As we want you to enjoy your purchases from <strong>High</strong> <strong>Life</strong> <strong>Shop</strong>, we are happy<br />

to refund or exchange unwanted items within 1 month of your receipt of them.<br />

Any defective items can be refunded within 1 month of receipt, or repaired/<br />

replaced within 6 months of receipt. Please see clause 8 for more details. We<br />

regret that we are unable to exchange or refund items on board. Your statutory<br />

rights are not affected.<br />

1 INTRODUCTION<br />

These Terms and Conditions are published by Tourvest Duty Free (UK) Ltd (“TDF”, “we”, “us”) on<br />

behalf of <strong>British</strong> <strong>Airways</strong> Plc (“BA”) and may be varied in accordance with clause 12. TDF is a<br />

company registered in England and Wales (Company number 05034988 [VAT number<br />

GB 832756514]). If you have any comments or questions about any aspect of <strong>High</strong> <strong>Life</strong> <strong>Shop</strong>,<br />

please contact us using the methods shown in our Enquiries and Returns section above.<br />

2 PLACING AN ORDER<br />

2.1 To purchase <strong>High</strong> <strong>Life</strong> <strong>Shop</strong> goods (the “Goods”), just ask a crew member once the <strong>High</strong><br />

<strong>Life</strong> <strong>Shop</strong> service commences on board (a “Request”). A Request is an offer by you which, if<br />

accepted by us, becomes a legally binding agreement.<br />

2.2 We reserve the right to decline any Request.<br />

2.3 You are responsible for accurately specifying the terms of your Request. If, due to any<br />

variation in price of the Goods, the price of the Goods is different from that set out in your<br />

Request, we will discuss this with you prior to processing your order in accordance with clause<br />

2.2 above.<br />

2.4 Goods are sold for personal use only and not for resale.<br />

3 PRODUCT AVAILABILITY AND DESCRIPTIONS<br />

3.1 We take care to ensure that all product information and pricing in respect of the Goods<br />

featured in the <strong>High</strong> <strong>Life</strong> <strong>Shop</strong> magazines are accurate. However, our Goods are continually<br />

updated and the images, specifications and prices may change. The representation of colours<br />

in the magazine may vary from the actual colours. Goods shown may not be to scale and we<br />

are unable to guarantee their size. Products are propped for size and to show usage — unless<br />

specified, props are not included.<br />

3.2 All Goods are subject to availability.<br />

4 ERRORS & OMISSIONS<br />

We have made reasonable endeavours to ensure the information is correct at the time of<br />

writing. Any typographical, clerical or other error or omission in the <strong>High</strong> <strong>Life</strong> <strong>Shop</strong> magazines<br />

shall be subject to correction without any liability on our part.<br />

5 PRICE<br />

5.1 The price of the Goods will be the price set out in the <strong>High</strong> <strong>Life</strong> <strong>Shop</strong> magazine (or such<br />

price as otherwise notified to you in accordance with clause 2.2).<br />

5.2 We reserve the right to change the prices quoted in the <strong>High</strong> <strong>Life</strong> <strong>Shop</strong> magazine at any<br />

time. Where used, ‘RRP’ means the recommended retail price on the high street in the UK.<br />

5.3 Prices for Goods in the <strong>High</strong> <strong>Life</strong> <strong>Shop</strong> magazines are shown in £sterling (GBP) and, where<br />

applicable, are inclusive of UK VAT. You will be liable for any import duties and local sales<br />

taxes that may be levied in the country of delivery.<br />

5.4 Card payments will appear on your payment card statement as “<strong>British</strong> <strong>Airways</strong> (Inflight)<br />

Retail”. Transactions will be effected in £sterling (GBP) and may be converted by your card<br />

issuer into your home currency.<br />

6 CARD PAYMENTS<br />

By presenting us with a payment card or details thereof, you confirm that (i) your use of the<br />

card to pay for Goods specified in the Request is authorised and (ii) that you authorise us to take<br />

payment of the full price of the Goods and all other amounts due such as delivery charges. We<br />

will confirm such other amounts with you by telephone or email prior to taking payment.<br />

7 RETURNS AND CANCELLATIONS<br />

Unwanted goods<br />

7.1 Subject to clause 7.4, we will refund or exchange any unwanted Goods within 1 month of<br />

your receipt of them provided that you notify us of your intention within that time.<br />

Faulty goods<br />

7.2 Subject to clause 7.4, if when you receive them Goods are faulty or are not as described,<br />

we will offer you:<br />

7.2.1 if you notify us within 1 month of receipt: the choice between a full refund, repair or<br />

replacement; or<br />

7.2.2 if you notify us between 1 month and 6 months following receipt: either a repair or a<br />

replacement.<br />

7.3 Please note that Goods shall not be considered faulty where a defect is due to wear and<br />

tear or wilful damage by or negligence of anyone other than us, our contractors or agents.<br />

Our office is open Monday-Friday between the hours of 0900 and 1800<br />

(UK time). <strong>High</strong> <strong>Life</strong> <strong>Shop</strong> operates on all BA flights excluding domestic and<br />

certain short European flights.<br />

TERMS AND CONDITIONS FOR HIGH LIFE SHOP<br />

7.4 For returns under clauses 7.1 to 7.3, we must receive the Goods back<br />

from you:<br />

(a) within 7 days of your notification;<br />

(b) with the original receipt or delivery note;<br />

(c) with a covering letter (specifying your order number, order date, delivery address, contact<br />

details, details of the fault (if any) and whether you require a refund/exchange/repair as<br />

applicable); and, in the case of returns under 7.1, the Goods must be:<br />

(d) in an unused condition with their original packaging intact.<br />

7.5 We are not responsible for returned Goods that are lost or damaged in transit. Proof of<br />

postage is not proof of receipt by/delivery to us. You should take reasonable care to ensure that<br />

the Goods returned are not damaged in transit and if appropriate arrange suitable insurance.<br />

7.6 We will refund you the reasonable costs, excluding courier costs, of safe delivery of Goods<br />

back to us other than in the case of:<br />

7.7 Our returns policy is based on your statutory rights.<br />

8 LIABILITY<br />

8.1 Subject to clause 8.2, we shall not be liable for any loss or damage (in contract, negligence<br />

or otherwise) where the loss or damage is an indirect result of any breach of a legal duty of<br />

care owed to you by us.<br />

8.2 We have the right to suspend or cancel our obligations (without liability to you) in whole or<br />

in part if we are delayed or prevented from carrying on our business or any of our obligations<br />

under these Terms and Conditions due to any circumstance beyond our reasonable control.<br />

8.3 Nothing in these Terms and Conditions shall be deemed to have given you a licence or<br />

any other rights to use the intellectual property rights owned by or licensed to us, including those<br />

created by us in the course of performance of our obligations.<br />

8.4 No third party (excluding any member of the BA group, who shall have such benefit and<br />

right) shall have the benefit of or the right to enforce these Terms and Conditions under the<br />

Contracts (Rights of Third Parties) Act 1999 or otherwise.<br />

8.5 These Terms and Conditions set out the entire agreement and understanding between you<br />

and us in connection with the sale of the Goods. You agree that you have not entered into this<br />

agreement in reliance on any representation made by or on behalf of BA except in so far as<br />

contained in these Terms and Conditions.<br />

8.6 Nothing in these Terms and Conditions excludes or limits our liability for fraudulent<br />

misrepresentation or for death or personal injury caused by our negligence.<br />

9 LAW AND JURISDICTION<br />

These Terms and Conditions shall be subject to English law and the parties hereby submit to the<br />

exclusive jurisdiction of English courts.<br />

10 DATA PROTECTION<br />

If you place an order with us, we will record your personal details. Your data will be used<br />

principally to provide you with the Goods and/or services you have purchased. We retain the<br />

data you provide from time to time, including data we collect when you place an order or use<br />

our products and services. Your data may be used for the following purposes: accounting, billing<br />

and audit, credit or other payment card verification, security, administrative and legal purposes,<br />

systems testing, maintenance and development. For these purposes we may disclose your data<br />

to any of the following: [TOURVEST GROUP] other companies in the <strong>British</strong> <strong>Airways</strong> group,<br />

other companies involved in providing you with the goods and/or services you have ordered<br />

(including our payment gateway service provider, logistics providers and customer service<br />

agents), data processing companies, our technology suppliers, government and enforcement<br />

agencies and credit and charge card companies. This may involve sending your data outside<br />

the European Economic Area.<br />

11 VARIATION<br />

We reserve the right to change these Terms and Conditions at any time. Any revised version<br />

will govern Requests and our relationship with you from the time at which it is posted on the<br />

highlifeshop.com website.<br />
