I've been trying to figure out if I could post a link to something so I can provide 

verification to certain facts without having to redact the document. It turns out in 

the end it is simpler to redact the private information. Then I've been trying to 

figure out why my scanner was making copies of the documents that were a 

quarter of the size of the normal document, I have no idea but they only shrink 

when you print them not when you view them so I'll just have to work with what 

I have.

think of this process should be directed at me and not them as they didn't do, 

they in fact have no more information than you do. And then in fact are why I'm

what has transpired to date.

I'm not trying to be dramatic, I'm not trying to drum up sympathy. I'm just here 

to give you as much of the story as I can. I'm not going to supply the whole 

story, there will still be some events that you are in the dark about. But I'll give 

you everything that is not personal in nature. And again I don't mean I have 

personal problems that came up like I needed a new car and stole your money. I 

mean there have arisen from this situation some problems that I consider 

personal problems and I will not be putting that information out to the general 

public. 

I would however consider validating this entire timeline with any one person of 

the groups choosing (assuming its someone I agree with). I would have said 

with Mark and/or JD but its clear you have let your opinion of me influence your 

opinion of them and you may not want it to be them. I could suggest MD Dave 

(he's well known in the cigar community but is not a member of this board) or 

possibly Phil as I'll be in San Francisco for work for two days this week and could 

drive out and meet him. I will provide the party of your designation copies of all 

documentation to examine and verify, I can have those copies notarized if 

desired.

I'm editing this because chat users are saying I'm not clear: 

To start with the basics of the group buys are that I promise the vendor that we 

will purchase whats been allotted to us by commitment time. Commitment time 

is when I start collecting payment. So typically by that time I've made payment 

arrangement or arranged to have the merchandise held via credit. However 

every payment we've ever made we've made via wire, in the end it saves us 

money by removing the CC transaction fees on all sides. Sometimes when I'm 

waiting to make payment what I actually meant was I was waiting to be sure I 

would not get screwed on additional payment. 

Thats how I get the boxes I don't want is I pick them up when you say "Hey I 

can't, don't want to, etc" 

Also some of people pay in advance. Like when I started collecting for GB10, 



GB11 had already been posted as available. So some of you (AnacostiaKat and 

Skibum do this a lot) just paid GB10 and GB11 at the same time. So I would 

always have money in my account that I wasn't supposed to have there. 

So whenever I do a wire to the vendor I just transfer everything thats been paid 

for any GB. So instead of me having the money in my account I let the vendor 

hold the payments on the upcoming GB by paying in advance. I just kind of felt 

like that was better all around in case my account was negatively impacted in 

some way. (I don't write checks but I was more comfortable with them holding 

the money than i was holding it). 

So when I sent this wire in March about $2800 of this (give or take by my 

recollection) was credit towards GB11. 

Hopefully those edits made it more clear.

After that we had a bit of a slowdown where I thought both 11 and 12 would be 

cancelled. During that time I ended up having to amend my business license and 

pay a small amount of tax on the GB payments because I commingled this 

money with my regular business. So once we decided to move ahead and this 

tax issue was resolved I then sent a payment for GB11 and GB 12. The same 

information is redacted as was on the previous image.

Just like usual I checked my account to make sure the proper amount had been 

sent and emailed a copy of the form to the vendor. 

I then had to deal with some issues surrounding boxes that should have been 

returned on two occasions. In one instance the vendor shipped out replacement 

boxes in December/January for boxes that had went missing in November. When 

the vendor tried to collect the insurance on the packages they all started to show 

up (this was in March several people can confirm this having happened). The 

vendor wanted those boxes back or for me to pay for them. So I paid for them. 

Of the six boxes two of them I'm sure I'll either get money for OR get the boxes 

back to return them. Once I return the boxes I'll receive a credit for what I paid 

for them. The others I'm assuming they are already a lost cause as those parties 

don't seem to be around anymore. 

The other boxes had various issues and were replaced, but the damaged boxes 

were never returned. So I paid for those too. 

We argued over these two items pretty strongly because I didn't want to pay for 

boxes I neither had nor wanted and with us deciding to cancel the GB 

arrangement we were not exactly skyrocketing to the top of the vendors 

christmas card list. So after this time had passed we discovered an issue with the 



second wire transfer listed here. I'm speculating but it seems to take a couple of 

days between the time I send a transfer and the time they get it. But this had 

been hanging out there and it had taken more than a couple weeks. The 

information on the wire document is correct so it wasn't the issue. The $27k was 

deducted from my account balance not in a pending status, so that wasn't the 

issue. The vendor was checking a couple of times a day so we were sure it 

wasn't on his end. So I thought I had to go into the bank to find out what the 

issue was and how to resolve it. 

At the bank I was given the contact numbers of the people who could resolve my 

problem and instructions for what I needed to do. That one problem became two 

problems but they are both personal. Its not that they aren't significant problems 

but failure to resolve them will not affect anyone in this GB other than me thats 

why I say they are personal.

After consulting with professional help I was given varying estimates on what 

exactly was going to make that problem go away and what would happen with 

the transfer when the problem was resolved. So it became pretty obvious that I 



needed to find another way to resolve the issue rather than to wait for the 

problem to be fixed so from there I made arrangements to send two more wire 

transfers (posted below). This again covered our balance on GB11 and also a bit 

of GB12.

I have to note that these GB's were sponsored by the forum.

I understand what you're getting at, but given the turn this thread has taken 

who knows how the would be callers would act.... 

And you're 100% correct that the posts Bryan makes are encrypted and hard to

Gentlemen, 

As Bryan stated, Jason and I have been disconnected from the GB process the 

entire time. In hindsight, this obviously wasn't the best approach. 

Jason and I are the owners of HB, there are no other "private" owners. The only 

mod was Bryan and he was limited to only the GB forum since that was his baby. 

The decision to stop doing GB's was because we thought they were becoming 

too big and too slow. Shortly after stating that we no longer wanted to GBs, GB 

11 and 12 started to go south. 

Since Bryan successfully ran 10 group buys previously, we thought we were 

getting information that would have led to a resolution of GBs 11 and 12. 

It became apparent that the information we were getting was the same 

information as his "updates" in the GB 11 thread. 

Don't mistake our silence for complacency; we've been playing this delicately as 

we thought this was our best chance for resolution. 

Additionally, I have the same sentiment as many others in the GB. 

I am in GB 11 for $2,000, I would rather have had some communication from 

Bryan than zero communication. Contrary to some people's misconception, 

$2,000 is a substantial amount of money to me. 

The only consistency in all of these "updates" is that there "will" be a resolution, 

albeit, slow. We can only hope that Bryan follows through.

Thanks for chiming in. It's good to know that although we haven't heard much 

from the owners of this board that they are trying to help. It's unclear to me 

what exactly the problem is and I'm wondering if perhaps you can summarize it 

as many here are having trouble following Bryan's long and winding updates. 

Where did the money go? Has DG been paid and what have they been paid for? 

Do you expect "resolution" will be refunds or cigars? Has anything been shipped 

at this point? What happened to all those tracking numbers Bryan said he has? 

If it was clear to people that the GB's were going down the drain, why were they 

allowed to continue? I'm pretty new to HB and I had no idea. I have so many 

questions, but the most important is what's the current status of 11 & 12 and 

what can we expect going forward?

$27,000. While this is proof that funds were transfered, it does not show what it 

paid for. 

1. When will we see the documentation of what was paid for and what was

3. Can you (Mark or Jason) verify with the vendor what has transpired and what 

the actual truth is in all this?

Sorry unless I am mistaken those "copies" don't prove anything. They 

could have been blanks that someone fixed up. 

Also one of them show an available balance of aprox 18,000, with the 

wire transfer amount of 27,000. Don't think they do that kind of 

transfer...and why cover up the date at the bottom of when the 

transfer was made? 

I hope I am wrong. I'm trying to make sense of this mess as everyone.

group buys, imo. That eliminated any "float" from future group buys that could

talking with JD and Mark and can say two things: 

1) I really believe they had nothing to do with this mess and are trying 

everything they can to resolve it. 

2) There will be more concrete/detailed information made available here in the 

next 24 hours. 

As I said, I and many others are tracking this very closely and I have absolutely 

zero motivation to 'calm the natives' by relaying anything except the facts known 

to me. If it were my money at stake I would be very pissed off at this point, but 

I can now say with confidence that there is much work going on out of view and 

there is reason to be patient for the next day for answers to materialize.

Please let me preface this by saying that the responses that we get from Bryan 

have been as cryptic as his posts and sometimes his posts are verbatim, so we 

have no "private" or "behind the scene" discussions with Bryan. 

Jason and I have been working to try to get some information in attempt to help 

all of us understand what is actually going on. 

We finally got in touch with the vendor yesterday and this is what we were told. 

1/2 of GB 11 has been paid for 

GB 11 has not shipped and will not ship until it's 100% paid for 

Zero money has been paid for GB 12 

GB 12 will not ship until it's 100% paid for 

After being told this, we contacted Phil (insight) to find out his opinion as how 

we might proceed since he has experience with this kind of stuff. 

After our discussion with Phil, we contacted Bryan to let him know what the 

vendor told us and to provided him with suggestions as to how he might be able 

to quickly resolve this. 

Answers to some questions that we can help with, others can still only be 

answered by Bryan 

You are saying the GBs [are] dead? 

Yes (see above) 

No boxes have been shipped? 

Yes, no boxes have been shipped (see above) 

Will you start your fund raising efforts? 

That is dependent upon Bryan selling his collection to cover refunds for the GBs 

and/or replacing boxes from the GBs with those from his collection. 

Are we getting our cash back or cigars? 

Again, that is dependent upon Bryan selling his collection to cover refunds the 

GBs and/or replacing boxes from the GBs with those from his collection.

Are you raising money to pay the vendor for the balance? 

With only 1/2 of the GB 11 having been paid and zero for GB 12 having been 

paid, I think we are beyond that at this point. 

Are you refunding everyone's money? 

Again, that is dependent upon Bryan selling his collection to cover the GBs and/ 

or replacing boxes from the GBs with those from his collection. 

Was their profiting from HB GBs? 

Jason and I wanted to do GBs on HB for the benefit of HB members, plain and 

simple. Jason and I have never received anything for GBs (contrarily, we've 

spent thousands getting HB up and running). 

Who actually made the decision to end the GBs and why? 

Jason and I made the decision long before GB 11 and 12 went off the rails. It 

wasn't until we told Bryan that we no longer wished to continue GBs that things 

with GB 11 and GB 12 started to go south. 

There has also been some disparaging remarks about the "nova crew". The 

"nova crew" is simply a bunch of guys who happen to be from the same 

geographic local who have come together through the hobby over the years and 

have become friends. We manage to get together as schedules allow which isn't 

as frequently as we would like. While we are all varying degrees of friends, their 

isn't some big conspiracy between us all. 

There are approximately 8 or 9 guys (including myself) from this area that are on 

HB and participating in GBs 11 and 11 and who are getting screwed right along 

with everyone else. 

This is what was suggested. 

1.) Bryan obtain a refund from the vendor to refund 1/2 of GB 11 participants in 

the order in which payments were received. 

2.) Bryan compile a list of boxes that are available as "replacements" for the 

second 1/2 GB 11 and all of GB 12, who wish to participate in an exchange and 

offer them in the order in which payments were received. 

ie: first paid, gets first pick of equivalent value boxes for their GB commitment 

3.) Bryan compile a list of boxes for sale and sell them to cover refunds for the 

second 1/2 of GB 11 and all of GB 12 for those who do not wish to participate in 

a box exchange. 

While Bryan has made the first baby step by offering up his collection, what we 

really need is a timeline and list of inventory that is either for sale or offered up 

as replacement stock for the GBs. 

There has also been a lot of speculation as to what happened to the money, we 

have no idea, that question remains for Bryan to answer but I doubt he ever will. 

While it makes for an interesting read to those not involved, as a GB participant, 



I want resolution. 

That's just how we see it but in the end, it remains entirely up to Bryan as to 

how he intends on making things right. 

That's all the information we have to this point, so we are all again on the same 

page.

Edit to add... while I'm not privy to what Addiction's "stash" is like, I think 

everyone should temper expectations a bit; it's unlikely he has $15,000 in cigars 

laying around. It's likely that the "co-mingled" money from the group buy was 

left in Paris, and to pay other bills/life expenses that he had, and is gone. And 

that doesn't even get into GB12... 

The long and the short of it is that it sounds unlikely that he is rolled to be able 

to make this right himself, and the vendor is under no obligation to release the 

money or the cigars until the balance of the funds are received. They ordered 

merchandise specifically for this buy, and have had to pay for the boxes of 

cigars, and storage/handling in the interim.

Mark, thanks for getting us this information. I know this has answered all my 

questions except the one question you mentioned. 

This is the most unbelievable sh!t storm I've ever seen. I can't imagine that if 

Bryan stole from everyone that he has a cigar collection that could be liquidated 

to cover the short fall. Regardless, his unwillingness to own up to the problem 

that he created has shown him to be totally and utterly untrustworthy and I 

don't anticipate that in the end he will sell even a single cigar. My hope is that 

the vendor will return the funds already paid, but I am not holding my breath on 

that either. At this point, I consider the funds I put into GB 11 & 12 a total loss. 

If Bryan's collection is not entirely catalogued and put up for sale by the end of 

the week, he should be immediately put on the scumbag list. Even if he does, he 

probably should go on the list anyway. 

These were my first GBs and I sunk my entire (albeit meager) cigar budget for 

the year into them. I even sold some of my aged Opus X which I put tons of 

effort into procurring in order to fund my purchases. So, I just want to give a big 

THANK YOU to Bryan for stealing my money and absolutely ruining my chances

I am not a legal expert but what you say is accurate. This would also classify as 

fraud as well as grand larceny as well as mail fraud if I am correct. The latter

ending without any further delays. The 'defenders' of his inaction and lack of

Wanted to touch base and say that today some progress was made. 

I'm encouraged by the fact that the dialogue with Bryan has increased, he is 

engaged in conversations with myself and we've begun to discuss specifics on 

the inventory and the logistics around securing the boxes. 

What we're missing right now and would really like to have is a specific date for 

this to occur. Bryan doesn't know if his travel schedule will allow for this in the 

next 2-3 days, so I'm optimistic that we can get that ironed out and begin 

moving forward with a quick resolution. 

If he has anything to add, there's always an open invite to do it here in the 

thread.

IMVHO: 

1) If the vendor WILL refund what's been paid so far, then the money can be 

refunded directly to the offended parties on a first-paid, first-refunded system. If 

the vendor really won't give up the money already paid, then enough inventory 

will have to be sold to pay the balance, and then GB11 can ship. 

2) For GB12, the easiest way would be to "swap" exact boxes to start with. But 

he won't have enough exact boxes to cover everything. So from there: 

--An "equivalent box" could be offered for replacement 

--More inventory can be sold to offer cash refunds 

I'm assuming that, for whatever needs to be sold for cash, those boxes will be 

offered here first at a "group buy" type rate. Then if there are no takers Admin 

could offer them elsewhere. 

But obviously this is all in the hands of the site owners now (sorry guys, it's a 

sucky gig, hopefully this will be resolved quickly!)

refunded first. Why should people who paid first have more priority than other

As the old saying goes: two heads are better than one. 

For instance, I really like the idea of paying off GB 11 with some of the money 

raised so that those boxes can fly if and only if the vendor will not refund what 

has been paid toward that GB. In the end, the simplest and most likely scenario 



is that we take all the money raised/refunded and divy it up proportionately.

complicated by some chargebacks but we will begin that process soon and begin

Good morning gentlemen, 

Over the past week Jason and I have worked diligently in gathering as much 

information as possible in a relatively short period of time. 

We came up with a plan that would allow for Bryan to cover his debt for GBs 11 

and 12 and obtain collateral in form of boxes in order to protect the GB 

participants. 

This plan would allow GBs 11 and 12 to be paid in full and be completed. 

We procured enough boxes from Bryan over the weekend, 2 days ahead of 

schedule, to cover GB 11 and GB 12. 

As of this moment, BOTH GBs are slated to proceed but it hinges on a couple 

more hurdles that need to be cleared. 

Namely a large transfer that never went through to the vendor and that never 

was sent back to Bryan, which is what apparently started this whole debacle 

(Bryan eluded to it in his posts on 06/10), needs to be resolved. Meaning, it 

needs to be received by the vendor or returned to Bryan. 

The second is a wire transfer is supposed to be sent out by Bryan today 

06/18/2012. 

This transfer would take care of the balance of GB 11 so it can be released to the 

shipping department for processing. This will not occur until the vendor receives 

the transfer. Assuming it goes out today, the vendor should have it by the end of 

the week. 

We are supposed to receive proof from Bryan that the transfer was sent today. 

GB 12 would proceed when and if the large transfer goes through. If it is 

returned to Bryan, then proceeds from this sale will be sent to the vendor to 

complete the GB 12 payments and release those for processing and shipping. 

If it is not received by the vendor by the week of July 9th, then we will send the 

payment using the proceeds of this sale. 

We have also procured enough boxes to cover refunds for GB 11 in the event 

that the plan doesn’t shake out exactly as hoped. We’ll address having to refund 

GB 11 if that arises but we are hopeful that it will not. 

The GB 11 and GB 12 participants have been sent the list of boxes currently for 

sale as we promised they would have the first right of refusal. 

We'll post the list on Wednesday morning of any boxes that are remaining. 

We'll keep you updated as things proceed.

We have been in communication with the vendor over the past few days. 

They have confirmed receipt of the final GB 11 payment and have informed us 

that they have started the shipping procedures for GB 11. 

The GB 12 cooler sale is nearly complete with GB 12 nearly funded (awaiting 

incoming payments). There are just 2 boxes of Sig IIs to sell to cover GB 12. 



We'll update on GB 12 as we get closer to finalizing it via shipping or even the 

possibility of refunding GB 12 participants. 

We'd like to commend Bryan at this point for his open dialogue and willingness 

to see this through.

Unfortunately, the pm feature only allows for 5 pm's to be sent at a time. 

Doing the pm's for GB 11 payment verification and for the "cooler sale" was 

quite and under taking sending 5 at a time. 

I intended on sending tracking numbers once I got more than half of them (since 

there is going to be 110 tracking numbers in all) and once the strike is over so 

we can see movement on them. 

As of now, Bryan has received 21/110. 

Unfortunately, they are just holding until the strike is over which should be July 

5th. 

BTW - About 3/4 of those who had one box in GB 11 have a tracking number.

To add to this: 

Staff at state-owned air traffic control company NAV are walking off the job eight 

hours a day between June 29 and July 3. 

They are protesting cuts that are part of austerity measures demanded by

Well dang, I must of got the bad ones... I'd say 3 or 4 of the 6 or so had broken 

up feet and some pyramids had busted up caps. I got them to smoke not age or 

resell so it's not or wasn't a big deal, most of the GB cigars I have gotten have 

been smoked. I didn't and am not complaining because it wasn't a big deal to 

me, just responding to Sleve's questions...

I wonder if it has something to do with the vendor shipping sealed boxes? I do 

have a couple of the boxes that I have not opened, maybe I need to double 

check those. Most of the usual grey market guys open and inspect before 

sending out. Honestly if I did have an issue, I wouldn't be worried about it unless 

I lost a significant portion of the box.

We've had returns of 17 boxes exactly for different issues. Some of them I'd 

have said were small issues but any return that someone has asked for has been 

processed.

another buck a stick from a vendor i have had zero problems with.... I would 

seriously consider just paying more. I wasnt going to complain or send them 

bqck for sticks that were smokeable...... But less just say that im happy that im 

no longer temted by these GBs. Now i can focus on buying boxes i totally q

typically with international shipments, you'll see 1 update when they left the 

source location, then another many days or weeks later when they land in the 

destination country. Then its business as usual with city to city. You never know 

with tracking, i've had some wierd things happen on those tracking sites

When I looked closer at the box I actually noticed that more than half the cigars 

had some level of foot damage. That's pretty bad and were these NCs I would 

send them back to where they came from in a heartbeat. However, given the 

nature of the deal and how long it took to get this box, I just got out my pectin 



and went to work. They're not as pretty as they should be, but they should 

smoke fine. So, in the end, no big deal.
