong> will be notified in <strong>the</strong> New Zealand Gazette.
