Please clarify preferred DBE/LBE participation
levels and details. Some general information was
given during the meeting but without sufficient
specificity. Is there a particular certification
program that the consultants have to participate in,
in order to qualify, and if yes, how long does the
certification process take for those who are not in
that program yet? Please provide relevant
program(s) contact information.
Will agencies other than SMART (i.e. Cities and
Counties) be involved in evaluation of future
Proposals?
Will design sub-consultants be locked out if they
are not part of a DB team as of the deadline for the
submittal of the statement of qualifications?
Can SMART furnish the RFQ Forms in word
format? This will facilitate our team members to fill
out the required information.
The RFQ does not provide for evaluation of
DBE/LBE participation as a condition to
prequalification. However, the RFP will include
requirements relating to local business and small
business participation. In this regard, the District's
General Conditions for the IOS-1 design-build
contract included provisions regarding local
business and small business that we anticipate will
also be included in the contract documents for
Contract Package 4.

Will the Systems Contract be Design-Build? The Systems contract is not in Contract Package 4
(CP4).
Clarify if Electrical and Mechanical Engineers need
to be included in PDBE pre-qualification form.
May the Design-Builder prequalify several Rail
Installation Subcontractors now, and later accept
bids to perform these services?
Based on the scope of the OMF and Haystack
Landing Bridge, they may be key consultants and
need to be prequalified.
From the RFQ, "The Design-Builder may prequalify
other (non-heavy and highway) subcontractors for
the Project. In the event that the Design-Builder
intends to include a Rail Installation Subcontractor
on its team, in lieu of the General Contractor
performing the rail installation or Moveable Bridge
scope of work, the Rail Installation and/or
Moveable Bridge Subcontractor shall be
prequalified.
"Principal Participant. Any of the following entities:
(a) The Contractor (or Proposer);
(b) An individual firm, all general partners, or JV
members of the Contractor (or Proposer); or
(c) All persons and legal entities holding (directly or
indirectly) a 15% or greater interest in the
Contractor (or Proposer)."
You may prequalify more than one Rail Installation
Subcontractor provided you follow the procedures
in the RFQ. Once a Prequalified PDBE is included
in the approved Prequalified PDBE list, no change
may be made in the prequalified elements of the
Prequalified PDBE's organization, including the
joint venture itself, except upon written approval of
the District, and only in accordance with this
section 18.0. In the event that a prequalified
PDBE decides to request a change, the request
shall be made in writing to the District no later than
