‘Potential cases’ under Part III of <strong>the</strong> <strong>Act</strong>, again in order to<br />

explore <strong>the</strong> barriers and difficulties faced in taking such<br />

cases, and <strong>the</strong> reasons <strong>for</strong> <strong>the</strong> relatively small number of such<br />

cases taken to date.<br />

At a more detailed level, <strong>the</strong> case studies aimed to explore <strong>the</strong><br />

following key issues:<br />

■ The processes underlying observed relationships<br />

between factors such as <strong>the</strong> characteristics of participants,<br />

<strong>the</strong> availability and quality of representation and support<br />

on <strong>the</strong> one hand, and case outcomes on <strong>the</strong> o<strong>the</strong>r hand.<br />

■ Access to justice issues, focusing on <strong>the</strong> factors<br />

influencing <strong>the</strong> relative paucity of certain types of cases<br />

(eg recruitment cases in Part II, and Part III cases in<br />

general).<br />

■ The barriers that disabled people experience in accessing<br />

advice about <strong>the</strong> <strong>DDA</strong>, and within <strong>the</strong><br />

adjudication/conciliation system itself.<br />

■ The effectiveness of <strong>the</strong> conciliation processes which are<br />

available to parties in <strong>DDA</strong> cases.<br />

■ The sources of in<strong>for</strong>mation and advice which disabled<br />

people, employers and service providers are using, and<br />

<strong>the</strong>ir views and experiences of <strong>the</strong> quality and utility of<br />

those sources.<br />

■ The impacts of <strong>the</strong> <strong>DDA</strong> cases on <strong>the</strong> parties in <strong>the</strong> case,<br />

distinguishing where possible between:<br />

❍ Immediate impacts on <strong>the</strong> parties while <strong>the</strong> case is<br />

ongoing.<br />

❍ Longer-term impacts, following a case, eg on <strong>the</strong><br />

behaviour and policies of employers/service-providers;<br />

on <strong>the</strong> motivation and well-being of disabled<br />

applicants/claimants in cases; and on <strong>the</strong> awareness<br />
