In brief…<br />
The ICO upholds in<strong>for</strong>mation rights in <strong>the</strong> public interest. We consider<br />
complaints, <strong>and</strong> have <strong>the</strong> power to take en<strong>for</strong>cement action <strong>for</strong> serious<br />
breaches, although our powers are more restricted in cases affecting <strong>the</strong><br />
<strong>media</strong>. We can also prosecute offences under <strong>the</strong> DPA. However, we<br />
cannot prevent publication or award compensation.<br />
We will always consider <strong>the</strong> impact on freedom of expression carefully<br />
be<strong>for</strong>e deciding to take any action. We will also seek to work with<br />
industry regulators, <strong>and</strong> refer issues to <strong>the</strong>m wherever appropriate.<br />
Individuals can also make DPA claims directly through <strong>the</strong> courts, but<br />
only after any relevant story has been published.<br />
Role of <strong>the</strong> ICO<br />
The In<strong>for</strong>mation Commissioner is <strong>the</strong> UK’s independent authority set up to<br />
uphold in<strong>for</strong>mation rights in <strong>the</strong> public interest, promoting openness by<br />
public bodies <strong>and</strong> <strong>data</strong> privacy <strong>for</strong> individuals. The Commissioner’s <strong>data</strong><br />
<strong>protection</strong> responsibilities are:<br />
to promote good practice <strong>and</strong> give advice <strong>and</strong> guidance;<br />
to keep a register of organisations processing personal <strong>data</strong>;<br />
to review complaints from <strong>the</strong> public <strong>and</strong> to consider whe<strong>the</strong>r fur<strong>the</strong>r<br />
regulatory action is required ;<br />
to take en<strong>for</strong>cement action against organisations that persistently<br />
ignore <strong>the</strong>ir obligations; <strong>and</strong><br />
to bring prosecutions <strong>for</strong> offences committed under <strong>the</strong> DPA.<br />
