Present<br />

A list <strong>of</strong> all who registered their attendance at the public meet<strong>in</strong>g is attached.<br />

1. Welcome and Introduction<br />

The facilitator David Shandler <strong>of</strong> Common Ground welcomed all attendants to the<br />

first public meet<strong>in</strong>g <strong>in</strong> a participation process to be conducted on <strong>Transnet</strong>’s<br />

proposed Durban Port expansion. He expla<strong>in</strong>ed that the purpose <strong>of</strong> the process was<br />

to assist <strong>in</strong> ensur<strong>in</strong>g a wise outcome be achieved with regards to <strong>Transnet</strong>’s<br />

proposals to expand their conta<strong>in</strong>er handl<strong>in</strong>g facilities. In order for this to happen<br />

there will need to be a structured and ordered process that recognises and<br />

addresses each stakeholder’s hopes, fears, <strong>in</strong>terests and issues. The process also<br />

seeks to generate and <strong>in</strong>vestigate alternative proposals. It would aim to f<strong>in</strong>d creative<br />

solutions to obstacles and challenges. In order to fulfil these functions, the process is<br />

likely to be long and iterative. He assured participants that they could have significant<br />

<strong>in</strong>put <strong>in</strong> the process through a large number <strong>of</strong> engagement opportunities.<br />

The facilitator emphasised that this <strong>in</strong>itial phase <strong>of</strong> this process is not part <strong>of</strong> the EIA<br />

(Environmental Impact Assessment) process for this proposal, which is yet to beg<strong>in</strong>.<br />

This <strong>in</strong>itial phase <strong>of</strong> participation has begun prior to the EIA <strong>in</strong> order to communicate<br />

<strong>in</strong>formation on the proposed expansion to all <strong>in</strong>terested and affected parties and to<br />

<strong>in</strong>form these stakeholders about the upcom<strong>in</strong>g process. This public meet<strong>in</strong>g forms<br />

part <strong>of</strong> a broader participation exercise that will eventually feed <strong>in</strong>to an EIA process.<br />

2. The <strong>Proposed</strong> Development<br />

Krish Reddy, the General Manager for Plann<strong>in</strong>g <strong>in</strong> the <strong>Transnet</strong> Group, gave a<br />

presentation detail<strong>in</strong>g the challenges <strong>Transnet</strong> faces <strong>in</strong> particular with regards to their<br />

anticipated future demand and their correspond<strong>in</strong>g lack <strong>of</strong> capacity to handle such<br />

demand. He then went on to outl<strong>in</strong>e <strong>Transnet</strong>’s proposed solution – namely the<br />

expansion <strong>of</strong> a conta<strong>in</strong>er term<strong>in</strong>al <strong>in</strong>to the Bayhead area <strong>of</strong> the bay. He emphasised<br />

that <strong>Transnet</strong> has a s<strong>in</strong>cere commitment to pursue a solution that is susta<strong>in</strong>able. A<br />

Discussion<br />

Follow<strong>in</strong>g the presentation participants raised questions and concerns. Where<br />

requested by the facilitator, representatives <strong>of</strong> <strong>Transnet</strong> responded. The discussion<br />

is summarised by theme below.<br />

Traffic Issues<br />

A significant proportion <strong>of</strong> comments made at the meet<strong>in</strong>g were related to the<br />

problem <strong>of</strong> traffic congestion. A number <strong>of</strong> participants, particularly those<br />

represent<strong>in</strong>g residents around the port and recreational users <strong>of</strong> the bay, referred to<br />

the “havoc” on the roads around the harbour. They would like to see this problem<br />

solved as soon as possible. They argued that, <strong>in</strong>stead <strong>of</strong> reliev<strong>in</strong>g the situation,<br />

<strong>Transnet</strong>’s proposal seems to project a scenario where more trucks and cars will<br />

make use <strong>of</strong> the roads, thereby worsen<strong>in</strong>g the situation.<br />

Mario Steyn, <strong>of</strong> <strong>Transnet</strong> Projects, acknowledged the problem and <strong>in</strong>dicated that<br />

feasibility studies were be<strong>in</strong>g done to <strong>in</strong>form how best to deal with the traffic problem<br />

<strong>in</strong> both the short and the long term. He expla<strong>in</strong>ed how <strong>Transnet</strong>’s Bayhead proposal<br />

<strong>in</strong>tends to improve the traffic problem. He noted that as soon as dredg<strong>in</strong>g <strong>of</strong> the bas<strong>in</strong><br />

beg<strong>in</strong>s, Bayhead Road would be affected. An alternative road with several lanes will<br />

be constructed to replace Bayhead road, routed around the new development. L<strong>in</strong>ks<br />

will also be provided between this and other roads. He said that this new proposed<br />

road layout would be an upgrade from the current situation. He also expla<strong>in</strong>ed that<br />

<strong>Transnet</strong> was pursu<strong>in</strong>g a strategy to shift more freight, and particularly the growth <strong>in</strong><br />

freight, onto rail. The Bayhead development will <strong>in</strong>clude realign<strong>in</strong>g rail yards. The<br />

new rail system will be more efficient than the current system and is set to transport<br />

up to 50% <strong>of</strong> freight <strong>in</strong> the future, but designed to take up to 80% if required.<br />

A participant argued that <strong>in</strong>terim solutions were necessary and that improvements<br />

should not only be <strong>in</strong>stituted after 2010. Another argued that the new road planned<br />

would not be sufficient s<strong>in</strong>ce it only provides one access road to the port. He argued<br />

that this would not solve the congestion problem. He believed that the transport<br />

strategy around the new development had not been thought through sufficiently. He<br />

argued further that the shift to rail would not be successful as cargo was <strong>of</strong>ten time<br />

sensitive. Rail presents a much slower option than road transport. Mario Steyn<br />

expla<strong>in</strong>ed that the rail option would become feasible, as it would be made<br />

significantly more efficient by utilis<strong>in</strong>g 50 truck block tra<strong>in</strong>s with turn around times <strong>of</strong><br />

no longer than 3.5 hours per tra<strong>in</strong>.<br />

A Bluff resident noted that tip trucks carry<strong>in</strong>g concrete were be<strong>in</strong>g driven through the<br />

residential areas around the port on a daily basis. The facilitator noted that this po<strong>in</strong>t<br />

was not strictly applicable to the process on the proposed expansion. However, the<br />

comment was useful <strong>in</strong> that the issue <strong>of</strong> construction vehicles would become relevant<br />

if this project were to enter a construction phase.<br />

Recreation Issues<br />

Several participants asked for clarity on the future <strong>of</strong> recreational clubs <strong>in</strong> the bay. A<br />

member <strong>of</strong> the Kwa-Zulu Natal Row<strong>in</strong>g Association asked about the impact <strong>of</strong> the<br />

development on the recreational users <strong>in</strong> the silt canal. He noted that <strong>in</strong> <strong>Transnet</strong>’s<br />

presentation an artist’s impression <strong>of</strong> the development seemed to show that the clubs<br />

rema<strong>in</strong>ed <strong>in</strong>tact. On the other hand, plans <strong>in</strong>dicate that the silt canal will be converted<br />

<strong>in</strong>to a wetland or eco-system. He asked for details on this discrepancy. <strong>Transnet</strong>’s<br />

representative said that it was not possible at this stage to not give a def<strong>in</strong>itive<br />

answer on the future <strong>of</strong> the clubs. Several options for the silt canal are currently<br />

be<strong>in</strong>g considered. He did, however, say that <strong>Transnet</strong> recognised the value <strong>of</strong> the<br />

clubs and the opportunities for leisure that clubs provided <strong>in</strong> the bay. This issue will<br />

cont<strong>in</strong>ue to receive attention dur<strong>in</strong>g the feasibility study currently be<strong>in</strong>g undertaken.<br />

The future <strong>of</strong> the recreational clubs will be an important issue to address dur<strong>in</strong>g the<br />

EIA process.<br />

A participant asked that, if the clubs were allowed to rema<strong>in</strong> <strong>in</strong> the silt canal, better<br />

access to be area be provided to recreational users. He suggested that a separate<br />

road could be built that was restricted to use by small vehicles, thereby separat<strong>in</strong>g<br />

motor cars from large trucks.<br />

The Residential Interest<br />

Residents raised concerns that trucks are us<strong>in</strong>g residential roads to, and from, the<br />

port. Even though trucks are not permitted to use these roads, they cont<strong>in</strong>ue to do<br />

so. This is not safe and also damages the roads. Residents are concerned that this is<br />

not be<strong>in</strong>g monitored. Concern was also raised around the fact that there are only<br />

three ways <strong>in</strong> which the 30 000 residents <strong>of</strong> the Bluff can access the area. This was<br />

argued to be <strong>in</strong>sufficient. The facilitator noted that these issues were not strictly<br />

relevant to this process given that the scope <strong>of</strong> the process relates to <strong>Transnet</strong>’s<br />

proposed port expansion and not to the use <strong>of</strong> City managed roads. He added that<br />

he would try to direct such comments to the relevant authorities.<br />

Representatives <strong>of</strong> the Clairwood Residents’ Association raised concerns about the<br />

development and its effect on their community. They expressed fears about<br />

expropriation and sought clarity on the exact dimensions <strong>of</strong> the proposed expansion.<br />

They wanted assurances that this development will not advance <strong>in</strong>to their area. They<br />

were also concerned that the development will result <strong>in</strong> displaced companies and<br />

<strong>in</strong>dustries seek<strong>in</strong>g land <strong>in</strong> their community. The encroachment <strong>of</strong> <strong>in</strong>dustry <strong>in</strong>to their<br />

residential area would be very negative for those choos<strong>in</strong>g to cont<strong>in</strong>ue to live <strong>in</strong> this<br />

area. They also questioned <strong>Transnet</strong> on how it proposed to use land that it owned <strong>in</strong><br />

Clairwood that had been vacant for years. Issues concern<strong>in</strong>g the community and the<br />

municipality were also raised. The Clairwood Ratepayers Association made a<br />

submission detail<strong>in</strong>g their concerns. This submission is attached. (See Annexure)<br />

Bus<strong>in</strong>ess Issues<br />

A representative <strong>of</strong> the Durban Chamber <strong>of</strong> Commerce and Industry expressed some<br />

concern about the tim<strong>in</strong>g <strong>of</strong> the project. He noted that <strong>Transnet</strong>’s presentation<br />

projects that Bayhead will come on l<strong>in</strong>e <strong>in</strong> 2014, but that the port would run out <strong>of</strong><br />

capacity <strong>in</strong> 2010. He wanted to know what stopgap measures <strong>Transnet</strong> had put <strong>in</strong><br />

place for the years between 2010 and 2014. Krish Reddy noted that the Port <strong>of</strong><br />

Ngqura was be<strong>in</strong>g developed to handle <strong>in</strong>creased demand between 2010 and 2014.<br />

Security Issues<br />

There was concern that <strong>Transnet</strong>’s proposal did not seem to <strong>in</strong>clude any<br />

consideration <strong>of</strong> the issue <strong>of</strong> security. For any security measures to be effective, the<br />

issue must be considered dur<strong>in</strong>g the plann<strong>in</strong>g stage.<br />

Concern was raised about the safety <strong>of</strong> tourists <strong>in</strong>, and around, the port. A second<br />

participant asked if <strong>Transnet</strong> had a strategy <strong>in</strong> place for deal<strong>in</strong>g with the illegal<br />

operations and organised crime that occurred with<strong>in</strong> the port. The facilitator noted<br />

that this po<strong>in</strong>t was not directly pert<strong>in</strong>ent to this process. The Act<strong>in</strong>g Port Manager<br />

noted that as far as he was aware, there were no illegal operations <strong>in</strong> the port. He<br />

asked that any <strong>in</strong>formation about illegal activities be reported to <strong>Transnet</strong>’s fraud<br />

hotl<strong>in</strong>e.<br />

Tenant Issues<br />

Several participants requested clarity on what <strong>Transnet</strong>’s approach would be toward<br />

tenants <strong>of</strong> the affected areas, particularly those with long leases. Specifically, there<br />

was a question about how tenants from the ship build<strong>in</strong>g and ship repair <strong>in</strong>dustry<br />

would be accommodated or affected. A member from Mar<strong>in</strong>e Yacht Lift also asked<br />

that consideration be given to the yacht<strong>in</strong>g <strong>in</strong>dustry. Representatives <strong>of</strong> these<br />

<strong>in</strong>terests wanted to know what <strong>Transnet</strong>’s th<strong>in</strong>k<strong>in</strong>g was around compensat<strong>in</strong>g<br />

tenants. In response, it was noted that <strong>Transnet</strong> is not yet <strong>in</strong> a position to comment<br />

on these issues. Separate consultations with tenants have been held and will<br />

cont<strong>in</strong>ue to be held to discuss these issues. This <strong>in</strong>terest will also be addressed more<br />

comprehensively through the EIA process.<br />

A participant noted that several tenants had been awarded very long leases for what<br />

he described as “ridiculously” low rents. It was asked that this issue be <strong>in</strong>vestigated<br />

further.<br />

Ecological Issues<br />

A representative <strong>of</strong> the Wildlife and Environmental Society <strong>of</strong> South Africa asked<br />

<strong>Transnet</strong> to remember that the bay <strong>in</strong>cludes, but should not be reduced to be<strong>in</strong>g seen<br />

as only the Port <strong>of</strong> Durban. She stressed that a key imperative should be to preserve<br />

the function<strong>in</strong>g <strong>of</strong> the ecosystem found <strong>in</strong> this remarkable bay. She urged <strong>Transnet</strong><br />

to seriously consider pursu<strong>in</strong>g the southern access option rather than the northern<br />

channel. She was very concerned that the ecosystem <strong>in</strong> the bay would be<br />

significantly impacted if the sand bank were to be trimmed. This trimm<strong>in</strong>g would be<br />

necessary if the Northern channel was to be the route used by ships access<strong>in</strong>g the<br />

new Bayhead bas<strong>in</strong>.<br />

Fund<strong>in</strong>g<br />

A participant asked what the implications <strong>of</strong> this development would be for the<br />

taxpayer. Moira Moses, the group executive for <strong>Transnet</strong> Projects, expla<strong>in</strong>ed that<br />

<strong>Transnet</strong> would f<strong>in</strong>ance this project with its own funds. It was stressed that <strong>Transnet</strong><br />

is run like any private company. It has its own balanc<strong>in</strong>g sheet and does not receive<br />

regular stipends from government.<br />

Procurement and Employment<br />

A participant asked about procurement. She specifically wanted to know what<br />

<strong>Transnet</strong>’s policies were with regards to black economic empowerment (BEE). Moira<br />

Moses assured participants that <strong>Transnet</strong> was committed not only to the codes and<br />

requirements <strong>of</strong> BEE legislation but also to the pr<strong>in</strong>ciples <strong>of</strong> broad based black<br />

economic empowerment (BBBEE). <strong>Transnet</strong> was particularly concerned with<br />

creat<strong>in</strong>g opportunities for black South Africans, women and previously disadvantaged<br />

people. <strong>Transnet</strong> was also <strong>in</strong> the early stages <strong>of</strong> <strong>in</strong>itiat<strong>in</strong>g an enterprise development<br />

project with potential small enterprises <strong>in</strong> local communities. It was noted that there<br />

was still a long process to be undertaken before the details on procurement become<br />

relevant to this project.<br />

Councillor Nene <strong>of</strong> Ward 26 asked about the opportunities that would be created for<br />

employment. She was particularly <strong>in</strong>terested <strong>in</strong> hear<strong>in</strong>g about what <strong>Transnet</strong>’s<br />

policies were on employ<strong>in</strong>g local labour. Moira Moses expla<strong>in</strong>ed that a project <strong>of</strong> this<br />

magnitude would generate numerous employment opportunities. She noted that<br />

already the project is draw<strong>in</strong>g on local labour. She assured participants that <strong>Transnet</strong><br />

would cont<strong>in</strong>ue to source labour <strong>in</strong> local communities.<br />

Alternative Logistic Solutions<br />

Councillor du Bois, who also represents communities adjacent to the port, proposed<br />

that a “dry port” be developed <strong>in</strong> the Cato Ridge area. This would relieve pressure<br />

from the port area. A copy <strong>of</strong> the written submission he submitted to the meet<strong>in</strong>g is<br />

attached. (See Annexure)<br />

Another participant recommended that a truck park would solve some <strong>of</strong> the traffic<br />

problems experienced <strong>in</strong> the vic<strong>in</strong>ity <strong>of</strong> the port.<br />

3. Stakeholder Involvement<br />

Lisa van Dongen <strong>of</strong> Common Ground described the public participation process that<br />

Common Ground will facilitate on <strong>Transnet</strong>’s proposed Bayhead expansion. She<br />

emphasised that the process is to be governed by the pr<strong>in</strong>ciples <strong>of</strong> <strong>in</strong>clusivity and<br />

transparency. She outl<strong>in</strong>ed the different phases <strong>of</strong> participation and gave examples<br />

<strong>of</strong> the various forms <strong>in</strong> which the engagement could be undertaken. She <strong>in</strong>troduced a<br />

proposal to establish a stakeholder forum and sought endorsement for this idea. A<br />

Discussion<br />

The Process<br />

A participant sought clarity on the EIA process. The facilitator expla<strong>in</strong>ed that the EIA<br />

for this project had not yet begun and was anticipated to beg<strong>in</strong> <strong>in</strong> the second half <strong>of</strong><br />

2007. Follow<strong>in</strong>g this response, a participant asked how the current participation<br />

process would align with the EIA process. She was concerned that this <strong>in</strong>itial process<br />

would have to be repeated when the EIA began. The facilitator said that the<br />

processes had been aligned. Common Ground had <strong>in</strong>itiated a prelim<strong>in</strong>ary<br />

stakeholder process and would cont<strong>in</strong>ue the consultation process <strong>in</strong>to the EIA. All<br />

issues and comments raised <strong>in</strong> the <strong>in</strong>itial phases <strong>of</strong> engagement would be kept on<br />

record and would be revisited <strong>in</strong> the EIA process.<br />

A representative <strong>of</strong> the shipp<strong>in</strong>g <strong>in</strong>dustry asked that the process be run as quickly<br />

and efficiently as possible. He stressed that implementation <strong>of</strong> the proposed<br />

expansion must beg<strong>in</strong> as soon as possible as already their <strong>in</strong>dustry is be<strong>in</strong>g affected<br />

by a lack <strong>of</strong> capacity. They hope for a quick decision on this development.<br />

The Forum<br />

Follow<strong>in</strong>g a request from the facilitator for any concerns regard<strong>in</strong>g the pr<strong>in</strong>ciple <strong>of</strong><br />

sett<strong>in</strong>g up <strong>of</strong> the proposed forum as presented <strong>in</strong> the presentation, no objections or<br />

issues were raised.<br />

A participant requested that representatives <strong>of</strong> the road transport sector be added to<br />

the list <strong>of</strong> proposed stakeholders to be <strong>in</strong>cluded <strong>in</strong> the forum.<br />

4. Next Steps<br />

The facilitator described the next steps <strong>in</strong> the participation process. Firstly, a record<br />

<strong>of</strong> the public meet<strong>in</strong>g would be distributed to all participants <strong>of</strong> the meet<strong>in</strong>g.<br />

Thereafter, the facilitators would contact the various stakeholder sectors that are to<br />

be <strong>in</strong>cluded <strong>in</strong> the forum. The outcome <strong>of</strong> these meet<strong>in</strong>gs will be the establishment <strong>of</strong><br />

a forum <strong>of</strong> stakeholders. The second phase <strong>of</strong> the participation process will beg<strong>in</strong><br />

when the EIA is <strong>in</strong>itiated. This is scheduled to beg<strong>in</strong> <strong>in</strong> the second half <strong>of</strong> 2007.<br />

5. Closure<br />

The facilitator thanked all participants for attend<strong>in</strong>g the meet<strong>in</strong>g. He welcomed all<br />

comments, questions and issues, which should be directed to Common Ground by<br />

The Challenge:<br />

The Port <strong>of</strong> Durban will run out <strong>of</strong> conta<strong>in</strong>er capacity <strong>in</strong> 2010<br />

and will not cope with the projected conta<strong>in</strong>er traffic <strong>in</strong>crease.<br />

It needs to grow and support economic growth <strong>in</strong> South<br />

Africa through its role <strong>in</strong> the movement <strong>of</strong> high value goods.<br />
