EXEMPTION<br />
Application No. A381/2003<br />
The <strong>Victoria</strong>n Civil and Administrative<br />
Tribunal (the Tribunal) has considered an<br />
application, pursuant to Section 83 of the Equal<br />
Opportunity Act 1995 (the Act), by the<br />
International WomenÕs Development Agency<br />
(the applicant). The application for exemption is<br />
to enable the applicant to advertise for and<br />
employ females in all positions within the<br />
agency.<br />
Upon reading the material submitted in<br />
support of the application, including the<br />
affidavit of Suzette Mitchell, the Tribunal is<br />
satisfied that it is appropriate to grant an<br />
exemption from Sections 13, 100 and 195 of the<br />
Act to enable the applicant to advertise for and<br />
employ females in all positions within the<br />
agency.<br />
In granting this exemption the Tribunal<br />
noted:<br />
● the applicant is an international development<br />
agency working for the elimination of<br />
poverty and for the empowerment of women<br />
around the world;<br />
● the applicant assists women internationally<br />
to develop skills and to gain access to<br />
resources and promotes projects and programs<br />
which demonstrate womenÕs competence<br />
and effectiveness as agents of development<br />
in agriculture, marketing, manufacturing,<br />
health, education, water supply, housing and<br />
other fields;<br />
● the applicant is a voluntary organisation<br />
which undertakes development in partnership<br />
with women of other countries and<br />
Aboriginal and migrant women in Australia,<br />
and gives priority to working with women<br />
who suffer poverty and depression;<br />
● it is important that female field workers be<br />
employed in the agencyÕs international<br />
development projects because of the cultural<br />
sensitivities in relation to the women in the<br />
countries where those projects are undertaken<br />
and women in those countries will be more<br />
likely to communicate freely with the field<br />
workers if those workers are also women;<br />
● it is important to make local positions with<br />
the agency available to women only to<br />
encourage the self development of Australian<br />
women and to provide them with additional<br />
career paths;
