CALIFORNIA PROPOSITION 65
What is California Proposition 65 ?
Proposition 65, is formally known as the Safe Drinking Water and Toxic
Enforcement Act of 1986 (Health and Safety Code, Chapter 6.6, Sections
25249.5 through 25249.13). It was enacted by voters as an environmental ballot
initiative in November 1986.
• drinking water discharges,
• environmental exposures,
• occupational exposures, and
• consumer products.
CALIFORNIA PROPOSITION 65
In its simplest form, as regards consumer products, Prop 65 can be considered
a consumer “right to know” law.
It doesn’t prohibit the sale of products containing hazardous substances at any
level.
It does require that if these substances are present in recognized risk levels
that the product be properly labeled.
• All products sold or distributed within California containing a listed
chemical must comply with Prop 65 requirements for either risk
exposure and/or labeling.
Who does Prop 65 affect ?
• Proposition 65 imposes requirements on persons/ businesses doing
chemicals.
• Consumers
CALIFORNIA PROPOSITION 65
What Does Prop 65 require of Businesses?
Prop 65 requires that manufacturers assess their products for Prop 65 listed
chemicals and either ensure the levels present do not represent an added risk to the
consumer or label their products with an appropriate Prop 65 warning statement.
As many manufacturers are not located in California retailers end up bearing the
brunt of the litigation as they are on the “front line” as regards sales.
Prop 65 include retailers that are solely internet and/or catalog based.
