She left $10 for each of her servants, then specified dividends Charleston, S.C., USA
from various stocks & bonds be left to her sisters and on their
deaths to passed on to specified relatives. Nearly all her
nephews & neices benefited from her. One of her main
beneficiaries in the long term was to be Hugh Ralph Swinton,
her nephew. He was top receive the shares & stocks which
she left to her sisters for their lives.
She possessed stock refered to at "6% stock of S.C.", shares in
the "Union Insurance Co. of S.C., Union Bank Stock, & Fire
& Marine Insurance Co. of S.C. She also possessed "an interest"
in a house which was rented out. This was later sold "by order
of the Court of Equity to Mrs Samuel Syle". With her share of
the proceeds she bought 3 shares stock in the Bank of Charleston.
To the executors she left the dividends of12 shares of her 5%
stock of the state of S.C. to be paid quarterly to her slave
Minda who she left to her sister, Eliza Swinton. On Minda's
death this stock was to go to the Sabbeth School of the
Circular Church of Charleston. Minda was also left her
matress, Pavilion pillows, her patchwork quilt numbered 4,
her oldest looking glass, her 2 oldest trunks, oldest blankets
& sheets, her painted table, large Mahogany arm chair with
cushions & covers, her oldest saxony shawl & straw bonnets.
She named Hugh Swinton Legare, George W. Egleston, Andrew
P. Gready & John Haslett as her executors.
In 1835, Sept. 14: Hannah added a codicil re the sale of the
rented house & new shares in the Bank of Charleston.
1843, Apr. 22: Her will was proved before Thomas Lehre Esq., &
George W. Egleston & A.P. Gready qualified as executors.

Styled "Lord of that Ilk" (a);
1377: The King , probably through his advisers,
decided to restore the Swinton Lands to the rightful
owner (d). The intention most likely was to restore them
to Sir John de Swynton (XI who had served England
so well for 6 years. The King possibly saw the
merit of having such a powerful friend & knight
residing there who could be expected to keep the peace
in the troubled borders. When Sir John de Swynton (XI) returned to Scotland
to take up the estate he found Henry de Swinton (styled 'Lord of Swinton'), had
already taken possession of these lands. Henry was presumably, Sir John's uncle.
The question of which one was the rightful owner, following the forfeiture was resolved by
William, Earl of Douglas who produced the lands of Mykery, in the Barony of Strathurd,
Sheriffdom of Perthshire which Henry accepted in "amicable exchange" (d) for the Swinton
lands which were then settled on Sir John de Swynton.

& Sheriffdom of Berwick to Sir John of Swinton (witnessed by William Earl of
Douglas & Mar, James Lyndsay L. of Crawford, Alexander Lyn. L. of Glenesk,

1735: Mr John Stewart came to S.C. to practice
surgery. Being without money & starving he
lived with the Rev. Hugh Stewart for some
time. Rev. Hugh Stewart introduced him to
William Swinton 'the surveyor' who bought him a house. William recommended John
to his brother Hugh Swinton who had a large stock of medicines & medical instruments.
Hugh set him up in a shop in Georgetown, S.C. Hugh Swinton had to go to Charlestown,
returning after a month to find talk of a relationship between his wife and John. In her
father's hearing, Hugh's daughter said to John Stewart "Doctor you can't sleep along with Mama
in Papa's bed now Papa's come home". Confused & tired, Hugh threw himself on his bed.
As he lay there Stewart offered to bleed him (contary to practice in such cases). Suspecting
Stewart might prick an artery, Hugh refused. Hugh's wife came in crying, but then going
into the hall was seen by Hugh, smiling at Stewart. He then went into the field & complained
at the lack of work done by the slaves in his absence. He was told that the reason
was the frequent absences of his wife with Stewart in a canoe where they were seen
hugging & kissing. The house servants also confirmed their 'immodest' behaviour.
Hugh's wife denied these accusations, threatening the negroes that they would be burned for
telling lies. The next day she confessed that John Stewart had behaved towards her in a "vile,

and then jumped upon her, but she had been rescued by some negroes. Next Hugh tackled Stewart about
these allegations. Stewart confessed that he deserved death for his actions, then in the height
of rage, Hugh cut off one of Stewart's ears. Later he had Stewart carried into his house and
at his own expense, employed a surgeon to cure him. Some 20 days later Hugh gave Stewart a
horse and provisions plus a guide to send him to Virginia. Stewart got as far as Cape Clear, S.C. &
decided to stay there and pursue his practice. Later Stewart contracted the 'fever' occasioned
by drinking and died. Richard Wright, Chief Justice of South Carolina, had now issued a warrant for
Hugh Swinton's arrest, claiming that the crime of cutting off an ear was punishable by death.
Knowing that the evidence of negroes was not acceptable in his defense, Hugh decided to
go to England in order to ask the King's mercy rather than surrender himself for trail.
In 1737 he filed a petition in London. The petition was referred on19 April, 1738 to

1738, July 20: Hugh was among a group of plantation owners "possessed" of land
formerly granted to the Duke of Beaufort. They petitioned the Privy Council
(Colonial) against the application made by Samuel and Joseph Wragg who were
seeking to have this 12,000 acres set aside for themselves (f).
1740: described as Physician, Surgeon, & manic-depressive who invented a "rice-beating machine".
c1742: he returned to England, taking William's son
Hugh (aged 5 yrs) with him. Hugh's parents had both
died within a short time of each other. Young Hugh was
left in the care of his Aunt Margaret (or Magdaline)
(Swinton) Stewart, in London, Eng., who raised him.
1759: in this year an affadavit was filed in
Charleston on Dec. 26 that Hugh Swinton,
Dr of Physics, late of South Carolina died

1763: He was married at Jacksonboro by the Rev. Mr Barron.
He was reserved & reticent by nature, & with his expected fortune gone he became morose.
After married, his sister, Margaret came to live with them and resided there until her death.
In later life, when questioned by a daughter about her ancesters, his answer was always
"you have no reason to be ashamed of them, but as you have no inheritance or fortune, it
behooves us to be silent". The family then lost track of their ancestry.

died) as "Inspector of Indigo". In this position the Indigo
market was controlled to maintain a good price from the London importers. (b)
1776: Like his borther Alexander & cousin, William, he fought in the American War of
Independence on the side of Liberty. He became one of the 'Marion' field officers, taking a
conspicuous part in the actions. He was made Commissioner of Prisoners, a responsible
office, conducted by him with strict honour, honesty and compassion. He was respected
by the prisoners under his care.
For many years Hannah (Hayne) Splatt, his mother-in-law lived with them & died there.
1786: He was named as executor to the will of his mother-in-law, Hannah.
1809, Jan. 16: Hugh made his last will 6 days before his death
with his wife & son William as the main beneficiaries. His son
James & son-in-law Daniel Ward were named executors. (c)

baffled in his attempts to assail the Revolutionary patriots by land & sea, mounted what was
supposed to be the highest hill on Long Island to spy. This hill is still there and bears his

1687, July 16: (New York): James Graham to John Spragge - Mr Swinton is dead of an
apoplexy leaving his affairs in great confusion [Item 1348]. Issac was violently seized
with three fits of apoplexy; during the intervals between the fits he was sensible but
without apprehensions of death, however he was prevailed upon to make a will by which
he named Mr Delaval his executor, his affairs are in great confusion and he judged
that he would be in debt by about £300 (b).

There is a suggestion that he went to
America with step-parents; there is a
Cemetery of 'Soc. of Friends' (Quakers) at
Charleston which has graves of descendants; (a)
However it seems that he went to Ireland, probably
with the troops of Oliver Cromwell and settled
there. He changed his name to 'SINTON'.
He was a Quaker like his father, as were his descendants.
Perhaps it was his descendant John Sinton who
established the Sinton family in S. Carolina.
