c. The lot will be opened for the Town’s semi-annual municipal auction, usually held in May and October. d. Should access to the lot be necessary outside of the regularly scheduled Impound Lot hours, the Tow Company will receive an after hours access fee of $75 which will be assessed to the violator. A 30-minute response time is required by the Tow Company. e. Police tows of vehicles pending forfeiture review relating to Controlled Dangerous substance are excluded from storage fees because of due process and other legal ramifications. f. Police tows of vehicles being held for forensic processing are excluded from storage fees. g. Police tows of recovered stolen vehicles are excluded from storage fees for 48 hours. Section 7. Inspection of Vehicle and Inventory The Tow company impoundment custodian shall, prior to taking any vehicle for impoundment, observe the exterior of said vehicle and note on an inventory sheet any obvious scratches, dents or other damage to the vehicle. He shall also indicate whether or not he keys are in said vehicles and whether or not the vehicle, including the trunk, is locked or unlocked. He shall also do an inventory of the contents of the vehicle by observation, including the contents of the trunk if the trunk is unlocked. If any suspected contraband or weapons are observed, contact Ocean City Police Department immediately. Section 8. Maintenance of Vehicles During Impoundment The Tow Company shall keep the keys to the vehicle, if same are therein, in his possession at all times while the vehicle is impounded. He shall keep the impounded vehicle under observation and make periodic inspections of all impounded vehicles Section 9. Release of Towed Vehicles Once the appropriate tow fees are paid in the Ocean City Police Department Records Office, a faxed authorization to release the vehicle will be forwarded to the impound lot. No vehicle may be released without this authorization and identification as to the appropriate owner or individual retrieving the vehicle. Section 10. Private Tows The Tow Company must accommodate the towing of private tows into the impound lot, which may be performed by other tow operators. When these private tows are brought into the lot, the Tow operator must fax the private tow affidavits to the Ocean City Police Department Records Office and follow the same procedures as noted in Sections 7 and 8 above. The Tow Company must accept these tows and cannot charge any additional fees or storage charges. Should access to the Impound Lot be necessary as the result of a private tow when the Impound Lot is not opened, a 30-minute response time is required and the after hours fee of $75 will be assessed to the violator as indicated in Section 6 above. Section 11. Payment of Towing and Storage Fees a. All payments for Tows will be made in the Records Department at the Public Safety Building. b. Authorized release of a vehicle will be determined by records personnel and faxed to the Tow Operator at the Impound Lot.
c. Reimbursement for towing and storage fees will be made to the Tow Company every two weeks. d. In the event the Records Office is closed, but the Impound Lot is open, the Ocean City Police Department front desk will accept fees and fax appropriate paper work to the Impound lot custodian for the Tow Company. Section 12. Tow Hearings for Police Tows a. As provided in Section 90-234 of the Code of the Town of Ocean City, the owner of all towed vehicles may file a request-for-hearing form with the Ocean City Police Department. b. Upon following the procedures outlined in these sections, should a determination be made that the vehicle was not abandoned nor illegally parked, reimbursement for the tow and storage fees shall be made to the owner. Reimbursement to the owner will be made by the Town of Ocean and is not the obligation of the Tow Company. Section 12. Maximum Tow Charges, Labor and Storage The maximum tow charges as outlined in Section 9-227 of the Ocean City Code will remain as listed below. The successful Tow Operator will be reimbursed for the storage fees at the rate of $20 for the first day and $25 for each day thereafter for all vehicles towed into the Impound Lot. The Town of Ocean City will continue to collect the $25 administrative fee for the processing of all tows. Term of Contract The successful bidder agrees to operate the Towing and Impound Lot as specified for a period of 3 years. Upon written request and mutual agreement with the Town of Ocean City, the Tow Operator may request an additional 2 years at a 10% increase.
