Warranties PORCHER TERMS AND CONDITIONS OF SALE Prices: All prices are subject to change without notice and are exclusive of any shipping, delivery, packaging or handling charges that may apply. Freight: Shipper reserves the right to ship the merchandise via the method and carrier of their choosing. Cancellations/Order Changes: Any changes or cancellations must be made before your order leaves the shipper’s warehouse. Once the shipment has left the warehouse, the client is liable for all related shipping charges (including return of any unwanted merchandise) and restocking charges. Claims: Claims for shortages must be made within 5 days from receipt of goods. Any claim for a shipment not received must be reported within 30 days from invoice date. Returns: No merchandise may be returned for credit or replacement without the express written approval of the shipper. Returned merchandise must be in first-quality, resale condition and shipped prepaid in its original packaging. NO returns will be accepted beyond forty-five (45) days from original date of shipment. Special order items will not be accepted for return. A 25% restocking and administrative charge will apply on all returns. Freight Claims: Upon delivery of the merchandise, the client should examine the packaging for damage. Client must note on bill of lading when signing for truck orders: “MERCHANDISE SUBJECT TO INSPECTION” (not necessary on parcel carriers). If not noted, PORCHER will not take responsibility for filing a claim. Any damage should be noted on the carrier’s delivery receipt before signing. In the event of apparent concealed damage or shortage, the client should retain all packaging and file a claim with the carrier. The shipper’s responsibility ceases when the merchandise is delivered in good condition to the carrier. PORCHER will NOT file or pay freight damaged claims unless filed with Customer Service within 14 days of receipt of product. PORCHER TOILET LIMITED WARRANTY This toilet comes with a limited lifetime warranty on chinaware, a limited 10 year warranty on all mechanical parts of the toilet, and a limited 1 year warranty on the toilet seat if included with product. If inspection of this Porcher plumbing product, inclusive of the chinaware and all mechanical parts, confirms that it is defective in materials or workmanship, Porcher will repair or, at its option, exchange the product for the same or a similar model. This limited warranty applies only to the original non-commercial purchaser and installation of the products. In the event of a limited warranty claim, proof of purchase will be required – save sales receipts. For this warranty to become effective, the warranty registration process must be completed via the internet or telephone per the warranty registration instructions. This limited warranty does not apply to commercial installations. The warranty for commercial installations is 10 years on chinaware and mechanical parts, and 1 year on the toilet seat if included with product. This warranty does not apply to local building code compliance. Since local building codes vary considerably, the purchaser of the product should check with a local building or plumbing contractor to ensure local code compliance before installation. This warranty will be void if the product has been moved from its initial place of installation; if it has been subjected to faulty maintenance, abuse, misuse, accident or other damage; if it was not installed in accordance with Porcher’s instructions; or if it has been modified in a manner inconsistent with the product as shipped by Porcher. WARNING: This warranty DOES NOT COVER any damages caused by the use of in-tank cleaners. These products can seriously corrode the fittings in the tank. This damage can cause leakage and property damage. Porcher will not be responsible or liable for any damage caused by the use of in-tank cleaners. Porcher’s option to repair or exchange the product under this warranty does not cover any labor or other costs of removal or installation including any costs of any surrounding material such as tile or marble. Porcher is not responsible for any other incidental or consequential damages attributed to a product defect. (Some states or provinces do not allow the exclusion or limitation of implied warranties, so this exclusion may not apply to you.) This warranty gives you specific rights.
