Dear Vendor:<br />

We are sending you this email as a preliminary communication to notify you that Lowe’s Canada is<br />

scheduling Product Line Reviews at the Lowe’s Canada office in Toronto for assorting stores in 2007.<br />

The meeting date and details will be provided to you by your Lowe’s Canada Merchandiser under separate<br />

communication over the next few months. Once that meeting is scheduled, it is important, for everyone<br />

involved, to understand that this review may bring about a change in <strong>vendor</strong>s and store presentation, therefore<br />

this meeting should include decision makers from your company.<br />

In order to prepare for the meeting, and to allow the Lowe’s Canada Merchandising team to conduct a<br />

preliminary analysis of product offerings and programs, we are asking that all potential <strong>vendor</strong>s supply us with<br />

PROPOSED CANADA ITEMS and INFORMATION. This <strong>information</strong> is similar to that which is provided to the<br />

US Merchandising team for Item setup with additional data points specific to Canada. These proposed items<br />

will be provided to us in the attached access database in which your current US program has been preloaded.<br />

We understand that the current US items may not be appropriate for Canada and request that as you go<br />

through the database you identify an offsetting item for Canada. A user guide (attached) has been created to<br />

facilitate use of the database.<br />

DATABASE TIPS:<br />

- You will need Microsoft Access to complete the <strong>information</strong><br />

- As you enter <strong>information</strong> into the fields, the <strong>information</strong> is automatically stored (no need for<br />

constant saving)<br />

- READ the instructions at the top of the page<br />

- HELP is available as text on the BOTTOM of the screen<br />

- A GLOSSARY is incorporated into the user guide<br />

- Complete all <strong>information</strong><br />

The database, which will be submitted prior to the line review process, will allow the Canada Merchandising<br />

team to identify gaps in product offerings as well as new offerings you have which are specific to Canada. As<br />

Canada is a new market for Lowe’s, there are many aspects of the assortment which need to be considered in<br />

order to develop our business processes from supply chain, to regulatory compliance, to store layout and even<br />

to loss prevention. Due to those requirements, we are asking you, our <strong>vendor</strong>s to provide the <strong>information</strong><br />

accurately and within a two week time frame from when you receive this email. If you are not able to complete<br />

the database in the allotted timeframe, please contact your Canada Merchandiser.<br />

We know that our US Vendors are transitioning to PCM and that <strong>information</strong> being asked for in the database<br />

looks similar. However, this <strong>information</strong> request requires Canada specific data which is not currently<br />

accessible in any other format.<br />

We know that you undoubtedly have many questions regarding the actual line review and what will be required<br />

of you so we have provided a Vendor Information Packet which gives a brief description of our strategic<br />

objectives for the line review, comprehensive <strong>information</strong> on Lowe’s Companies Canada Logistics<br />

requirements, HazMat and Classification requirements as well as Source Tagging requirements. Please<br />

review these carefully as they will help you understand how to position your company for compliance in these<br />

areas.<br />

Product Line Review Information<br />

As previously stated, a Lowe’s Canada merchandising team member will contact you with the exact date and<br />

time of your scheduled line review.<br />

For the actual line review meeting at the Lowe’s Companies Canada office in Toronto, you should bring hard<br />

copy versions of the presentation document accompanied by a CD version.<br />

With this review, we have the following strategic objectives in mind and trust that your presentation will address<br />

them:<br />

Assortment dominance that creates market expansion opportunities for Lowe’s Canada<br />

A simplified shopping experience for the consumer<br />

Clear articulation of features and benefits moving up the price continuum<br />

Opportunities for incremental special order, commercial, and installed businesses<br />

You will have about one hour for your entire presentation. Please note that there may not be time during the<br />

Line Review meeting to go through every page of the presentation document in detail, but the quality of<br />

<strong>information</strong> you provide will be extremely useful in making final product and <strong>vendor</strong> decisions.<br />

We realize that this is a large undertaking in a short period of time. To make your visit a beneficial one, come<br />

organized, prepared, and realize the importance of this review. We encourage you to present your ‘best deal’<br />

to distinguish Lowe’s in the Canada market with particular emphasis on product presentation, differentiation<br />

and innovation.<br />

Packaging<br />

All packaging must meet the requirements of the Canadian government. Some basic guidelines have been<br />

incorporated into Lowe’s Visual Standard Guidelines under Partner <strong>information</strong> located at<br />

Lowe’s Canada Supply Chain Introduction<br />

Let me introduce myself as the new VP of Supply Chain of Lowe’s Canada. We are looking forward to<br />

establishing great relationships with you and your organization in the near future.<br />

In order to support your upcoming conversations with the Canadian merchandising team, I wanted to reach out<br />

to you to create a high level understanding of how Lowe’s Supply Chain will be structured in Canada at start<br />

up, and to introduce the logistics requirements so that they can be considered during your product line review<br />

and pricing conversations.<br />

Even if you currently sell product in our US stores and are thus familiar with how to operate with Lowe’s, many<br />

new procedures will exist in Canada due to the unique supply chain we are building. This document contains<br />

the key logistics requirements that will ensure a smooth flow of product and a successful start up in Canada. A<br />

full Canadian Vendor Partnership Guide and a Canada Routing Guide will be developed over the next few<br />

months and will be shared with you. In the meantime, please read through this document in order to be<br />

familiar with the key requirements, and to ensure they are considered as you work with the Lowe’s Canada<br />

merchants to assort the Canadian stores and finalize pricing agreements.<br />

Canadian Supply Chain Overview<br />

Regional Distribution Center<br />

Lowe’s Canada will be building a regional distribution center in the GTA area to support our store launch<br />

and expansion.<br />

The GTA Distribution center will be capable of supporting stock, cross dock, and <strong>vendor</strong>-prepared cross<br />

dock programs as well as other programs unique to the Canadian market place.<br />

In order to minimize infrastructure investment at start-up stocked SKUs will be limited to import SKUs and<br />

“Gold Bar” programs (strategic products with a never out service threshold). This program is likely to grow<br />

in the future as volume grows and greater leverage is possible.<br />

Flat Bed Distribution Center<br />

Lowe’s will have a distribution point in the GTA area for our lumber & other building supply product.<br />

SKUs selected to be held in this distribution point will be <strong>vendor</strong> managed inventory with ownership<br />

transferring to Lowe’s at time of shipment to the store.<br />

Transportation<br />

Similar to the way transportation operates in the U.S., Lowe’s transportation department will manage all<br />

collect freight movements and will create a routing guide that dictates the approved LTL and TL carriers for<br />

all prepaid loads.<br />

Supply Chain Organization<br />

All <strong>vendor</strong>s will be assigned a designated logistics representative with whom all logistics discussions<br />

should occur. Logistics and Merchandising in Canada will continue to operate in product group teams and<br />

will always work together to ensure the best decisions are made to benefit our end consumer.<br />

Upon item selection during the product line review process, a Canadian logistics representative will be<br />

assigned. This individual will assist in you with on-boarding and continued success as a Lowe’s partner in<br />

the future.<br />

Vendor Partner Requirements - Overview<br />

Purchase Orders & Purchase Order Fulfillment<br />

The following section outlines the <strong>vendor</strong> requirements as they relate to receiving and fulfilling purchase orders<br />

submitted by Lowe’s. These requirements are grounded in the Supply Chain’s philosophy of maximizing<br />

efficiency and accuracy in our service to the stores.<br />

Order Size & Frequency<br />

The size and frequency of all Lowe’s orders will be dictated by rate of sale unless specifically stated and<br />

agreed upon by Lowe’s Merchandising and Logistics representatives. This does not apply to initial orders<br />

or to orders placed to ship direct to new/retrofit stores.<br />

Lowe’s prefers to transmit all purchase orders to our <strong>vendor</strong>s using Electronic Data Interchange (EDI). See<br />

EDI section for more details.<br />

Substitutions<br />

Substitutions of products and/or changes to model numbers are not allowed without express authorization<br />

from a Lowe’s Merchandising and Logistics representative.<br />

Vendors are not authorized to add any item(s) to a purchase order without the prior approval of a Lowe’s<br />

Logistics representative<br />

o Any non-stock items that are shipped, but not ordered, will be returned to the <strong>vendor</strong> freight collect.<br />

o Any stock items that are shipped, but not ordered, may be accepted at no charge and the cost of<br />

goods will be deducted from the invoice.<br />

Vendor Capacity<br />

Vendors are expected to maintain the required on-hand inventory levels to insure that all Lowe’s store and<br />

distribution center orders ship complete and on time in accordance with the designated ship date and<br />

arrival date. See Vendor Performance section regarding service level expectations.<br />

Lowe’s requires a 30 day notification to a Lowe’s Logistics representative of any delays in manufacturing or<br />

shipping due to plant closing for holidays, physical inventories, union negotiations, or other circumstances<br />

that may impact product availability.<br />

Back Orders<br />

Lowe’s does not accept Backorders of any kind. Any backorders will be returned at <strong>vendor</strong> expense.<br />

On time Order Fulfillment<br />

Lowe’s designates a required ship date and arrival date on every COLLECT and PREPAID stock purchase<br />

order.<br />

Lowe’s requires all <strong>vendor</strong>s to tender purchase orders according to the scheduled ship date instructions.<br />

In order for each shipment to meet our carriers’ scheduled cut-off times, pick-up must be completed prior to<br />

5 PM on the scheduled ship date.<br />

If a Lowe’s Core Carrier arrives to the shipper’s location on the coordinated ship date and the purchase<br />

order is not ready, the <strong>vendor</strong> will be responsible for any additional transportation charges or fees.<br />

Multiple Purchase Orders to Single Lowe’s Location<br />

Slip-sheets must not be used to unitize any LTL orders to any location for any reason. Any resulting<br />

charges due to the use of slip-sheets will be the sole responsibility of the <strong>vendor</strong>.<br />

Lowe’s requires all multiple purchase orders to a single Lowe’s location be combined into a single shipment<br />

under the same bill of lading.<br />

The combined weight and cube must be used as the basis to determine the proper shipping method.<br />

Please use the outlined requirements in this routing guide to determine whether to ship via small Package,<br />

LTL or truckload.<br />

Vendor Order Minimums<br />

Lowe’s does not accept Vendor Order Minimums on Collect freight shipments.<br />

At start-up and ongoing, Vendor Order Minimums on prepaid freight must equal 2 WOS (weeks of supply)<br />

or less:<br />

o 2 DC WOS if it is DC destined order<br />

o 2 Store WOS if it is a store destined order<br />

Lowe’s will work with <strong>vendor</strong>s to minimize prepaid minimums in order to maximize inventory turns and<br />

service levels.<br />

Vendors will be required to reduce or eliminate excessive prepaid minimums prior to contract finalization.<br />

Ship Units and Weeks of Supply<br />

Lowe’s requires that item packaging quantities remain consistent from order to order.<br />

Vendor ship units must match sales rates to insure acceptable inventory turnover, ROI, etc.<br />

o Outbound ship units to stores (master cartons if via DC or pallets if store direct) must be greater or<br />

equal to 4 weeks of supply for a single store.<br />

o Inbound ship units to DC (order multiple) must be greater than or equal to 2 weeks of supply for the<br />

DC.<br />

o For start up, store weeks of supply will be determined based on the per store annual forecasts<br />

agreed to with merchants & supply chain. DC weeks of supply will be calculated based on the total<br />

stocking stores.<br />

Lowe’s must be given the ability to order product in master carton, tier, or pallet quantities. This<br />

determination will be solely at Lowe’s discretion.<br />

Vendors will be required to change excessive ship unit quantities for Lowe’s start up or in the future as<br />

annual volumes change.<br />

Proactive planning of appropriate ship unit sizes is expected for seasonal exit strategies so that guidelines<br />

can still be adhered to.<br />

Lowe’s will not accept additional costs for “Out of Season” ship unit revisions.<br />

Lead Times<br />

Lowe’s requires our <strong>vendor</strong>s to communicate to a Lowe’s Logistics representative the shortest possible<br />

lead time that the <strong>vendor</strong> can consistently adhere to (initial target to be provided in item set up sheet).<br />

o Freight collect <strong>vendor</strong>s. Lowe’s defines lead time as the number of calendar days between order<br />

receipt date and the designated ship date.<br />

o Freight prepaid <strong>vendor</strong>s. Lowe’s defines lead time as the number of calendar days between order<br />

receipt date and the designated arrival date.<br />

In order to minimize the inventory required in our supply chain pipeline and maximize the service level to<br />

the stores, the following requirements must be adhered to by our <strong>vendor</strong> partners:<br />

US/Can Vendor Source Points<br />

o Maximum allowable lead-time is 7 calendar days<br />

o Minimum safety stock requirement is 60 days of finished goods<br />

Overseas Vendor Source Points<br />

o Maximum lead-time is 35 to 45 calendar days for on-going replenishment orders<br />

o On initial orders <strong>vendor</strong>s will be allowed a maximum of 60 days lead-time<br />

Vendor Performance<br />

Vendor manufacturing & distribution capacity must meet Lowe’s needs.<br />

o As an important partner in Canada’s market entry, Lowe’s expects that priority allocation given to<br />

Lowe’s stores<br />

o A 98% fill rate minimum is expected by all <strong>vendor</strong>s<br />

o A 95% on-time delivery minimum is expected by all <strong>vendor</strong>s<br />

o New store orders must be accurate 100% of the time<br />

o Vendor performance will be tracked and communicated to the <strong>vendor</strong> on a regular basis by the<br />

Logistics team in order to identify opportunities to improve.<br />

o Unaddressed poor performance will result in fines and loss of business<br />

o Vendor performance will be strictly enforced by the Canadian merchandising & logistics teams. Our<br />

first priority will always be to assist the <strong>vendor</strong> in addressing the service issue. However, failure to<br />

eliminate issues will result in loss of business as negative impact to customer can not be risked.<br />

Vendors must proactively notify Lowe’s if capacity is insufficient to meet forecasted or growing demand as<br />

well as when SKUs are planned for discontinuation.<br />

Electronic Date Interchange (EDI)<br />

Vendors are required to have EDI capability. Exceptions will be at the sole discretion of Lowe’s and will be<br />

made only where minimal negative impact on the supply chain will result.<br />

Vendors approved to operate without EDI capabilities are required to use Lowe’s EDI webform.<br />

Lowe’s will transmit purchase orders via EDI several times each day. Vendors are required to check for<br />

purchase orders at least once a day in order to ensure lead times are adhered to.<br />

Canada will also be moving to an Advance Shipping Notice (ASN) environment and all EDI <strong>vendor</strong>s will be<br />

required to submit ASNs for both DC and Store orders. Specific <strong>information</strong> in terms of timing will be<br />

communicated to <strong>vendor</strong>s shortly.<br />

Transportation<br />

The following section outlines the types of modes Lowe’s will use in order to move product from your ship point<br />

to either our DC or our Stores. A single approach will be used with each <strong>vendor</strong> and will be determined based<br />

on cost and efficiency. Listed below are the most common modes available to Lowe’s and the <strong>vendor</strong><br />

requirements for each.<br />

Oceanic Freight<br />

Document and communicate any problems to the Lowe’s LGS (Lowe’s Global Sourcing) team in a timely<br />

manner.<br />

Properly unitize, label, and package all shipments in accordance with Lowe’s packaging requirements.<br />

See <strong>vendor</strong> requirements document on www.loweslink.com<br />

It is the responsibility of all <strong>vendor</strong>s to fill out and populate all Lowe’s tracking mechanisms before and<br />

when product ships (Celarix, UPS, GXS, etc...).<br />

LTL<br />

In order to reduce carrier congestion and improve inbound flow into Lowe’s facilities, Lowe’s will only<br />

receive LTL freight from Core LTL carriers regardless of freight terms (prepaid or collect).<br />

Lowe’s requires that LTL shipments on Non Core carriers be routed through a core carrier’s local facility for<br />

consolidation and delivery.<br />

This is required for all store, new store or DC shipment.<br />

Vendor is responsible for contacting Lowe’s routing guide carriers at least 24 hours prior to scheduled<br />

shipment.<br />

Properly unitize, label, and package all LTL shipments (“Bomb-proof”).<br />

Collect TL<br />

TL shipments will be routed by Lowe’s traffic department.<br />

TL carrier dispatcher schedules pickup appointments 24 - 48 hours prior to the scheduled ship date.<br />

Vendor is responsible for contacting Lowe’s traffic if a core carrier has not scheduled an appointment by<br />

noon the day before the scheduled ship date.<br />

Prepaid TL<br />

Carriers are required to have delivery appointments at our receiving docks for all shipments, including<br />

special orders. These appointments must be scheduled at least 48 hours in advance of scheduled delivery<br />

date for Lowe’s distribution centers and 24 hours in advance for Lowe’s stores.<br />

Appointment schedules are managed at each location (store or DC).<br />

Unscheduled deliveries may result in an extended waiting period.<br />

Small parcel<br />

Small Parcel (UPS, Fed Ex, Purolator) applies all orders that weigh less than 150 pounds and the total<br />

freight bill is less than $55.<br />

Third party billing will be available to qualified <strong>vendor</strong>s.<br />

There is an automated system for small parcel shipments.<br />

The system eliminates the need for “prepaid and add”.<br />

Expedited Shipments<br />

Vendors may not use expedited services on Lowe’s paid shipments without authorization from both the<br />

Lowe’s logistics specialist and Lowe’s Transportation.<br />

Lowe’s will choose the proper carrier and level of service for the shipment.<br />

Accessorial Charges<br />

Lowe’s is not responsible for accessorial charges of any kind.<br />

Lowe’s has established a Core carrier program whereby all delivery problems are resolved through joint<br />

process development.<br />

Our delivery processes are designed to handle palletized, store integrity shipments. All purchase orders<br />

are verified and shipments are delivered to pre established standing daily appointments. Lowe’s rates<br />

reflect these processes.<br />

Any charges such as notification, storage, reconsignment, inside delivery, sorting/segregation, time-definite<br />

delivery and so on are the sole responsibility of the <strong>vendor</strong>.<br />

Live Nursery Shipments<br />

All collect Live-Nursery shipments designated to any Lowe’s location must be routed through the correct<br />

Lowe’s Preferred Live-Nursery Carrier.<br />

Lowe’s Canada Routing guide will be made available in early 2007.<br />

Flooring and Major Appliance Shipments<br />

Vendors in these product categories may have exception routing that supersedes normal routing as<br />

outlined in this requirements document.<br />

Each <strong>vendor</strong> location will receive the exception routing from Lowe’s upon assortment approval.<br />

Free Time for Carrier Loading<br />

Suppliers are allotted approximately 2 hours of free time for loading.<br />

When a supplier delays a carrier beyond the free time, detention charges will be assessed.<br />

Lowe's will process a claim against the Supplier for the detention charges, plus a handling fee.<br />

Other Transportation Programs<br />

In order to further optimize LTL orders, Lowe’s runs both a Pooled program as well as a LTL combination<br />

program. Candidates for these programs will be identified by the Lowe’s Transportation department based<br />

on the <strong>vendor</strong> activity in any given region. Requirements for these programs will not be substantial and will<br />

be communicated to by the selected <strong>vendor</strong>s at that time.<br />

Product Packaging & Preparation<br />

The following section summarizes the packaging, labeling & handling requirements for all Lowe’s product.<br />

These requirements are in place to ensure that DCs and Stores can efficiently and accurately receive and<br />

process the product ensuring good in stock positions at the stores.<br />

Bar Coding<br />

All products are required to have a unique, scannable bar code according to the Uniform Code Council’s<br />

specifications for product identification at the sales register.<br />

Lowe’s accepts only UPC Version A, UPC Version E, EAN 8, and EAN 13 bar code symbologies at point of<br />

sale.<br />

All standard shipping containers (master cartons, bundles, pallets, inner packs, etc.) containing fixed<br />

multiples of the same item must have an Interleaved 2 of 5 (UPC Shipping Container Code) placed on the<br />

packaging according to the Uniform Code Council’s specifications.<br />

Lowe’s uses this bar code symbology at the point of receipt, as well as for taking inventory in our stores<br />

and distribution centers.<br />

All cartons must be packed on the pallet with the bar code (I 2 of 5 or UPC) facing outward. Lowe’s<br />

receiving personnel must be able to scan the bar code without breaking down the cartons on the pallet.<br />

All bar codes must have human readable characters that include a number system character and a check<br />

digit.<br />

All bar code <strong>information</strong> must be provided to your Lowe’s Merchandising representative upon agreement to<br />

purchase product.<br />

A 60 day advance notice of all bar code number changes and additions is required.<br />

Any problems with the quality, integrity, or application of a bar code must be reported immediately to a<br />

Merchandising representative.<br />

Any changes to an existing products bar code (UPC AND UPC shipping container code) or it’s quantity<br />

must be communicated to a Merchandising representative prior to change.<br />

For start-up in Canada, UPC-128 labels will be required on all <strong>vendor</strong> prepared cross dock pallets as well<br />

as any <strong>vendor</strong> pick pack cases.<br />

A 100% scan rate is required on all labels.<br />

Mislabeled product at the distribution centers will result in labor charges.<br />

Packing Slips & BOLs<br />

A packing slip is required for each shipment. If there are multiple Purchase Orders in a shipment, each PO<br />

must have a separate packing slip.<br />

The packing slip must be clearly located in a plastic “packing slip enclosed” pouch on the exterior of the<br />

first carton of each PO and visible to the loader.<br />

For truckload shipments, the cartons containing packing slips must be easily accessible prior to unloading.<br />

Please place them at the rear of the trailer facing the unloader.<br />

The packing slip must identify the Lowe’s item number(s) in ascending numerical sequence, the Lowe’s<br />

Purchase Order number, store number, model number, quantity and the shipper’s name.<br />

The Packing Slip must be machine printed and legible to the user.<br />

The bill of lading must clearly identify shipment contents and show all purchase orders included in the<br />

shipment. You must clearly identify our company name, the Lowe’s location number (IE: “LOWE’S HOME<br />

IMPROVEMENT 457”) and address in the consignee <strong>information</strong> on the bill of lading.<br />

Lowe’s requires that all <strong>vendor</strong>s use the VICS Bill of Lading. Lowe’s core carriers have adopted the VICS<br />

format. Lowe's and Lowe's Core Carrier contacts can assist shippers with questions. The VICS Bill of<br />

Palletization<br />

All collect and prepaid shipments must be shrink-wrapped on Lowe’s specification 4 way entry pallets<br />

unless the size of the cartons or nature of the freight prohibits palletization. See below table for details.<br />

The following section outlines the 4-way costing approach Lowe’s takes to product selection & channel<br />

modeling. Please ensure that when you quote your 4-way costing that all the logistics requirements associated<br />

with your product are considered as cost adjustments after the fact will not be tolerated.<br />

All <strong>vendor</strong>s are required to provide 4 costs for each SKU in their program. These costs are required regardless<br />

of your status as a current Lowe’s <strong>vendor</strong> or the pricing approach that has been used with Lowe’s US in the<br />

past.<br />

The accuracy of these costs in the item set-up sheet (the first time they are provided) is essential as they not<br />

only contribute to the merchant’s assortment decision, but also to the logistics flow decisions appropriate for<br />

Canada (which will by and large be significantly different than the US). These decisions will impact the size of<br />

the facility opened in Canada as well as the consolidation points we contract with and the freight rates we<br />

secure.<br />

Material Safety Data Sheets Requirements<br />

Background<br />

Beginning in mid 2007 Lowe’s will be expanding into Canada. As a result, this will necessitate strict<br />

compliance with a variety of Canadian regulations. Among these are regulations related to the transportation<br />

and management of hazardous materials.<br />

MSDS Compliance Requirements<br />

In order to comply with these regulations in particular, Lowe’s will be requiring new <strong>information</strong> from <strong>vendor</strong>s<br />

who wish to market products in Canada. Specifically, we are requiring Material Safety Data Sheets (MSDSs)<br />

in the French language (as well as English) and containing the <strong>information</strong> required by the Canadian<br />

Workplace Hazardous Materials Information System (WHMIS). NOTE: IF YOU DO NOT PROVIDE THIS<br />

INFORMATION YOUR PRODUCT(S) CANNOT AND WILL NOT BE OFFERED BY LOWE’S IN CANADA.<br />

MSDS Codes<br />

We need each item to have an MSDS code associated with it. Each item should have only one code.<br />

N Item does not have an MSDS and is not regulated by Department of Transportation (CFR49), Transport<br />

Canada (TRANSPORTATION OF DANGEROUS GOODS ACT (CANADA), Ontario Ministry of Transportation<br />

(DANGEROUS GOODS ACT), Transportation Act (ONTARIO) and applicable Provincial equivalents.<br />

As you should be aware, the WHMIS requirements for MSDSs vary somewhat from those of OSHA in the<br />

United States. For example, WHMIS requires the percent of concentrations of hazardous ingredients to be<br />

listed (optional in the U.S.) as well as the LD50 value.<br />

Also of concern is the Canadian requirement that MSDSs be updated every three years or when there is a<br />

change in formulation. Since it will be impossible for Lowe’s to know when you have reviewed your MSDSs or<br />

changed formulations you will be required to maintain a system to manage this so that Lowe’s will ALWAYS<br />

have the most recent version of every MSDS. Revised and updated MSDSs should immediately be sent to<br />

Lowe’s MSDS custodian at:<br />

and timely openings for the planned Canadian locations.<br />

of Hazardous Materials Regulations and submit this <strong>information</strong> to Lowe’s in order that they may be in<br />

also agree to write the item's 12 digit UPC bar code on the MSDS. I also agree to update this MSDS every 3<br />

years and to send said copies to Infotrac. I certify that these MSDS's are compliant with USA OSHA and<br />

Canadian WHMIS standards and understand the penalties if they are not.<br />

IMPORTANT: Lowe's has a policy that strictly prohibits the purchase of certain items from <strong>vendor</strong>s. Included<br />

are products containing more than 25% ammonium nitrate, pesticides that require an applicator's license and<br />

pesticides that are classified as restricted use chemicals. If you are in the process of selling to Lowe's any<br />

products that may fit the above descriptions you must notify Lowe's Merchandising Department immediately.<br />

In addition, if there are federal, provincial, state or local laws, regulations or requirements pertaining to any<br />

materials or products sold or to be sold to Lowe's, that may impact Lowe's as a retailer, you must notify Lowe's<br />

Merchandising Department immediately. This includes, but is not limited to, sale of products to minors,<br />

labeling requirements, signage requirements and requirements pertaining to height of product display.<br />

Failure to abide by these requirements shall constitute a material breach of the Lowe's Master Standard<br />

Buying Agreement between you and Lowe's.<br />

Lowe’s Source Tag Commitment Statement<br />

Lowe’s has implemented source tagging as part of our corporate strategy to increase sales and decrease<br />

shrinkage. The company has made a significant investment and commitment to source tagging and therefore<br />

appreciate the cooperation of our <strong>vendor</strong>s in this venture as we both experience the benefits source tagging<br />

offers.<br />

What is Source Tagging?<br />

Source Tagging is the process by which disposable anti-theft labels are incorporated into the merchandise to<br />

be protected during manufacturing or packaging process.<br />

Lowe’s has chosen to use TEPG/Sensormatic’s Ultra-Max Anti-Shoplifting Technology because it offers:<br />

The highest detection rate in the industry.<br />

Coverage of wide exits and entrances.<br />

Automatic, reliable deactivation of hidden labels without slowing throughput.<br />

A virtually false-free alarm system<br />

Potential packaging reduction or elimination since Ultra-Strip labels fit easily into small items.<br />

Washable labels for sewn-in application with home fashion products.<br />

Labels are able to be deactivated & reactivated.<br />

Lowe’s requires all suppliers with high-theft/high-shrink product to source tag specific SKU’s based<br />

upon their specific Product Group tagging criteria. If you are contacted to begin source tagging your<br />

product, you should follow these easy “Next Step Instructions” to get your program up and running. If<br />

you have any questions or issues regarding Lowe’s Source Tagging Policy you should contact Lowe’s<br />

EAS Coordinator at 704-758-6012.<br />

Next Step Instructions<br />

1. Complete ADT/Sensormatic's Product Submission Form & forward it, along with your SKUs that need<br />

to be tested, to one of Sensormatic’s Certification Labs. You do not need to try to pre-place the security<br />

tag on or in the product. The lab will determine the optimal place for the tag during the testing process.<br />

The certification process is the same for import & domestic items. You may choose the HK or US lab<br />

location that works best for you unless the item is to be Phase III tested.<br />

The certification process is FREE and generally takes less than two weeks to complete. Your product<br />

should be shipped to Sensormatic packaged exactly as it will arrive to our stores. If you have several<br />

SKUs packaged exactly the same, you need only send one product representative for each packaging<br />

style. However, provide all of the UPC codes for the items you would like certified.<br />

2. All certifications are sent to the Lowe’s EAS Source Tag Manager for approval, please wait for<br />

Lowe’s approval regarding each certification before you proceed with tagging the item. Should you<br />

have any packaging you feel is questionable please contact the EAS Program Coordinator to have<br />

a sample sent in for review. All packaging must be approved prior to implementing your merchandise<br />

program. NOTE: All clam shells must be heat or RF sealed on all sides and must include the approved<br />

phase tag before your first shipment.<br />

3. Lowe’s requires all product to be Phase II or Phase III tagged. PII tagging means the tag is concealed<br />

inside of the packaging of your product. PIII tagging means the tag is actually placed inside the product<br />

itself. The tag is always universally positioned within 3” of the barcode for all retailers regardless of the<br />

phase. (Sensormatic’s Lab has been instructed to adhere to our standard requirement of testing all Lowe’s<br />

product for Phase III first.) If an item exceeds 24”/25lbs please contact the EAS Source Tag Coordinator to<br />

inquire about alternative tagging for these items so they remain within the Source Tagging Guidelines.<br />

Upon receipt of certification from Sensormatic and approval of those certifications & packaging from Lowe’s<br />

Complete and return Lowe’s Source Tag Commitment form via fax to: 1.704.757.6098. You will need to<br />

list all of the SKUs that will be source tagged, by Lowe’s item number, and the approved phase on the form.<br />

(Please do not list the SKUs by your model number.) Enter the implementation date in the first paragraph. This<br />

is the date your source tagged product will begin shipping to our stores. (This date must be approved by<br />

Lowe’s EAS Program Manage/ Coordinator.)<br />

Source Tagging Requirements & Guidelines<br />

It generally takes a new supplier approximately 60-90 days to have source tagged product arriving in<br />

our stores. Should you have current warehouse stock, Lowe’s will allow you to work through that inventory<br />

and begin your program with the shipment following depletion of such. Should you determine that your current<br />

inventory level is greater then two months, you must contact Lowe’s EAS Coordinator at 704-758-6012 to<br />

determine the arrival date.<br />

Lowe’s ONLY accepts tagged product that uses TEPG/Sensormatic’s Dual Resonator (DR) anti-theft<br />

tag. There are several different anti-theft tags on the market. Lowe’s systems will only activate and perform<br />

accurately with the use of TEPG/Sensormatic’s DR tag. You may NOT use Check Point, or any other RF,<br />

(radio frequency) tag on your product to be shipped to Lowe’s.<br />

Lowe’s conducts weekly internal audits on committed source tagged SKU’s. Approximately six months<br />

after your implementation date, we will manually<br />

check all of your committed SKU’s to make sure they are tagged. This allows us to monitor <strong>vendor</strong> compliance<br />

and ensure our suppliers are receiving LIVE tags from their distributors.<br />

Lowe’s has a minimal 85% source tag compliance requirement. You will be notified of the results of your<br />

audit and given the opportunity to correct the problem should it be necessary. Your items will be rechecked 45<br />

days later. Should the problem not be corrected at the second audit, you will be found non-compliant. The<br />

specific recourse for non-compliance will be determined at the time by Lowe’s Merchandising and Loss<br />

Prevention Management. Non-compliance is handled on a case-by-case basis.<br />

Lowe’s will assist all suppliers with any “hard to tag” item and allow them significant time to find,<br />

develop & initiate use of the solution. Lowe’s will supply you with a list of VAR’s, (Value Added Resellers),<br />

who assist <strong>companies</strong> with developing unique, individual tagging solutions for abnormal, or hard –to-tag items.<br />

For instance: drop in tags (phones, fertilizer, soft goods), sewn in tags (soft goods), weighted/winged tags<br />

(liquid concentrates/Round UP, chemicals & cleaners), are just a few of the tagging solutions that have been<br />

developed for unique SKU’s at Lowe’s and other retailers. For any item, there is a solution, and we will assist<br />

you in finding the right one for your product.<br />

Lowe’s DOES NOT absorb or “share” in the cost of the anti-theft tag. Lowe’s has invested millions of<br />

dollars in the installation of TEPG/Sensormatic’s EAS equipment throughout our stores, and for this reason,<br />

require our suppliers to “share” the cost of the program, by providing the tags.<br />
