<strong>What</strong> <strong>is</strong> <strong>California</strong> <strong>Proposition</strong> <strong>65</strong> ?<br />
<strong>Proposition</strong> <strong>65</strong>, <strong>is</strong> formally known as the Safe Drinking Water and Toxic<br />
Enforcement Act of 1986 (Health and Safety Code, Chapter 6.6, Sections<br />
25249.5 through 25249.13). It was enacted by voters as an environmental ballot<br />
initiative in November 1986.<br />
<strong>Proposition</strong> <strong>65</strong> addresses exposure by:<br />
• drinking water d<strong>is</strong>charges,<br />
• environmental exposures,<br />
• occupational exposures, and<br />
• consumer products.<br />

In its simplest form, as regards consumer products, Prop <strong>65</strong> can be considered<br />
a consumer “right to know” law.<br />
It doesn’t prohibit the sale of products containing hazardous substances at any<br />
level.<br />
It does require that if these substances are present in recognized r<strong>is</strong>k levels<br />
that the product be properly labeled.<br />

• All products sold or d<strong>is</strong>tributed within <strong>California</strong> containing a l<strong>is</strong>ted<br />
chemical must comply with Prop <strong>65</strong> requirements for either r<strong>is</strong>k<br />
exposure and/or labeling.<br />
Who does Prop <strong>65</strong> affect ?<br />
• <strong>Proposition</strong> <strong>65</strong> imposes requirements on persons/ businesses doing<br />
business in <strong>California</strong> that have products containing specific l<strong>is</strong>ted<br />
chemicals.<br />

<strong>What</strong> Does Prop <strong>65</strong> require of Businesses?<br />
Prop <strong>65</strong> requires that manufacturers assess their products for Prop <strong>65</strong> l<strong>is</strong>ted<br />
chemicals and either ensure the levels present do not represent an added r<strong>is</strong>k to the<br />
consumer or label their products with an appropriate Prop <strong>65</strong> warning statement.<br />
As many manufacturers are not located in <strong>California</strong> retailers end up bearing the<br />
brunt of the litigation as they are on the “front line” as regards sales.<br />
Prop <strong>65</strong> include retailers that are solely internet and/or catalog based.<br />
