I & I Results in Sewer Backups, Overflows, and dB Bypasses Causing Permit itVi Violations • Violation of Clean Water Act, Regulatory Fines, Legal Action, etc. (R.S. 30:2076.2 and 30:2025, rev. 4/25/07) ‣ Negligent Violation: $2,500 to $25 25,000 per day/not more than 1 yr. imprisonment, or both. ‣ Known Violation (First violation): Fine of not less than $5,000 nor more than $50 50,000 000 per day of violation or 3 yrs. of imprisonment, or both. ‣ Known endangerment: Fine of not more than $250 250,000 000 or $1 million or imprisonment of not more than 15 years, or both. ‣ Civil Penalties: $32 32,500 per day for each violation. When a violation results in a discharge or disposal which causes serious damage to the environment, endangers human life or health, may be liable for an additional penalty of not more than $1 million.
I & I Results in Sewer Backups, Overflows, and Bypasses Causing Permit Violations (Cont’d) • On May 18, 2004, the Louisiana Department of Environmental Quality (LDEQ) issued a Compliance Order with Notice of Potential Penalty for 265 sewer system overflows (SSOs), which occurred between Sept. 1, 2001 –Jan Jan. 31, 2004. • From Jan. 2004 –April 2008, 365 overflows were reported to the LDEQ. These are not a part of the aforementioned Order. • For 265 SSOs, the approximate fine for Negligent Violations could be $662 662,500 to $6,625 625,000 000, OR $8,612 612,500 for Civil il Penalties, etc. • If LDEQ include the above 365 overflows, which occurred, from Jan. 2004 – Apr. 2008, the fine could be significantly greater ($912 912,500 to $9,125 125,000 OR $11 11,862 862,500 for civil penalties). **As such, the maximum fine could be: $15 15,750 750,000 000 for negligent violations OR $20 20,475 475,000 000.
