deaths to passed on to specified relatives. Nearly all her<br />

nephews & neices benefited from her. One of her main<br />

beneficiaries in the long term was to be Hugh Ralph <strong>Swinton</strong>,<br />

her nephew. He was top receive the shares & stocks which<br />

she left to her sisters for their lives.<br />

She possessed stock refered to at "6% stock of S.C.", shares in<br />

the "Union Insurance Co. of S.C., Union Bank Stock, & Fire<br />

& Marine Insurance Co. of S.C. She also possessed "an interest"<br />

in a house which was rented out. This was later sold "by order<br />

of the Court of Equity to Mrs Samuel Syle". With her share of<br />

the proceeds she bought 3 shares stock in the Bank of Charleston.<br />

To the executors she left the dividends of12 shares of her 5%<br />

stock of the state of S.C. to be paid quarterly to her slave<br />

Minda who she left to her sister, Eliza <strong>Swinton</strong>. On Minda's<br />

death this stock was to go to the Sabbeth School of the<br />

Circular Church of Charleston. Minda was also left her<br />

matress, Pavilion pillows, her patchwork quilt numbered 4,<br />

her oldest looking glass, her 2 oldest trunks, oldest blankets<br />

& sheets, her painted table, large Mahogany arm chair with<br />

cushions & covers, her oldest saxony shawl & straw bonnets.<br />

She named Hugh <strong>Swinton</strong> Legare, George W. Egleston, Andrew<br />

P. Gready & John Haslett as her executors.<br />

In 1835, Sept. 14: Hannah added a codicil re the sale of the<br />

rented house & new shares in the Bank of Charleston.<br />

1843, Apr. 22: Her will was proved before Thomas Lehre Esq., &<br />

George W. Egleston & A.P. Gready qualified as executors.<br />

1377: The King , probably through his advisers,<br />

decided to restore the <strong>Swinton</strong> Lands to the rightful<br />

owner (d). The intention most likely was to restore them<br />

to Sir John de Swynton (XI who had served England<br />

so well for 6 years. The King possibly saw the<br />

merit of having such a powerful friend & knight<br />

residing there who could be expected to keep the peace<br />

in the troubled borders. When Sir John de Swynton (XI) returned to Scotland<br />

to take up the estate he found Henry de <strong>Swinton</strong> (styled 'Lord of <strong>Swinton</strong>'), had<br />

already taken possession of these lands. Henry was presumably, Sir John's uncle.<br />

The question of which one was the rightful owner, following the forfeiture was resolved by<br />

William, Earl of Douglas who produced the lands of Mykery, in the Barony of Strathurd,<br />

Sheriffdom of Perthshire which Henry accepted in "amicable exchange" (d) for the <strong>Swinton</strong><br />

lands which were then settled on Sir John de Swynton.<br />

surgery. Being without money & starving he<br />

lived with the Rev. Hugh Stewart for some<br />

time. Rev. Hugh Stewart introduced him to<br />

William <strong>Swinton</strong> 'the surveyor' who bought him a house. William recommended John<br />

to his brother Hugh <strong>Swinton</strong> who had a large stock of medicines & medical instruments.<br />

Hugh set him up in a shop in Georgetown, S.C. Hugh <strong>Swinton</strong> had to go to Charlestown,<br />

returning after a month to find talk of a relationship between his wife and John. In her<br />

father's hearing, Hugh's daughter said to John Stewart "Doctor you can't sleep along with Mama<br />

in Papa's bed now Papa's come home". Confused & tired, Hugh threw himself on his bed.<br />

As he lay there Stewart offered to bleed him (contary to practice in such cases). Suspecting<br />

Stewart might prick an artery, Hugh refused. Hugh's wife came in crying, but then going<br />

into the hall was seen by Hugh, smiling at Stewart. He then went into the field & complained<br />

at the lack of work done by the slaves in his absence. He was told that the reason<br />

was the frequent absences of his wife with Stewart in a canoe where they were seen<br />

hugging & kissing. The house servants also confirmed their 'immodest' behaviour.<br />

Hugh's wife denied these accusations, threatening the negroes that they would be burned for<br />

and then jumped upon her, but she had been rescued by some negroes. Next Hugh tackled Stewart about<br />

these allegations. Stewart confessed that he deserved death for his actions, then in the height<br />

of rage, Hugh cut off one of Stewart's ears. Later he had Stewart carried into his house and<br />

at his own expense, employed a surgeon to cure him. Some 20 days later Hugh gave Stewart a<br />

horse and provisions plus a guide to send him to Virginia. Stewart got as far as Cape Clear, S.C. &<br />

decided to stay there and pursue his practice. Later Stewart contracted the 'fever' occasioned<br />

by drinking and died. Richard Wright, Chief Justice of South Carolina, had now issued a warrant for<br />

Hugh <strong>Swinton</strong>'s arrest, claiming that the crime of cutting off an ear was punishable by death.<br />

Knowing that the evidence of negroes was not acceptable in his defense, Hugh decided to<br />

go to England in order to ask the King's mercy rather than surrender himself for trail.<br />

In 1737 he filed a petition in London. The petition was referred on19 April, 1738 to<br />

the Attorney-General for his opinion. (a) He feared that the punishment for the offence<br />

in South Carolina would be death & so had gone to England seeking the Kings pardon<br />

seeking to have this 12,000 acres set aside for themselves (f).<br />

1740: described as Physician, Surgeon, & manic-depressive who invented a "rice-beating machine".<br />

Hugh (aged 5 yrs) with him. Hugh's parents had both<br />

died within a short time of each other. Young Hugh was<br />

Independence on the side of Liberty. He became one of the 'Marion' field officers, taking a<br />

conspicuous part in the actions. He was made Commissioner of Prisoners, a responsible<br />

office, conducted by him with strict honour, honesty and compassion. He was respected<br />

by the prisoners under his care.<br />

For many years Hannah (Hayne) Splatt, his mother-in-law lived with them & died there.<br />

1786: He was named as executor to the will of his mother-in-law, Hannah.<br />

1809, Jan. 16: Hugh made his last will 6 days before his death<br />

with his wife & son William as the main beneficiaries. His son<br />

<strong>Swinton</strong> reported that Santen refused to say who were his deputy book-keepers [Item 1147].<br />

1687, July 16: (New York): James Graham to John Spragge - Mr <strong>Swinton</strong> is dead of an<br />

apoplexy leaving his affairs in great confusion [Item 1348]. Issac was violently seized<br />

with three fits of apoplexy; during the intervals between the fits he was sensible but<br />

without apprehensions of death, however he was prevailed upon to make a will by which<br />

he named Mr Delaval his executor, his affairs are in great confusion and he judged<br />

that he would be in debt by about £300 (b).<br />

However it seems that he went to Ireland, probably<br />

with the troops of Oliver Cromwell and settled<br />

there. He changed his name to 'SINTON'.<br />

He was a Quaker like his father, as were his descendants.<br />

Perhaps it was his descendant John Sinton who<br />

established the Sinton family in S. Carolina.<br />
