Key Compon<strong>en</strong>ts of Grant Terms and Conditions<br />

The Grants C<strong>en</strong>tre of Excell<strong>en</strong>ce developed a model template award letter to<br />

help safeguard Welsh Governm<strong>en</strong>t's accountability to the public purse by<br />

using legal docum<strong>en</strong>tation that is consist<strong>en</strong>t, compliant and reviewed on a<br />

regular basis. The model letter is also an effici<strong>en</strong>cy measure as it can be<br />

readily adapted by Grants Officials to suit the requirem<strong>en</strong>ts of differ<strong>en</strong>t grant<br />

funded activities.<br />

The letter contains 22 sections which are supported by schedules which<br />

contain the detailed requirem<strong>en</strong>ts linked to a particular funded activity. Key<br />

sections of the letter are:<br />

What you must use the Funding for - it is important that both the<br />

Governm<strong>en</strong>t and Funded body are clear about their respective roles and<br />

responsibilities in the use of grant funding.<br />

Funding pre-conditions - the conditions that a funded body must satisfy<br />

before funding will be released.<br />

How to claim the Funding - this is an important section as it sets out wh<strong>en</strong><br />

paym<strong>en</strong>ts will be made and what funded bodies must do to satisfy Grant<br />

Officials that funding has be<strong>en</strong> (or in some cases, will be) used responsibly<br />

and for int<strong>en</strong>ded purposes only.<br />

Your g<strong>en</strong>eral obligations to us - refers to the areas for which funded<br />

bodies must implem<strong>en</strong>t measures to prev<strong>en</strong>t fraud, <strong>en</strong>sure compliance with<br />

all relevant law and regulations, manage risk, and g<strong>en</strong>erally co-operate with<br />

Welsh Governm<strong>en</strong>t officials seeking assurance as to the proper use of grant<br />

funding.<br />

Declarations - this is the funded body's formal agreem<strong>en</strong>t that it will comply<br />

with all the terms and conditions of funding set out in the award letter.<br />

Notification Ev<strong>en</strong>ts and their consequ<strong>en</strong>ces - funded bodies must comply<br />

with the provisions of this section where one or more prescribed ev<strong>en</strong>t<br />

occurs (e.g. grant has be<strong>en</strong> overpaid or the funded body has failed to<br />

comply with funding conditions - a full list is contained in a schedule to the<br />

letter). The section also stipulates what Welsh Governm<strong>en</strong>t may do in<br />

response to such notification.<br />

Audit requirem<strong>en</strong>ts - as recipi<strong>en</strong>ts of public monies, it is right and proper<br />

that funded bodies account for, and demonstrate appropriate and<br />

responsible use of, such monies. Where necessary, they must give access<br />

to Welsh Governm<strong>en</strong>t, Wales Audit Office or European Commission officials<br />
