Data <strong>protection</strong> basics<br />
In brief…<br />
If you h<strong>and</strong>le in<strong>for</strong>mation about people, you will usually need to notify<br />
<strong>the</strong> ICO <strong>and</strong> comply with eight common-sense principles. The principles<br />
cover fairness, transparency, quantity, accuracy, time limits, individuals’<br />
rights, security, <strong>and</strong> international transfers. It is also a criminal offence<br />
to obtain, procure or disclose personal <strong>data</strong> without <strong>the</strong> consent of <strong>the</strong><br />
<strong>data</strong> controller.<br />
Some <strong>data</strong> <strong>protection</strong> myths<br />
Myth: <strong>the</strong> DPA doesn’t apply to <strong>the</strong> <strong>media</strong><br />
Reality: <strong>the</strong> DPA applies to any organisation h<strong>and</strong>ling in<strong>for</strong>mation<br />
about people. There is an exemption <strong>for</strong> <strong>journalism</strong>, but this<br />
does not give a blanket exemption from <strong>the</strong> DPA as a whole. See<br />
When does <strong>the</strong> DPA apply?<br />
Myth: <strong>the</strong> DPA only covers ‘private’ in<strong>for</strong>mation<br />
Reality: any in<strong>for</strong>mation about someone can be personal <strong>data</strong> –<br />
even if it’s in <strong>the</strong> public domain or is about someone’s public<br />

Myth: <strong>the</strong> DPA bans <strong>the</strong> disclosure of personal <strong>data</strong><br />
Reality: <strong>the</strong> DPA does not contain any absolute prohibitions. In<br />
general, <strong>the</strong> key is to consider what’s fair in <strong>the</strong> circumstances.<br />
