<strong>and</strong> not everything that can be counted counts.<br />

Fred Hamlin, one <strong>of</strong> my architectural pr<strong>of</strong>essors, ranted about<br />

the poetic principle. We didn’t know what he was talking about.<br />

He applied it to architecture, engineering, planning, l<strong>and</strong>scape<br />

– the fact that there was a common thread through it all, the<br />

whole <strong>of</strong> which was greater than the sum <strong>of</strong> its parts.<br />

Ted Kooser <strong>and</strong> Bob Hanna have been providing poetry <strong>and</strong><br />

sketches for this newsletter since its initial issue in May, 1991.<br />

The combination <strong>of</strong> literature <strong>and</strong> graphics is powerful <strong>and</strong>,<br />

although the various marriages were not made in heaven, the<br />

poetry seems to enhance the sketch <strong>and</strong> vice-versa. Maybe<br />

that’s the poetic principle.<br />

Ted has recently been named U.S. Poet Laureate,<br />

a position previously held by, among others,<br />

Robert Frost <strong>and</strong> Karl Shapiro. In announcing<br />

the appointment, Librarian <strong>of</strong> Congress James<br />

H. Billington said, “Ted Kooser is a major<br />

poetic voice for rural <strong>and</strong> small town America,<br />

<strong>and</strong> the first Poet Laureate chosen from the<br />

Great Plains. His verse reaches beyond his<br />

native region to touch on universal themes<br />

in accessible ways.”<br />

Bob has been an architect in <strong>Nebraska</strong> since<br />

1967. He has produced two books <strong>of</strong> sketches<br />

defining <strong>Nebraska</strong>, where he was born above<br />

a beer tavern in Ewing. He grew up in Gr<strong>and</strong><br />

Isl<strong>and</strong>, having biked every square inch <strong>of</strong> the city.<br />

He is a delineator whose architectural renderings<br />

regularly transcend computer-generated<br />

competition.<br />

Ted grew up in Ames, Iowa. After a flirtation with architecture,<br />

he graduated from Iowa State University in English <strong>and</strong> later<br />

obtained a Masters Degree from the University <strong>of</strong> <strong>Nebraska</strong>,<br />

having studied there under Karl Shapiro.<br />

Some may consider sketches <strong>and</strong> poetry strange fare, even malfeasance,<br />

for a state agency newsletter. I commend the <strong>Nebraska</strong><br />

<strong>Board</strong> for their realization that this might be something that<br />

counts, if not something that can be counted.<br />

Raising the Bar: The <strong>Nebraska</strong> <strong>Board</strong> Is on <strong>Board</strong><br />

<strong>Board</strong> Perspective<br />

During the past ten years the American Society <strong>of</strong> Civil <strong>Engineers</strong> (ASCE)<br />

has been formulating a program to encourage “raising the bar” in engineering<br />

education. During the last half-century, the practice <strong>of</strong> civil engineering<br />

has grown more complex <strong>and</strong> dem<strong>and</strong>ing while the number <strong>of</strong> credit hours<br />

required to receive an undergraduate CE degree has steadily declined.<br />

These opposing trends, the ASCE believes, create a compelling need to<br />

“raise the bar” in engineering education to continue to adequately protect<br />

public health <strong>and</strong> safety.<br />

The ASCE proposal is to establish a Body <strong>of</strong> Knowledge (BOK) consisting<br />

<strong>of</strong> a bachelor’s degree plus 30 semester credits <strong>of</strong> acceptable “advanced<br />

level” courses in technical <strong>and</strong>/or pr<strong>of</strong>essional practice topic areas. This<br />

BOK would then become the new education prerequisite for licensure in<br />

civil engineering. The details <strong>of</strong> the BOK can be found in documents available<br />

In March <strong>of</strong> 2004, the ASCE licensure committee prepared an article for the<br />

Licensure Exchange, published by the National Council <strong>of</strong> Examiners for<br />

Engineering <strong>and</strong> Surveying (NCEES). The article makes a case for raising<br />

the bar, resulting from the reduction in the core technical subjects, technical<br />

breadth, <strong>and</strong> technical depth in the face <strong>of</strong> increased complexity <strong>and</strong><br />

technical specialization <strong>of</strong> the civil engineering pr<strong>of</strong>ession. This initiative<br />

by the ASCE has brought the topic “front <strong>and</strong> center” to the NCEES <strong>and</strong><br />

made it a national focus for state licensing organizations.<br />

There is enormous detail in the proposed BOK that is beyond the scope <strong>of</strong><br />

this article. In addition, there are several issues to be worked out such as<br />

how mobility <strong>and</strong> comity would be maintained <strong>and</strong> how “gr<strong>and</strong>fathering”<br />

provisions might work as additional engineering education is required.<br />

Further, due to the very nature <strong>of</strong> this <strong>Board</strong>’s regulation <strong>of</strong> the Architecture<br />

pr<strong>of</strong>ession, which already requires extended education criteria, we<br />

must be sensitive to this matter as to how it may apply to all the various<br />

architecture <strong>and</strong> engineering pr<strong>of</strong>essionals practicing in <strong>Nebraska</strong>.<br />

<strong>Engineers</strong> <strong>and</strong> <strong>Architects</strong>…<br />

to safeguard life, health<br />

<strong>and</strong> property <strong>and</strong> promote<br />

the public welfare.<br />

This issue <strong>of</strong> educational requirements directly ties to one <strong>of</strong> the key<br />

responsibilities <strong>of</strong> the <strong>Nebraska</strong> <strong>Board</strong> <strong>of</strong> <strong>Engineers</strong> <strong>and</strong> <strong>Architects</strong>. The<br />

<strong>Engineers</strong> <strong>and</strong> <strong>Architects</strong> Regulation Act requires the regulation <strong>of</strong> architecture<br />

<strong>and</strong> engineering in <strong>Nebraska</strong> to safeguard life, health <strong>and</strong> property<br />

<strong>and</strong> promote the public welfare.<br />

Suffice it to say that the <strong>Nebraska</strong> <strong>Board</strong> <strong>of</strong> <strong>Engineers</strong> <strong>and</strong> <strong>Architects</strong><br />

believes the ASCE proposal has definite merit. Accordingly, the <strong>Board</strong><br />

has expressed interest to ASCE regarding early implementation <strong>of</strong> requiring<br />

additional engineering education as a condition for civil engineering<br />

licensure. We believe <strong>Nebraska</strong> should be one <strong>of</strong> the states leading the<br />

nation in promoting higher st<strong>and</strong>ards for our regulated pr<strong>of</strong>essions.<br />

While there is a long way to go (some say 15 to 20 years) before the concept<br />

is fully implemented across all the U.S. jurisdictions, we believe that now<br />

is the time for high-level discussion <strong>and</strong> input from both the regulated<br />

pr<strong>of</strong>essions <strong>and</strong> the public. If you would like to weigh in on this issue, we<br />

03.04 A pr<strong>of</strong>essional engineer <strong>and</strong> his client’s draftsman were alleged to have<br />

engaged in plan stamping <strong>and</strong> unlicensed practice. Action: James J. Musilek,<br />

E-5935, has signed a Settlement Agreement with the <strong>Board</strong> containing<br />

stipulations for a two-year period <strong>and</strong> payment <strong>of</strong> $1,000 in costs.<br />

03.12 A pr<strong>of</strong>essional engineer has been accused <strong>of</strong> incompetence, negligence,<br />

<strong>and</strong> possibly plan stamping in placing his seal on drawings <strong>of</strong> an exempt<br />

residential project. Action: The <strong>Board</strong> has retained legal counsel to investigate<br />

the matter <strong>and</strong> to seek resolution.<br />

04.02 A firm owned <strong>and</strong> operated by an Engineer Intern holds a Certificate <strong>of</strong><br />

Authorization to practice engineering by virtue <strong>of</strong> a full time licensed pr<strong>of</strong>essional<br />

engineer employed by the firm. The complaint alleges that the<br />

P.E. is not full-time <strong>and</strong> that the owner is practicing engineering without<br />

a license. Action: It was determined, from payroll records, that the PE in<br />

responsible charge was a full-time employee during the period in question.<br />

04.03 A State agency alleges that a pr<strong>of</strong>essional engineer did not act with reasonable<br />

care <strong>and</strong> competence in designing <strong>and</strong> administering construction <strong>of</strong><br />

a wastewater system for a housing development. Action: A disinterested<br />

pr<strong>of</strong>essional engineer has investigated the documentation submitted with<br />

the complaint <strong>and</strong> issued an opinion to the board. The respondent has<br />

responded to the allegations <strong>of</strong> the complaint. The <strong>Board</strong> has requested reaction<br />

<strong>of</strong> the complainant <strong>and</strong> the disinterested engineer to the response.<br />

04.05 A draftsman was accused <strong>of</strong> the unlicensed practice <strong>of</strong> architecture when<br />

his client’s attorney referred to him as the architect for a project before a<br />

planning commission. Action: The project was determined to be exempt<br />

from the law, <strong>and</strong> the draftsman instructed the attorney to refrain from<br />

referring to him as an architect.<br />

04.06 A firm with no certificate <strong>of</strong> authorization to practice engineering, <strong>and</strong> no<br />

known pr<strong>of</strong>essional engineers, submitted an application for a State permit<br />

that requires the seal <strong>of</strong> a licensed pr<strong>of</strong>essional engineer on application<br />

documents. Action: The matter has been referred to an investigator.<br />

04.07 A telephone Yellow Pages directory listed organizations under ‘<strong>Architects</strong>’<br />

that allegedly employed no licensed architects. Action: A letter was sent to<br />

the publisher <strong>of</strong> the book, with copies to the organizations listed, explaining<br />

that such listings are unlawful.<br />

04.08 An architect was accused <strong>of</strong> incompetence <strong>and</strong> <strong>of</strong> withholding refund <strong>of</strong><br />

unearned retainer funds. Action: Under investigation.<br />

04.09 An architect is alleged to have sealed structural engineering documents.<br />

Action: Pending board review.<br />

Leading to Accredited Masters Degrees.<br />

Engineering students holding a non-accredited baccalaureate degree who are<br />

enrolled in an accredited Masters program will not be required to have the<br />

former degree evaluated for equivalency by ABET in order to sit for the FE<br />

exam. Admittance to the exam is based on the accredited Masters degree;<br />

the c<strong>and</strong>idate shall be eligible for FE examination during the final year <strong>of</strong><br />

Dr. Corley, a Licensed Structural Engineer in Illinois <strong>and</strong> a Pr<strong>of</strong>essional<br />

Engineer in seventeen other states, was selected by the ASCE<br />

to lead the Building Performance Assessment Team investigating the<br />

bombing <strong>of</strong> the Murrah Federal Building in Oklahoma City in 1995. In<br />

September, 2001 he served as a team member to evaluate performance<br />

<strong>of</strong> the Pentagon, <strong>and</strong> was selected to head the team to study building<br />

performance after the attack on New York’s World Trade Center.<br />

After Years<br />

Today, from a distance, I saw you<br />

walking away, <strong>and</strong> without a sound<br />

the glittering face <strong>of</strong> a glacier<br />

slid into the sea. An ancient oak<br />

fell in the Cumberl<strong>and</strong>s, holding only<br />
