The time is coming for a change in management <strong>of</strong> the <strong>Board</strong> <strong>of</strong><br />

<strong>Engineers</strong> <strong>and</strong> <strong>Architects</strong>. I am planning to leave as Executive<br />

Director <strong>of</strong> the <strong>Board</strong> at midnight on December 31, fi fteen years<br />

to the second after assuming this position. A new director is<br />

being sought, as you will see elsewhere in this letter.<br />

Fifteen years may not seem a long time. It is, however, nearly a<br />

quarter <strong>of</strong> the <strong>Board</strong>’s existence. I have served with over a third<br />

<strong>of</strong> the board members who have populated the table. When I<br />

look at the photographs in the boardroom, I am amazed at the<br />

quality <strong>of</strong> the woman <strong>and</strong> men who have given <strong>of</strong> themselves<br />

since 1937 to protect the public, but also to create a legal climate<br />

in which the pr<strong>of</strong>essions <strong>of</strong> architecture <strong>and</strong> engineering<br />

can excel. They have given many hours locally, nationally, <strong>and</strong><br />

internationally to that endeavor.<br />

Members <strong>of</strong> the board are appointed by the Governor to fi ve<br />

year terms. You might expect it to be a political appointment<br />

— <strong>and</strong> it probably is — but once the oath is taken, all that is<br />

forgotten <strong>and</strong> the public welfare is dominant. <strong>Nebraska</strong> has the<br />

advantage <strong>of</strong> a combined board <strong>of</strong> engineers <strong>and</strong> architects. Many<br />

states with separate boards simmer in pr<strong>of</strong>essional discontent<br />

<strong>and</strong> distrust; our board members have a mutual respect for the<br />

differences among them.<br />

The person who takes this position will share some interesting<br />

challenges with the <strong>Board</strong>. The value <strong>of</strong> architects <strong>and</strong> engineers<br />

to public safety, but also to economic development <strong>of</strong> the state,<br />

is not widely understood; the subject requires constant attention.<br />

In our fi rst newsletter <strong>of</strong> May, 1991 we pondered whether<br />

the pr<strong>of</strong>essions are a conspiracy or a public service. The initial<br />

notion was held by George Bernard Shaw:<br />

All pr<strong>of</strong>essions are conspiracies against the laity.<br />

We then quoted Dean Roscoe Pound <strong>of</strong> the Harvard Law School,<br />

a <strong>Nebraska</strong> native, when he characterized the pr<strong>of</strong>essions as:<br />

…pursuing a learned art as a common calling in a<br />

spirit <strong>of</strong> public service — no less a public service<br />

because it may incidentally be a means <strong>of</strong> livelihood.<br />

It is the season to make the latter description a public perception<br />

<strong>and</strong> a reality.<br />

The <strong>Nebraska</strong> <strong>Board</strong> <strong>of</strong> <strong>Engineers</strong> <strong>and</strong> <strong>Architects</strong>, located in Lincoln, is<br />

seeking an Executive Director. Primary responsibilities for this position will<br />

include administering daily activities <strong>of</strong> the <strong>Board</strong> <strong>and</strong> directing activities<br />

<strong>of</strong> their staff in support <strong>of</strong> the agency’s programs <strong>and</strong> its operations. The<br />

<strong>Board</strong> is an independent agency <strong>of</strong> the State <strong>of</strong> <strong>Nebraska</strong> charged by law<br />

with the licensing <strong>of</strong> architects <strong>and</strong> pr<strong>of</strong>essional engineers, <strong>and</strong> regulation<br />

<strong>of</strong> the two pr<strong>of</strong>essions to safeguard life, health <strong>and</strong> property.<br />

All qualifi ed c<strong>and</strong>idates will be considered, but licensure as an architect<br />

or pr<strong>of</strong>essional engineer is desirable <strong>and</strong> preference will be given to those<br />

with experience in the pr<strong>of</strong>essions. The successful c<strong>and</strong>idate will have<br />

specifi c experience in <strong>of</strong>fi ce administration. Salary is budgeted at $80,000<br />

per year. The position will be open on January 1, 2006.<br />

03.12 A pr<strong>of</strong>essional engineer has been accused <strong>of</strong> incompetence, negligence,<br />

<strong>and</strong> possibly plan stamping in placing his seal on drawings<br />

<strong>of</strong> an exempt residential project. Update: The <strong>Board</strong> has retained<br />

legal counsel to investigate the matter <strong>and</strong> to seek resolution.<br />

04.03 A State agency alleges that a pr<strong>of</strong>essional engineer did not act with<br />

reasonable care <strong>and</strong> competence in designing <strong>and</strong> administering<br />

construction <strong>of</strong> a wastewater system for a housing development.<br />

Update: Inasmuch as the allegations cited were violations <strong>of</strong> the<br />

complaining agency’s rules <strong>and</strong> regulations, the complaint has been<br />

closed pending possible legal action by the agency.<br />

04.06 A fi rm with no certifi cate <strong>of</strong> authorization to practice engineering,<br />

<strong>and</strong> no known pr<strong>of</strong>essional engineers, submitted an application<br />

for a State permit that requires the seal <strong>of</strong> a licensed pr<strong>of</strong>essional<br />

engineer on application documents. Update: A consent order<br />

has been signed with Denise Ennis <strong>and</strong> Jerome Ennis <strong>of</strong> Bioenvironmental<br />

Engineering Services & Technologies, Inc. (B.E.S.T.)

requiring them to change the corporate name to remove the word<br />

‘Engineering’.<br />

04.08 An architect was accused <strong>of</strong> incompetence <strong>and</strong> <strong>of</strong> withholding refund<br />

<strong>of</strong> unearned retainer funds. Update: Investigation determined that<br />

the services provided by the architect were commensurate with the<br />

fee paid <strong>and</strong> that the services were <strong>of</strong> adequate quality.<br />

04.09 An architect is alleged to have sealed structural engineering documents.<br />

Update: It was found that a structural engineer was involved<br />

<strong>and</strong> had properly sealed the documents.<br />

04.10 This was a complaint against the engineer involved in 04.09.<br />

04.11 A state agency reported that a submittal requiring a seal had none.<br />

Action: A letter to the respondent resulted in the appropriate<br />

seal.<br />

04.12 Drawings submitted for review by a state agency lacked an architect’s<br />

seal. Action: Inquiry <strong>of</strong> the submitting party produced the seal <strong>of</strong><br />

an architect.<br />

04.13 A church camp project included architectural drawings sealed by<br />

a Pr<strong>of</strong>essional Engineer. Action: The architectural seal eventually<br />

provided was that <strong>of</strong> an Emeritus Architect, no longer licensed to<br />

practice in <strong>Nebraska</strong>. An active architect, while unwilling to seal<br />

drawings not produced by him, has written <strong>and</strong> sealed a letter to the<br />

complainant explaining his legitimate involvement in the project. The<br />

Emeritus Architect has been denied reactivation <strong>of</strong> his license.<br />

04.14, 04.15, 04.17, <strong>and</strong> 05.01 A Pr<strong>of</strong>essional Engineer employed by a metal<br />

building manufacturer has sealed architectural drawings for projects<br />

submitted to a state agency for review. Action: The board<br />

investigator is negotiating an agreed settlement in the matter.<br />

04.16 A bar project with no seals was submitted to a state agency for<br />

review <strong>and</strong> approval. Action: Identity <strong>of</strong> the design pr<strong>of</strong>essionals<br />

has been requested <strong>of</strong> the respondent.<br />

05.02 A Pr<strong>of</strong>essional Engineer has sealed architectural drawings for a<br />

furniture store. Action: The board has issued an <strong>of</strong>fi cial censure<br />

to the engineer, warning that a second <strong>of</strong>fense will result in a public<br />

(published) reprim<strong>and</strong>.<br />

05.03 Plans for a bank building with an estimated occupancy <strong>of</strong> thirty-two<br />

were submitted to a state agency for review; the drawings did not<br />

contain an architectural seal. Action: A letter has been written to<br />

the respondent requesting identity <strong>of</strong> the architect.<br />

05.04 Unsealed drawings for an animal show arena building on a county<br />

fairground have been submitted to a state agency for review. Action:<br />

Identity <strong>of</strong> the design pr<strong>of</strong>essionals has been requested.<br />

05.05 An unlicensed person has sealed drawings with an ‘Association<br />

<strong>of</strong> Iron & Steel <strong>Engineers</strong>’ seal. This person has previously been<br />

fi ned by the Colorado board for use <strong>of</strong> a fraudulent Colorado seal.

05.06 An unlicensed person has produced a brochure <strong>and</strong> web-site <strong>of</strong>fering<br />

environmental services. Action: Under review by the <strong>Board</strong>.<br />

05.07 A Pr<strong>of</strong>essional Engineer has been reported to have been involved in<br />

theft, conversion, <strong>and</strong> fraud in his dealings with a previous employer.<br />

Action: Under review by the <strong>Board</strong>; more legal information has<br />

been requested.<br />

05.08 An Architect is accused <strong>of</strong> obstructing the permitting <strong>of</strong> a project to<br />

effect payment <strong>of</strong> overdue fees. Action: The complaint was referred<br />

to the Joint Committee on Pr<strong>of</strong>essional Practice.<br />

The board may retain pr<strong>of</strong>essional assistance in carrying out administrative<br />

matters <strong>and</strong> other general governance <strong>of</strong> the board. Such assistance<br />

may include fi nancial, technological, investigatory, legal, <strong>and</strong> administrative<br />

Target Reserve for the E&A Regulation Fund<br />

The <strong>Engineers</strong> <strong>and</strong> <strong>Architects</strong> Regulation Fund (Fund 25810), created in<br />

NRS Section 81-3432, shall retain a reserve for contingencies <strong>and</strong> unforeseen<br />

conditions. The target reserve shall be double the amount <strong>of</strong> the<br />

annual budget for the agency. 9/17/2004<br />

Publication <strong>of</strong> Names <strong>of</strong> Those Subject to Disciplinary Action.<br />

The <strong>Board</strong>, having taken disciplinary action after hearing or by agreed<br />

settlement, may publish the respondent’s name <strong>and</strong> place <strong>of</strong> business.<br />

From its inception in May <strong>of</strong> 1991, this newsletter has devoted its back page<br />

to a duet <strong>of</strong> artistic works: a drawing <strong>of</strong> a <strong>Nebraska</strong> scene by Bob Hanna, a<br />

<strong>Nebraska</strong> Architect, <strong>and</strong> a poem by <strong>Nebraska</strong> Poet Ted Kooser.<br />

As noted in our last issue, Ted Kooser was named United States Poet Laureate<br />

in 2004. Now, Ted has received the additional honor <strong>of</strong> winning the 2005<br />

Pulitzer Prize for poetry for his book Delights <strong>and</strong> Shadows (Copper Canyon<br />

Press, 2004).<br />

We <strong>of</strong>fer our public congratulations to Ted on his recent honors <strong>and</strong> our<br />

sincere appreciation for his kind permission over the years to publish his<br />

remarkable works in our newsletter.<br />
