Present
A list of all who registered their attendance at the public meeting is attached.
1. Welcome and Introduction
The facilitator David Shandler of Common Ground welcomed all attendants to the
first public meeting in a participation process to be conducted on Transnet’s
proposed Durban Port expansion. He explained that the purpose of the process was
to assist in ensuring a wise outcome be achieved with regards to Transnet’s
proposals to expand their container handling facilities. In order for this to happen
there will need to be a structured and ordered process that recognises and
addresses each stakeholder’s hopes, fears, interests and issues. The process also
seeks to generate and investigate alternative proposals. It would aim to find creative
solutions to obstacles and challenges. In order to fulfil these functions, the process is
likely to be long and iterative. He assured participants that they could have significant
input in the process through a large number of engagement opportunities.
The facilitator emphasised that this initial phase of this process is not part of the EIA
(Environmental Impact Assessment) process for this proposal, which is yet to begin.
This initial phase of participation has begun prior to the EIA in order to communicate
information on the proposed expansion to all interested and affected parties and to
inform these stakeholders about the upcoming process. This public meeting forms
part of a broader participation exercise that will eventually feed into an EIA process.
2. The Proposed Development
Krish Reddy, the General Manager for Planning in the Transnet Group, gave a
presentation detailing the challenges Transnet faces in particular with regards to their
anticipated future demand and their corresponding lack of capacity to handle such
demand. He then went on to outline Transnet’s proposed solution – namely the
expansion of a container terminal into the Bayhead area of the bay. He emphasised
that Transnet has a sincere commitment to pursue a solution that is sustainable. A
copy of his presentation s attached, and can also be accessed online at
Discussion
Following the presentation participants raised questions and concerns. Where
requested by the facilitator, representatives of Transnet responded. The discussion
is summarised by theme below.
Traffic Issues
A significant proportion of comments made at the meeting were related to the
problem of traffic congestion. A number of participants, particularly those
representing residents around the port and recreational users of the bay, referred to
the “havoc” on the roads around the harbour. They would like to see this problem
solved as soon as possible. They argued that, instead of relieving the situation,
Transnet’s proposal seems to project a scenario where more trucks and cars will
make use of the roads, thereby worsening the situation.
Mario Steyn, of Transnet Projects, acknowledged the problem and indicated that
feasibility studies were being done to inform how best to deal with the traffic problem
in both the short and the long term. He explained how Transnet’s Bayhead proposal
intends to improve the traffic problem. He noted that as soon as dredging of the basin
begins, Bayhead Road would be affected. An alternative road with several lanes will
be constructed to replace Bayhead road, routed around the new development. Links
will also be provided between this and other roads. He said that this new proposed
road layout would be an upgrade from the current situation. He also explained that
Transnet was pursuing a strategy to shift more freight, and particularly the growth in
freight, onto rail. The Bayhead development will include realigning rail yards. The
new rail system will be more efficient than the current system and is set to transport
up to 50% of freight in the future, but designed to take up to 80% if required.
A participant argued that interim solutions were necessary and that improvements
should not only be instituted after 2010. Another argued that the new road planned
would not be sufficient since it only provides one access road to the port. He argued
that this would not solve the congestion problem. He believed that the transport
strategy around the new development had not been thought through sufficiently. He
argued further that the shift to rail would not be successful as cargo was often time
sensitive. Rail presents a much slower option than road transport. Mario Steyn
explained that the rail option would become feasible, as it would be made
significantly more efficient by utilising 50 truck block trains with turn around times of
no longer than 3.5 hours per train.
A Bluff resident noted that tip trucks carrying concrete were being driven through the
residential areas around the port on a daily basis. The facilitator noted that this point
was not strictly applicable to the process on the proposed expansion. However, the
comment was useful in that the issue of construction vehicles would become relevant
if this project were to enter a construction phase.
Recreation Issues
Several participants asked for clarity on the future of recreational clubs in the bay. A
member of the Kwa-Zulu Natal Rowing Association asked about the impact of the
Public Meeting Record
Proposed Container Handling Expansion
development on the recreational users in the silt canal. He noted that in Transnet’s
presentation an artist’s impression of the development seemed to show that the clubs
remained intact. On the other hand, plans indicate that the silt canal will be converted
into a wetland or eco-system. He asked for details on this discrepancy. Transnet’s
representative said that it was not possible at this stage to not give a definitive
answer on the future of the clubs. Several options for the silt canal are currently
being considered. He did, however, say that Transnet recognised the value of the
clubs and the opportunities for leisure that clubs provided in the bay. This issue will
continue to receive attention during the feasibility study currently being undertaken.
The future of the recreational clubs will be an important issue to address during the
EIA process.
A participant asked that, if the clubs were allowed to remain in the silt canal, better
access to be area be provided to recreational users. He suggested that a separate
road could be built that was restricted to use by small vehicles, thereby separating
motor cars from large trucks.
The Residential Interest
Residents raised concerns that trucks are using residential roads to, and from, the
port. Even though trucks are not permitted to use these roads, they continue to do
so. This is not safe and also damages the roads. Residents are concerned that this is
not being monitored. Concern was also raised around the fact that there are only
three ways in which the 30 000 residents of the Bluff can access the area. This was
argued to be insufficient. The facilitator noted that these issues were not strictly
relevant to this process given that the scope of the process relates to Transnet’s
proposed port expansion and not to the use of City managed roads. He added that
he would try to direct such comments to the relevant authorities.
Representatives of the Clairwood Residents’ Association raised concerns about the
development and its effect on their community. They expressed fears about
expropriation and sought clarity on the exact dimensions of the proposed expansion.
They wanted assurances that this development will not advance into their area. They
were also concerned that the development will result in displaced companies and
industries seeking land in their community. The encroachment of industry into their
residential area would be very negative for those choosing to continue to live in this
area. They also questioned Transnet on how it proposed to use land that it owned in
Clairwood that had been vacant for years. Issues concerning the community and the
municipality were also raised. The Clairwood Ratepayers Association made a
submission detailing their concerns. This submission is attached. (See Annexure)
Business Issues
A representative of the Durban Chamber of Commerce and Industry expressed some
concern about the timing of the project. He noted that Transnet’s presentation
projects that Bayhead will come on line in 2014, but that the port would run out of
capacity in 2010. He wanted to know what stopgap measures Transnet had put in
place for the years between 2010 and 2014. Krish Reddy noted that the Port of
Ngqura was being developed to handle increased demand between 2010 and 2014.
3
10 May 2007
Proposed Container Handling Expansion
Security Issues
There was concern that Transnet’s proposal did not seem to include any
consideration of the issue of security. For any security measures to be effective, the
issue must be considered during the planning stage.
Concern was raised about the safety of tourists in, and around, the port. A second
participant asked if Transnet had a strategy in place for dealing with the illegal
operations and organised crime that occurred within the port. The facilitator noted
that this point was not directly pertinent to this process. The Acting Port Manager
noted that as far as he was aware, there were no illegal operations in the port. He
asked that any information about illegal activities be reported to Transnet’s fraud
hotline.
Tenant Issues
Several participants requested clarity on what Transnet’s approach would be toward
tenants of the affected areas, particularly those with long leases. Specifically, there
was a question about how tenants from the ship building and ship repair industry
would be accommodated or affected. A member from Marine Yacht Lift also asked
that consideration be given to the yachting industry. Representatives of these
interests wanted to know what Transnet’s thinking was around compensating
tenants. In response, it was noted that Transnet is not yet in a position to comment
on these issues. Separate consultations with tenants have been held and will
continue to be held to discuss these issues. This interest will also be addressed more
comprehensively through the EIA process.
A participant noted that several tenants had been awarded very long leases for what
he described as “ridiculously” low rents. It was asked that this issue be investigated
further.
Ecological Issues
A representative of the Wildlife and Environmental Society of South Africa asked
Transnet to remember that the bay includes, but should not be reduced to being seen
as only the Port of Durban. She stressed that a key imperative should be to preserve
the functioning of the ecosystem found in this remarkable bay. She urged Transnet
to seriously consider pursuing the southern access option rather than the northern
channel. She was very concerned that the ecosystem in the bay would be
significantly impacted if the sand bank were to be trimmed. This trimming would be
necessary if the Northern channel was to be the route used by ships accessing the
new Bayhead basin.
Funding
A participant asked what the implications of this development would be for the
taxpayer. Moira Moses, the group executive for Transnet Projects, explained that
Transnet would finance this project with its own funds. It was stressed that Transnet
is run like any private company. It has its own balancing sheet and does not receive
regular stipends from government.
Procurement and Employment
A participant asked about procurement. She specifically wanted to know what
Transnet’s policies were with regards to black economic empowerment (BEE). Moira
Moses assured participants that Transnet was committed not only to the codes and
requirements of BEE legislation but also to the principles of broad based black
economic empowerment (BBBEE). Transnet was particularly concerned with
creating opportunities for black South Africans, women and previously disadvantaged
people. Transnet was also in the early stages of initiating an enterprise development
project with potential small enterprises in local communities. It was noted that there
was still a long process to be undertaken before the details on procurement become
relevant to this project.
Councillor Nene of Ward 26 asked about the opportunities that would be created for
employment. She was particularly interested in hearing about what Transnet’s
policies were on employing local labour. Moira Moses explained that a project of this
magnitude would generate numerous employment opportunities. She noted that
already the project is drawing on local labour. She assured participants that Transnet
would continue to source labour in local communities.
Alternative Logistic Solutions
Councillor du Bois, who also represents communities adjacent to the port, proposed
that a “dry port” be developed in the Cato Ridge area. This would relieve pressure
from the port area. A copy of the written submission he submitted to the meeting is
attached. (See Annexure)
Another participant recommended that a truck park would solve some of the traffic
problems experienced in the vicinity of the port.
3. Stakeholder Involvement
Lisa van Dongen of Common Ground described the public participation process that
Common Ground will facilitate on Transnet’s proposed Bayhead expansion. She
emphasised that the process is to be governed by the principles of inclusivity and
transparency. She outlined the different phases of participation and gave examples
of the various forms in which the engagement could be undertaken. She introduced a
proposal to establish a stakeholder forum and sought endorsement for this idea. A
copy of her presentation is attached and can be accessed online at
www.transnet.net/TransnetProjects.aspx
Discussion
The Process
A participant sought clarity on the EIA process. The facilitator explained that the EIA
for this project had not yet begun and was anticipated to begin in the second half of
2007. Following this response, a participant asked how the current participation
process would align with the EIA process. She was concerned that this initial process
would have to be repeated when the EIA began. The facilitator said that the
processes had been aligned. Common Ground had initiated a preliminary
stakeholder process and would continue the consultation process into the EIA. All
issues and comments raised in the initial phases of engagement would be kept on
record and would be revisited in the EIA process.
A representative of the shipping industry asked that the process be run as quickly
and efficiently as possible. He stressed that implementation of the proposed
expansion must begin as soon as possible as already their industry is being affected
by a lack of capacity. They hope for a quick decision on this development.
The Forum
Following a request from the facilitator for any concerns regarding the principle of
setting up of the proposed forum as presented in the presentation, no objections or
issues were raised.
A participant requested that representatives of the road transport sector be added to
the list of proposed stakeholders to be included in the forum.
4. Next Steps
The facilitator described the next steps in the participation process. Firstly, a record
of the public meeting would be distributed to all participants of the meeting.
Thereafter, the facilitators would contact the various stakeholder sectors that are to
be included in the forum. The outcome of these meetings will be the establishment of
a forum of stakeholders. The second phase of the participation process will begin
when the EIA is initiated. This is scheduled to begin in the second half of 2007.
5. Closure
The facilitator thanked all participants for attending the meeting. He welcomed all
comments, questions and issues, which should be directed to Common Ground by
emailing info@commonground.co.za or phoning (031) 304 9323. He closed the
meeting by expressing his anticipation for further engagement in the future.
