BOAT SLIP RENTAL AGREEMENT<br />
THIS AGREEMENT, made this day <strong>of</strong> , 20 , by and between The<br />
<strong>Town</strong> Council <strong>of</strong> <strong>Centreville</strong>, <strong>Centreville</strong>, MD, party <strong>of</strong> the first part, hereinafter called<br />
“LESSOR” and<br />
, party <strong>of</strong> the second<br />
party, hereinafter called “LESSEE”.<br />
WITNESSETH, that for and in consideration <strong>of</strong> the sum <strong>of</strong> one thousand dollars ($1,000.00),<br />
the receipt <strong>of</strong> which is hereby acknowledged, the Lessor does hereby lease unto the Lessee <strong>Boat</strong><br />
<strong>Slip</strong> No. at the <strong>Centreville</strong> Wharf, Watson Road, for a period <strong>of</strong> twelve (12)<br />
months, beginning April 1, 2012 and ending March 31, 2013, subject to the following terms and<br />
conditions:<br />
1. <strong>Boat</strong> slip must only be used for storage <strong>of</strong> the following described craft:<br />

The boat must be registered to the Lessee. NOTE: Lessee is required to provide a copy <strong>of</strong> valid owner<br />
registration to the <strong>Town</strong> at signing <strong>of</strong> this agreement. The slip must be occupied by the above described<br />
vessel at least 8 months <strong>of</strong> the year. In winter months (December, January, February, and March), if the slip<br />
holder’s vessel is not kept in the slip, the slip holder may permit others to occupy the slip, but may not do so for<br />
pr<strong>of</strong>it. The <strong>Town</strong> encourages slip holders that do not utilize their slip in the winter months to be considerate <strong>of</strong><br />
local waterman who could benefit from a slip in those months. If the slip holder chooses to allow another to<br />
occupy the slip, during winter months, the <strong>Town</strong> <strong>of</strong> <strong>Centreville</strong> must be notified in writing, and must also<br />
approve the occupation. Failure to do so will eliminate the Lessee from being eligible for the annual slip lottery<br />
for the subsequent lease year.<br />
2. The town encourages anyone that has a boat slip without a vessel to relinquish said slip for distribution<br />
according to The General Rules & Regulations for <strong>Centreville</strong> Wharf and <strong>Boat</strong> <strong>Slip</strong> Rules & Regulations<br />
attached hereto. If the slip is voluntarily relinquished, and re-leased, that person will receive a prorated refund<br />
<strong>of</strong> the annual rent paid.<br />
3. Should Lessee acquire a different boat, the Lessor must be notified in writing within Ten (10) days and<br />
appropriate documentation provided.<br />
4. This agreement shall NOT be assigned nor said boat slip be sub-leased. Any other attempt to assign, sublet, or<br />
otherwise allow other persons to utilize said boat slip will result in termination <strong>of</strong> this <strong>Agreement</strong>, and<br />
ineligibility for the following year’s slip lottery. However, it is acceptable for the spouse <strong>of</strong> the slip holder to<br />
occupy the slip in the event <strong>of</strong> death <strong>of</strong> the slip holder and the slip may then be transferred to said spouse. In<br />

the event that the spouse does not want the slip, it will be granted to the next person on the boat slip waiting list.<br />
It will not be transferable to another family member.<br />
5. The boat using said slip shall be seaworthy and must be kept afloat and in good repair. No unsafe or dilapidated<br />
boats shall be allowed to use a slip. The Lessor reserves the right to deem a boat unsafe or dilapidated and<br />
reserves the right to remove a boat so designated at the expense <strong>of</strong> the Lessee, without giving any prior notice.<br />
Lessee agrees to indemnify full and reimburse the <strong>Town</strong> for any expenses incurred in removing a vessel<br />
pursuant to this provision.<br />
6. Lessee shall indemnify Lessor for any damage done to said boat slip or the <strong>Centreville</strong> Wharf, including actual<br />
repair and/or replacement cost arising out <strong>of</strong>, caused by, or in anyway related to the use <strong>of</strong> said boat slip or the<br />
<strong>Centreville</strong> Wharf, by Lessee, its agents, employees or invitees. Lessee shall maintain liability and property<br />
damage insurance on boat assigned to said slip.<br />
7. Lessee shall vacate the boat slip at the termination <strong>of</strong> the lease in the same condition as is at the commencement<br />
<strong>of</strong> said term, with reasonable wear, tear, and damage by the elements excepted.<br />
8. Lessee shall not live or permit anyone to live on the vessel while kept at said boat slip.<br />
9. The Lessee covenants and agrees not to do or suffer anything to be done which may injure, damage, or<br />
endanger persons or property in or about, or adjacent to, the leased boat slip. Lessee knows, understands, and<br />
acknowledges the risks and hazards associated with using said boat slip and the <strong>Centreville</strong> Wharf and the<br />
Lessee agrees to indemnify and save harmless the Lessor, its successors and assigns, from any claim <strong>of</strong> any<br />
person, including Lessee, for injury to life, person, or property resulting from or in any way related to the<br />
Lessee’s use and occupation <strong>of</strong> said leased boat slip and/or the <strong>Centreville</strong> Wharf.<br />
10. The Lessee shall not leave trash, engine parts, or any other type <strong>of</strong> debris on the dock area or Wharf at any time.<br />
Motor oil will be disposed <strong>of</strong> properly and in accordance with the law. The <strong>Town</strong> <strong>of</strong> <strong>Centreville</strong> DOES NOT<br />
collect motor oil and dumping oil into the river or trash receptacles is illegal.<br />
11. The Lessee agrees to comply with all reasonable requests made by the Lessor.<br />
12. Any emergency response organization, including but not limited to, police, fire, EMS, and representatives <strong>of</strong> the<br />
<strong>Town</strong> <strong>of</strong> <strong>Centreville</strong> shall have the authority to board the vessel described in paragraph 1 above, as required to<br />
carry out their <strong>of</strong>ficial duties. The owner shall be liable for any costs incurred in carrying out such duties.<br />
13. Lessee’s failure to comply with any <strong>of</strong> the above terms and conditions automatically terminates this agreement.<br />
14. This lease is not renewed automatically. The <strong>Town</strong> will hold an annual lottery based on the <strong>of</strong>ficial boat slip<br />
interest list maintained at <strong>Town</strong> Hall. Payment in full must be received within 15 calendar days <strong>of</strong> notification<br />
<strong>of</strong> Lessor’s <strong>of</strong>fer <strong>of</strong> lease to Lessee. Failure to pay slip rent in full within 15 days <strong>of</strong> such notice in the<br />
applicable year will result in termination <strong>of</strong> slip rental rights and slip will be <strong>of</strong>fered for lease pursuant to The<br />
Rules & Regulations for <strong>Centreville</strong> Wharf attached hereto. Make checks payable to: <strong>Town</strong> <strong>of</strong> <strong>Centreville</strong><br />
15. If it is necessary to increase the annual rental fee, the Lessee will be so notified prior to signing.<br />
16. Parking at the <strong>Centreville</strong> Wharf is on a first-come, first-served basis and is not guaranteed to Lessee. There is<br />
no trailer parking allowed at the <strong>Centreville</strong> Wharf at any time.<br />

17. Lessee shall be responsible for payment <strong>of</strong> any and all costs, including attorney fees, associated with the<br />
enforcement <strong>of</strong> this <strong>Agreement</strong> and/or collection <strong>of</strong> monies owed to Lessor pursuant to this <strong>Agreement</strong>.<br />
18. Lessee may switch slips only after all vacancies are filled, and with the approval <strong>of</strong> the Lessor.<br />
19. The disposal <strong>of</strong> bait, animal carcasses, shell fish, etc., at the <strong>Centreville</strong> Wharf or in adjacent waters is<br />
prohibited.<br />
20. The <strong>Town</strong> may perform random checks to confirm Lessee’s assigned boat is in assigned slip. If assigned boat is<br />
not in assigned slip during the check, Lessee will be notified. If another boat is in assigned slip on 3 or more<br />
occasions, this lease may be immediately terminated, and slip will be leased to the next person on the slip list,<br />
according to the rules & regulations governing the Wharf.<br />
21. Only one slip per household.<br />
22. The <strong>Town</strong> <strong>of</strong> <strong>Centreville</strong> reserves the right to conduct routine maintenance and may ask for a boat(s) to be<br />
removed to allow for the completion <strong>of</strong> required maintenance.<br />
23. Any boat occupying a slip after the termination <strong>of</strong> this lease will be subject to a rental rate <strong>of</strong> $20.00 per day.<br />
The Lessor agrees to pay this rental fee to the <strong>Town</strong> if the Lessor fails to remove the Lessor’s boat upon the<br />
termination <strong>of</strong> this rental agreement. The <strong>Town</strong> reserves the right to impound any boat that occupies a slip after<br />
the termination <strong>of</strong> this agreement. Impounded boats shall be subject to a charge equal to the <strong>Town</strong>’s total out<strong>of</strong>-pocket<br />
cost per day until the boat is retrieved by the owner. Lessor consents to personal jurisdiction in courts<br />
sitting in the State <strong>of</strong> <strong>Maryland</strong> and further consents to venue in Queen Anne’s County with respect to the<br />
enforcement <strong>of</strong> this <strong>Slip</strong> Rental <strong>Agreement</strong>.<br />
