Accord<strong>in</strong>g to local folklore, <strong>Australian</strong><br />

media mogul Rupert Murdoch got<br />

so sick <strong>of</strong> be<strong>in</strong>g unable to see<br />

anyth<strong>in</strong>g from his multi-milliondollar<br />

view on <strong>The</strong> Peak that he sold up and<br />

never went back. Michael Wray writes.<br />

At the time, Murdoch was attempt<strong>in</strong>g<br />

to cash <strong>in</strong> on Ch<strong>in</strong>a’s economic miracle by<br />

creat<strong>in</strong>g a cable-television network that<br />

would have potentially made him the world’s<br />

greatest media baron.<br />

Ch<strong>in</strong>a was still <strong>in</strong> the early stages <strong>of</strong><br />

open<strong>in</strong>g up and, the legend goes, on the<br />

days when he could see Victoria Harbour,<br />

Murdoch liked to count conta<strong>in</strong>er ships on<br />

the water as a crude barometer <strong>of</strong> how the<br />

economy was travel<strong>in</strong>g.<br />

Eventually though Murdoch was forced<br />

to walk away from both the view and his<br />

television dreams. Ch<strong>in</strong>a’s dream, however,<br />

cont<strong>in</strong>ued unabated, ships kept fill<strong>in</strong>g<br />

the harbour and eventually the ma<strong>in</strong>land<br />

economy overtook Japan to become the<br />

world’s second largest, beh<strong>in</strong>d the US.<br />

<strong>Hong</strong> <strong>Kong</strong>’s proximity to Ch<strong>in</strong>a and<br />

close political ties with Beij<strong>in</strong>g dur<strong>in</strong>g that<br />

period mean it has reaped huge f<strong>in</strong>ancial<br />

ga<strong>in</strong>s from the ma<strong>in</strong>land’s success. But <strong>Hong</strong><br />

<strong>Kong</strong>’s geographic position has also led it<br />

to import many <strong>of</strong> Ch<strong>in</strong>a’s environmental<br />

problems, <strong>in</strong>clud<strong>in</strong>g even more days <strong>of</strong><br />

the thick pollution that blocked Murdoch’s<br />

view.<br />

For years <strong>Hong</strong> <strong>Kong</strong> has blamed heavy<br />

<strong>in</strong>dustrialisation and coal-fired power<br />

stations <strong>in</strong> the Pearl River Delta across the<br />

border for the heavy smog that descends<br />

on the city.<br />

Last year the BBC reported that <strong>Hong</strong><br />

<strong>Kong</strong>’s high levels <strong>of</strong> pollution were<br />

mak<strong>in</strong>g it harder for bus<strong>in</strong>esses to reta<strong>in</strong><br />

and hire <strong>in</strong>ternational staff, erod<strong>in</strong>g <strong>Hong</strong><br />

<strong>Kong</strong>'s appeal as a place to live and work.<br />

It also said that one <strong>in</strong> four <strong>Hong</strong> <strong>Kong</strong><br />

residents was consider<strong>in</strong>g emigrat<strong>in</strong>g<br />

because <strong>of</strong> air pollution.<br />

Each <strong>Hong</strong> <strong>Kong</strong> person<br />

still threw away about<br />

6kg <strong>of</strong> waste from their<br />

homes every week<br />

Accord<strong>in</strong>g to <strong>Hong</strong> <strong>Kong</strong> Observatory<br />

data, there has been a “dramatic rise <strong>in</strong><br />

the frequency <strong>of</strong> reduced visibility” <strong>in</strong> the<br />

city s<strong>in</strong>ce the late 1980s, when Ch<strong>in</strong>a’s<br />

<strong>in</strong>dustrialisation began to ramp up. In<br />

the 1960s and ‘70s, visibility had been<br />

consistently much clearer.<br />

A 2020 Climate Strategy that's rapidly<br />

runn<strong>in</strong>g short <strong>of</strong> gas<br />

<strong>The</strong> Observatory’s data removes<br />

days when there is fog, mist, ra<strong>in</strong> or high<br />

relative humidity, so it is effectively a<br />

measure <strong>of</strong> smog and pollution.<br />

To help counter the grow<strong>in</strong>g problem,<br />

the <strong>Hong</strong> <strong>Kong</strong> government <strong>in</strong> 2009<br />

released its Climate Strategy, which set<br />

an ambitious target <strong>of</strong> reduc<strong>in</strong>g carbon<br />

<strong>in</strong>tensity per unit <strong>of</strong> GDP by 50-60 per<br />

cent <strong>in</strong> 2020 compared with 2005 levels.<br />

<strong>The</strong> strategy relied on four <strong>in</strong>itiatives:<br />

1. Maximis<strong>in</strong>g energy efficiency;<br />

2. Green<strong>in</strong>g road transport and promot<strong>in</strong>g<br />

electric vehicles;<br />

3. Turn<strong>in</strong>g waste <strong>in</strong>to energy;<br />

4. Revamp<strong>in</strong>g the fuel mix for electricity<br />

generation.<br />

Although <strong>Hong</strong> <strong>Kong</strong> is a modern city,<br />

a quick look around at the number <strong>of</strong><br />

ancient wall-style air conditioners stick<strong>in</strong>g<br />

out <strong>of</strong> build<strong>in</strong>gs shows that policies<br />

promot<strong>in</strong>g energy efficiency have the<br />

potential for large emission reductions.<br />

Similarly clean<strong>in</strong>g up the transport<br />

<strong>in</strong>dustry, which contributes 18 per cent <strong>of</strong><br />

<strong>Hong</strong> <strong>Kong</strong>’s greenhouse emissions, and<br />

waste management has strong potential<br />

for positive reductions.<br />

the largest contributor to the problem,<br />

account<strong>in</strong>g for 69 per cent <strong>of</strong> total<br />

emissions <strong>in</strong> 2008. And even if all other<br />

<strong>in</strong>itiatives work perfectly, <strong>Hong</strong> <strong>Kong</strong> would<br />

still be unable to meet its greenhouse goals<br />

unless it can reduce its reliance on thermalcoal<br />

for electricity production.<br />

<strong>The</strong> government has set a target <strong>of</strong><br />

reduc<strong>in</strong>g coal-fired power from the current<br />

54 per cent <strong>of</strong> the fuel mix to just 6 per cent<br />

by 2020 and for it to be totally elim<strong>in</strong>ated<br />

by 2030.<br />

Fill<strong>in</strong>g the gap, natural gas use is slated<br />

to rise from its current 23 per cent to 40<br />

per cent <strong>in</strong> 2020. Use <strong>of</strong> nuclear power<br />

should rise from 23 per cent to 50 per cent<br />

<strong>in</strong> that period and w<strong>in</strong>d energy grow from<br />

its current 1-2 per cent to 3-4 per cent.<br />

Ch<strong>in</strong>a has also set ambitious targets<br />

for reductions <strong>in</strong> greenhouse emissions<br />

that, if met, would significantly clear up the<br />

air drift<strong>in</strong>g over <strong>Hong</strong> <strong>Kong</strong> from the Pearl<br />

River Delta.<br />

Like <strong>Hong</strong> <strong>Kong</strong>, Ch<strong>in</strong>a is rely<strong>in</strong>g<br />

on large <strong>in</strong>creases <strong>in</strong> nuclear power for<br />

electricity generation to meet its goals.<br />

But these plans have been thrown <strong>in</strong>to<br />

disarray s<strong>in</strong>ce the earthquake and tsunami<br />

<strong>in</strong> Japan last year decimated the Fukishima<br />

nuclear plant and forced governments<br />

around the world, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong> Ch<strong>in</strong>a, to<br />

reconsider their use <strong>of</strong> nuclear power.<br />

Accord<strong>in</strong>g to a report prepared for<br />

Civic Exchange, a th<strong>in</strong>k tank, the <strong>Hong</strong><br />

<strong>Kong</strong> Government has been caught out by<br />

the freeze on nuclear expansion and this<br />

threatens to derail its efforts to meet the<br />

emission reduction goals.<br />

“<strong>Hong</strong> <strong>Kong</strong> <strong>of</strong>ficials have not come to<br />

a decision on how to go forward, and they<br />

are monitor<strong>in</strong>g <strong>in</strong>ternational debate on<br />

nuclear energy,” the report says.<br />

Accord<strong>in</strong>g to the report Ch<strong>in</strong>a is<br />

expected to quickly return to its nuclear<br />

program because it simply has few other<br />

short-term options to produce huge<br />

amounts <strong>of</strong> energy us<strong>in</strong>g low emissions.<br />

In <strong>Hong</strong> <strong>Kong</strong> though the decision is made<br />

more difficult as citizens have seen what<br />

happened <strong>in</strong> Japan and will expect more <strong>of</strong><br />

a voice on the f<strong>in</strong>al decision.<br />

“<strong>Hong</strong> <strong>Kong</strong> would not meet its carbon<br />

coal use as proposed, kept nuclear import<br />

at the same level as today (23%), added<br />

w<strong>in</strong>d power as planned, and made up the<br />

difference by import<strong>in</strong>g much more natural<br />

gas,” the report says.<br />

“Whether <strong>Hong</strong> <strong>Kong</strong> could <strong>in</strong>crease<br />

natural gas supply by a large marg<strong>in</strong> and<br />

whether <strong>Hong</strong> <strong>Kong</strong> would be prepared to<br />

keep a higher level <strong>of</strong> coal usage are issues<br />

that will have to be discussed should it wish<br />

not to <strong>in</strong>crease nuclear electricity imports.”<br />

In a report on the city’s environment<br />

for the period 1986 to 2011, Environment<br />

Secretary Edward Yau said <strong>Hong</strong> <strong>Kong</strong> had<br />

made “remarkable progress’’ over 25 years<br />

and residents lived <strong>in</strong> a “healthier and more<br />

pleasant city”.<br />

He said the two greatest challenges<br />

to the environment were climate change<br />

and waste management. Further to that,<br />

each <strong>Hong</strong> <strong>Kong</strong> person still threw away<br />

about 6kg <strong>of</strong> waste from their homes<br />

every week, which put enormous stra<strong>in</strong> on<br />

landfills. He admitted governments had an<br />

important role <strong>in</strong> overcom<strong>in</strong>g environmental<br />

problems but the first responsibility lay with<br />

<strong>in</strong>dividuals, who had to contribute to the<br />

effort.<br />

or because most <strong>of</strong> the city is <strong>in</strong> holiday<br />

nooks which don’t like moisture. Anyway, as<br />

French moniker aside, stick to the asparagus & parmesan<br />

risotto. Far more reward<strong>in</strong>g than the nespresso cuppa.<br />

How do you judge this <strong>in</strong>novative fusion <strong>of</strong> a café and<br />

salon - by the c<strong>of</strong>fee or the haircut? One sip says ‘you’ve<br />

had this before’, Pacific C<strong>of</strong>fee brews all the c<strong>of</strong>fee albeit<br />

under a different name. While the taste is predictable,<br />

it’s a nifty shelter from the busy Central flow –<br />

you might got for a haircut too.<br />

It was Kermit the<br />

Frog who crooned the<br />

tune “Its not easy be<strong>in</strong>g<br />

Green” and whilst this<br />

was a reference to Kermit<br />

be<strong>in</strong>g an “amphibian <strong>of</strong><br />

colour” rather than an environmentalist the<br />

phrase does sum up the challenges <strong>of</strong> tak<strong>in</strong>g<br />

a susta<strong>in</strong>able approach to liv<strong>in</strong>g <strong>in</strong> our city <strong>of</strong><br />

seven million people.<br />

<strong>The</strong>re are <strong>of</strong> course many dedicated people<br />

<strong>in</strong> <strong>Hong</strong> <strong>Kong</strong> work<strong>in</strong>g on this challenge and<br />

I cont<strong>in</strong>ue to be impressed with the work<br />

<strong>of</strong> AustCham’s Susta<strong>in</strong>able Development<br />

committee. I’m pleased that this month’s<br />

edition <strong>of</strong> AustCham news is devoted to their<br />

cause and the broader issues <strong>of</strong> susta<strong>in</strong>ability<br />

and a cleaner environment for our great<br />

city <strong>of</strong> <strong>Hong</strong> <strong>Kong</strong>. If you’re <strong>in</strong>terested <strong>in</strong><br />

Last month I was <strong>in</strong>vited to speak on behalf<br />

<strong>of</strong> AustCham on a panel at the 2nd Australia<br />

Ch<strong>in</strong>a Media forum <strong>in</strong> Conghua, Guangdong.<br />

COMMUNITYCORNERCORNER<br />

<strong>The</strong> media forum was a two-day event that<br />

bought together people from the key media<br />

outlets and government agencies <strong>in</strong> Australia<br />

and the ma<strong>in</strong>land. <strong>The</strong> focus <strong>of</strong> the forum<br />

was to explore ways <strong>in</strong> which the media could<br />

be used to develop the very board bilateral<br />

relationship that exists between Australia and<br />

greater Ch<strong>in</strong>a.<br />

In recognition <strong>of</strong> 40 years <strong>of</strong> diplomatic<br />

relations with Ch<strong>in</strong>a, much was made <strong>of</strong> the<br />

ma<strong>in</strong>land. Importantly, I also spoke publicly<br />

and privately with a number <strong>of</strong> delegates<br />

about the important roles that <strong>Hong</strong> <strong>Kong</strong>,<br />

and our <strong>Chamber</strong> can play <strong>in</strong> be<strong>in</strong>g a bridge<br />

Inhale now: Australia puts its price on fresh air<br />

On July 1, Australia became the<br />

world’s most expensive place to<br />

emit greenhouse gases after a tax<br />

<strong>of</strong> AU$23 tax per tonne was placed<br />

on carbon.<br />

Although only 300 companies will be<br />

forced to pay, the burden <strong>of</strong> the tax will flow<br />

through the entire economy as bus<strong>in</strong>esses<br />

pass on any <strong>in</strong>creased costs. <strong>The</strong> most<br />

visible effect is likely to be on domestic<br />

power bills after energy companies jack up<br />

prices to <strong>of</strong>fset balloon<strong>in</strong>g tax exposures.<br />

Among others, the m<strong>in</strong><strong>in</strong>g, transport and<br />

steel <strong>in</strong>dustries will be affected.<br />

<strong>The</strong> Government is fac<strong>in</strong>g a massive<br />

scare campaign from the Opposition but has<br />

told low and middle-<strong>in</strong>come earners not to<br />

worry because tax receipts will be used to<br />

compensate them for any higher costs.<br />

Prime M<strong>in</strong>ister Julia Gillard has argued<br />

the carbon tax is necessary if Australia,<br />

which is the world’s largest greenhouse<br />

polluter per head, is to meet its obligations<br />

on greenhouse omissions.<br />

Opposition Leader Tony Abbot has<br />

called it a “toxic tax” and has promised to<br />

repeal the legislation should he w<strong>in</strong> the next<br />

election.<br />

If op<strong>in</strong>ion polls can be believed, this is a<br />

very real possibility. Accord<strong>in</strong>g to a Nielsen<br />

poll taken <strong>in</strong> early July, just after the tax<br />

was <strong>in</strong>troduced, Labor’s Primary vote was<br />

just 28 per cent, compared with 48 per cent<br />

for the Coalition.<br />

Speak<strong>in</strong>g to an AustCham bus<strong>in</strong>ess<br />

lunch <strong>in</strong> <strong>Hong</strong> <strong>Kong</strong> recently, Treasurer<br />

Wayne Swan admitted that the <strong>in</strong>troduction<br />

<strong>of</strong> the tax along with the M<strong>in</strong>eral Resources<br />

Rent Tax (MRRT) had contributed to Labor’s<br />

dismal position <strong>in</strong> the polls.<br />

“We came back <strong>in</strong> as a m<strong>in</strong>ority<br />

government and proceeded to put <strong>in</strong><br />

place some big significant reforms like<br />

carbon pric<strong>in</strong>g and then you get a negative<br />

opposition… they’ve run negative and<br />

they’ve run hard and they’ve done it <strong>in</strong> that<br />

environment, and I th<strong>in</strong>k they’ve had a fair<br />

bit <strong>of</strong> impact,” he said.<br />

A Nielsen poll taken <strong>in</strong> the days after<br />

the tax was <strong>in</strong>troduced found support for<br />

it had dropped to an all-time low <strong>of</strong> just 33<br />

per cent.<br />

Projections for the total impact on daily<br />

liv<strong>in</strong>g costs range from benign to significant.<br />

Treasury has estimated that an average<br />

family will pay $9.90 more per week <strong>in</strong> the<br />

first year <strong>of</strong> the scheme’s <strong>in</strong>troduction.<br />

It is still much too early to work out<br />

the real costs however opponents and the<br />

media have been search<strong>in</strong>g for any signs <strong>of</strong><br />

ris<strong>in</strong>g prices.<br />

<strong>The</strong> Manag<strong>in</strong>g Director <strong>of</strong> Brumby’s<br />

bakery was forced to resign after be<strong>in</strong>g<br />

caught urg<strong>in</strong>g his employees to blame price<br />

rises on the carbon tax.<br />

<strong>The</strong>n about two weeks after the tax<br />

was <strong>in</strong>troduced, the <strong>Australian</strong> Competition<br />

and Consumer Commission (ACCC) released<br />

figures on the number <strong>of</strong> compla<strong>in</strong>ts it had<br />

received dur<strong>in</strong>g that period. More than 600<br />

compla<strong>in</strong>ts or enquiries directly related to<br />

the tax were received <strong>in</strong> the first 10 days<br />

after it was <strong>in</strong>troduced. In total the ACCC<br />

received more than 8000 general compla<strong>in</strong>ts<br />

for that period.<br />

Deputy Chairman <strong>of</strong> the ACCC Michael<br />

Schaper told the ABC that out <strong>of</strong> the 600-<br />

odd carbon tax compla<strong>in</strong>ts, it was actively<br />

<strong>in</strong>vestigat<strong>in</strong>g 20.<br />

“I can't give details about any <strong>of</strong> those<br />

specific <strong>in</strong>vestigations,” he said.<br />

“I will po<strong>in</strong>t out though that <strong>of</strong> the<br />

compla<strong>in</strong>ts more generally that we've<br />

received, clearly the biggest group have<br />

been about energy retailers and <strong>in</strong> addition<br />

to that a number <strong>of</strong> other sectors such<br />

as construction, land fill and refrigerant<br />

gases.”<br />

In a recent editorial <strong>The</strong> Economist<br />

magaz<strong>in</strong>e said that despite “birth defects”<br />

<strong>in</strong> implement<strong>in</strong>g the carbon tax and<br />

the MRRT there were “merits <strong>in</strong> their<br />

conception”.<br />

“(It will allow) the government to lower<br />

taxes on work, by rais<strong>in</strong>g the threshold for<br />

<strong>in</strong>come tax,” the magaz<strong>in</strong>e said.<br />

well to emulate and improve upon Australia’s<br />

efforts to shift the tax burden from hardearned<br />

wages and pr<strong>of</strong>its to unearned rents<br />

and uncompensated harms”.<br />

That view is <strong>in</strong> the m<strong>in</strong>ority <strong>in</strong> Australia<br />

right now and unless Gillard can change<br />

that, she and her colleagues could well<br />

f<strong>in</strong>d themselves <strong>in</strong> a m<strong>in</strong>ority <strong>in</strong> the next<br />

parliament.<br />

<strong>The</strong> obsession from both sides for<br />

f<strong>in</strong>d<strong>in</strong>g statistics to back their case<br />

is likely to cont<strong>in</strong>ue right up to the<br />

election campaign - where the issue will<br />

be a significant factor because <strong>of</strong> the<br />

Opposition’s promise to scrap the tax.<br />

<strong>The</strong>re are doubts <strong>in</strong> some quarters that<br />

the Opposition would actually go through<br />

with the promise however senior Liberal<br />

Christopher Pyne <strong>in</strong>sisted to Sky News that<br />

they were serious and that the next election<br />

would be a referendum on the carbon tax.<br />

“We are tell<strong>in</strong>g the <strong>Australian</strong> public<br />

right up front, we will abolish the carbon<br />

tax... you couldn't be any clearer than that,”<br />

he said.<br />

In the weeks after the tax was<br />

<strong>in</strong>troduced both government and opposition<br />

MPs fanned out across the country to spread<br />

their message.<br />

Climate Change M<strong>in</strong>ister Greg Combet<br />

summed up the government’s message to the<br />

ABC.<br />

"This is a reform that is perfectly<br />

manageable, one that is a responsible th<strong>in</strong>g<br />

to do," he said.<br />

While the Opposition arguments seem to<br />

be ga<strong>in</strong><strong>in</strong>g most traction there are glimmers<br />

<strong>of</strong> hope that with the right strategy, Gillard<br />

might be able to turn public op<strong>in</strong>ion her way.<br />

Your Bus<strong>in</strong>ess and the Carbon Pric<strong>in</strong>g Mechanism<br />

Bree Miechel, a member <strong>of</strong> AustCham’s Susta<strong>in</strong>able Development Committee,<br />

is a Manag<strong>in</strong>g Associate at Simmons & Simmons. Here she outl<strong>in</strong>es what your<br />

bus<strong>in</strong>ess should aware <strong>of</strong> under the new <strong>Australian</strong> Carbon Tax system.<br />

<strong>The</strong> contentious Carbon Pric<strong>in</strong>g<br />

Mechanism (“CPM”) came <strong>in</strong>to effect<br />

<strong>in</strong> Australia on 1 July. Over the next<br />

3 years, emissions units are to be<br />

issued by the Government (the “fixed price<br />

period”), and from 2015 onwards a ‘capand-trade’<br />

scheme is to be <strong>in</strong>troduced (the<br />

“flexible price period”).<br />

1. Will the CPM affect my bus<strong>in</strong>ess?<br />

Large emitters <strong>of</strong> greenhouse gases<br />

(referred to as “liable entities”) will<br />

need to obta<strong>in</strong> carbon permits <strong>in</strong><br />

exchange for every tonne <strong>of</strong> CO2<br />

equivalent produced. Whilst these<br />

are to be obta<strong>in</strong>ed by direct emitters,<br />

the impact <strong>of</strong> the carbon price will<br />

<strong>in</strong>evitably trickle down the supply cha<strong>in</strong><br />

and affect the prices <strong>of</strong> goods and<br />

services market-wide. <strong>The</strong> most obvious<br />

sectors that will be directly impacted<br />

are:<br />

• M<strong>in</strong><strong>in</strong>g<br />

• Manufactur<strong>in</strong>g<br />

• Natural gas suppliers<br />

• Industrial processes (cement,<br />

chemicals, metal process<strong>in</strong>g)<br />

• Waste disposal<br />

2. What are the different types <strong>of</strong><br />

emissions units under the CPM?<br />

Three types <strong>of</strong> carbon permits can<br />

be used at different times under the<br />

scheme: Carbon Units, <strong>Australian</strong><br />

Carbon Credit Units (“ACCUs”) and<br />

Eligible International Emissions Units<br />

(“EIEUs”).<br />

3. How can my bus<strong>in</strong>ess satisfy its liability<br />

dur<strong>in</strong>g the “fixed price period”?<br />

From 1 July 2012 to 1 July 2015, Carbon<br />

Units will be sold by the Clean Energy<br />

Regulator at a fixed-price. Trad<strong>in</strong>g will<br />

be m<strong>in</strong>imal as the units will expire on 1<br />

February <strong>of</strong> the follow<strong>in</strong>g year and can<br />

be resold to the Regulator.<br />

ACCUs are emission units generated by<br />

land-based sequestration and <strong>of</strong>fset<br />

projects and may be used to <strong>of</strong>fset up<br />

to 5% <strong>of</strong> a liable entity’s obligations<br />

dur<strong>in</strong>g the fixed price period.<br />

4. How can my bus<strong>in</strong>ess satisfy its liability<br />

dur<strong>in</strong>g the “flexible price period”?<br />

From 2015 onwards, a ‘cap-and-trade’<br />

scheme will operate. For the first 3<br />

years until 2018, to m<strong>in</strong>imise price<br />

volatility the price <strong>of</strong> carbon permits<br />

must fall between pre-set floor and<br />

ceil<strong>in</strong>g prices. After this, pric<strong>in</strong>g will<br />

be flexible and determ<strong>in</strong>ed by market<br />

forces. <strong>The</strong> cap will be set every 5<br />

years to reflect Australia’s commitment<br />

to greenhouse gas reduction targets<br />

and <strong>in</strong>ternational climate change<br />

obligations.<br />

Unlike the fixed price period,<br />

bus<strong>in</strong>esses will not be restricted to<br />

us<strong>in</strong>g Carbon Units and ACCUs to meet<br />

their compliance obligations. EIEUs may<br />

also be used to meet up to 50% <strong>of</strong> a<br />

bus<strong>in</strong>ess’ liability. EIEUs <strong>in</strong>clude units<br />

issued <strong>in</strong> accordance with the Kyoto<br />

Protocol such as Certified Emission<br />

Reductions generated by Clean<br />

Development Mechanism projects.<br />

5. What restrictions apply to trad<strong>in</strong>g<br />

emissions units?<br />

Carbon Units, ACCUs and EIEUs are<br />

considered f<strong>in</strong>ancial products under<br />

the Corporations Act 2001. Accord<strong>in</strong>gly,<br />

entities deal<strong>in</strong>g <strong>in</strong>, creat<strong>in</strong>g a market<br />

for or advis<strong>in</strong>g on such products may<br />

need to obta<strong>in</strong> an <strong>Australian</strong> F<strong>in</strong>ancial<br />

Services Licence (“AFSL”) or seek a<br />

variation to an exist<strong>in</strong>g AFSL from the<br />

<strong>Australian</strong> Securities and Investments<br />

Commission. Certa<strong>in</strong> limited exceptions<br />

apply <strong>in</strong>clud<strong>in</strong>g for (1) <strong>in</strong>dividual<br />

traders, (2) entities provid<strong>in</strong>g services<br />

to a related body with<strong>in</strong> a corporate<br />

structure (exclud<strong>in</strong>g jo<strong>in</strong>t ventures)<br />

for the purposes <strong>of</strong> f<strong>in</strong>ancial risk<br />

management, and (3) entities acquir<strong>in</strong>g<br />

emissions units for their own use<br />

(exclud<strong>in</strong>g OTC derivatives).<br />

6. Does the CPM create any opportunities<br />

for non-liable entities and foreign<br />

<strong>in</strong>vestors?<br />

Yes. <strong>The</strong> <strong>Australian</strong> Government has<br />

established the Clean Energy F<strong>in</strong>ance<br />

Corporation (“CEFC”) with AUD10 billion<br />

fund<strong>in</strong>g to assist with the development<br />

<strong>of</strong> renewable energy resources and<br />

clean energy projects. Provided that<br />

a bus<strong>in</strong>ess is primarily located <strong>in</strong><br />

Australia, it may apply for assistance<br />

through the CEFC. It is anticipated<br />

that the CEFC could unlock over AUD50<br />

billion <strong>in</strong> private capital.<br />

7. What should my bus<strong>in</strong>ess do to prepare<br />

for the CPM?<br />

Even if your bus<strong>in</strong>ess is not a liable<br />

entity, it is important to mitigate the<br />

potential impact <strong>of</strong> the CPM by mak<strong>in</strong>g<br />

appropriate management decisions.<br />

You may consider the follow<strong>in</strong>g:<br />

• Assess<strong>in</strong>g the<br />

potential impact <strong>of</strong> the CPM on<br />

current and future <strong>in</strong>vestments<br />

• Exam<strong>in</strong><strong>in</strong>g eligibility for Government<br />

grants and funds<br />

• Consider<strong>in</strong>g the impact <strong>of</strong> the carbon<br />

price when negotiat<strong>in</strong>g contracts<br />

• Prepar<strong>in</strong>g for <strong>in</strong>ternational trad<strong>in</strong>g<br />

opportunities <strong>in</strong> the future with the<br />

EU, New Zealand and other Asian<br />

markets<br />

Whether or not the scope <strong>of</strong> the CPM<br />

appropriately balances Australia’s<br />

environmental and economic<br />

considerations, the pric<strong>in</strong>g <strong>of</strong> carbon<br />

emissions is a step <strong>in</strong> the right<br />

direction. It is important for the<br />

susta<strong>in</strong>able development <strong>of</strong> the<br />

<strong>Australian</strong> economy and our stand<strong>in</strong>g<br />

as <strong>in</strong>ternational citizens.<br />

<strong>The</strong> futuristic Vida Rica Bar at the Mandar<strong>in</strong> Oriental<br />

was the venue for the fourth Macau M<strong>in</strong>gler.<br />

<strong>The</strong>re was another great mix <strong>of</strong> guests who enjoyed<br />

the wonderful hospitality <strong>of</strong> the Mandar<strong>in</strong> Oriental who<br />

were also the ma<strong>in</strong> sponsor for the even<strong>in</strong>g. It was good<br />

to see so many there who came across from HK and<br />

made the most <strong>of</strong> the opportunity to have a night out <strong>in</strong><br />

A<br />

revolution<br />

is quietly occurr<strong>in</strong>g <strong>in</strong> the workplace, as the<br />

shift to alternative workplace solutions is rapidly ga<strong>in</strong><strong>in</strong>g<br />

traction with<strong>in</strong> enlightened organisations.<br />

A research firm, International Data Corporation, recently<br />

reported that as <strong>of</strong> end 2011, more than 1 billion people or 18%<br />

<strong>of</strong> the global workforce are now operat<strong>in</strong>g as Mobile Workers,<br />

mean<strong>in</strong>g that they spend at least 2 days <strong>of</strong> every week work<strong>in</strong>g<br />

outside <strong>of</strong> the traditional <strong>of</strong>fice. This figure is expected to double<br />

to 2 billion workers by the end <strong>of</strong> this decade.<br />

At a recent AustCham breakfast sem<strong>in</strong>ar held on the<br />

topic <strong>of</strong> Virtual Office & Workplace Solutions, Alex Guthrie<br />

from HSBC expla<strong>in</strong>ed that whilst the corporate benefits<br />

<strong>of</strong> an Alternative Workplace Strategy (AWS) are <strong>of</strong>ten well<br />

understood, companies need to also <strong>in</strong>vest the effort <strong>in</strong><br />

sell<strong>in</strong>g the benefits <strong>of</strong> an AWS to their employees and<br />

help them understand that this is a journey that they are<br />

embark<strong>in</strong>g on and not a dest<strong>in</strong>ation to beg<strong>in</strong> with. From his<br />

experience, if the change management process is handled<br />

effectively, then more than 60% <strong>of</strong> the workforce will<br />

enthusiastically embrace a flexible work<strong>in</strong>g arrangement<br />

and give up entitlements such as a permanent desk at their<br />

primary place <strong>of</strong> work.<br />

As Neil Salton from Woods Bagot elaborated,<br />

“If you ask employees whether they would prefer to own<br />

and drive a Ford or share <strong>in</strong> driv<strong>in</strong>g a Ferrari, then most will<br />

choose the latter alternative”.<br />

“Advances <strong>in</strong> mobile and network<strong>in</strong>g technologies,<br />

together with the development <strong>of</strong> sophisticated collaboration<br />

tools, is now enabl<strong>in</strong>g distributed teams to operate effectively<br />

across multiple different locations and vary<strong>in</strong>g time zones”<br />

expla<strong>in</strong>ed Peter Smith from Wavelength Consult<strong>in</strong>g.<br />

<strong>The</strong> benefits <strong>of</strong> an effectively executed Alternative<br />

Workplace Strategy are certa<strong>in</strong>ly compell<strong>in</strong>g, where a 20-50<br />

percent improvement <strong>in</strong> asset performance and cost sav<strong>in</strong>gs<br />

for <strong>of</strong>fice real estate is achievable. Greater productivity and<br />

collaborative work efforts, along with higher staff retention<br />

are also key benefits. This is particularly the case for Gen<br />

Y’s and Millenials, who typically highly value hav<strong>in</strong>g flexible<br />

workplace arrangements.<br />

F<strong>in</strong>ancial, Legal and Tax Committee: Submission to<br />

Treasurer on Double Taxation Agreement<br />

Dur<strong>in</strong>g his July visit to <strong>Hong</strong> <strong>Kong</strong>, the <strong>Australian</strong> Treasurer, Wayne Swan,<br />

received a submission from our committee urg<strong>in</strong>g him to elevate the<br />

importance <strong>of</strong> a double taxation agreement between Australia and <strong>Hong</strong><br />

<strong>Kong</strong>.<br />

<strong>The</strong> committee gave five key reasons <strong>in</strong> support:<br />

1. It would encourage Asian <strong>in</strong>vestors to participate <strong>in</strong> <strong>Australian</strong> funds<br />

2. Australia would be able to take greater advantage <strong>of</strong> <strong>Hong</strong> <strong>Kong</strong>’s Closer<br />

Economic Partnership Arrangement with Ch<strong>in</strong>a - and thus its ability to<br />

export to Ch<strong>in</strong>a tariff free.<br />

3. Australia’s reputation as a regional hub for f<strong>in</strong>ancial services <strong>in</strong> Asia<br />

would be raised - and reservations <strong>in</strong>vestors have about the <strong>Australian</strong><br />

f<strong>in</strong>ancial services <strong>in</strong>dustry would be reduced.<br />

4. It would support Australia’s development as a secondary RMB dest<strong>in</strong>ation<br />

<strong>in</strong> Asia.<br />

5. It would redress the present imbalance <strong>in</strong> Australia’s tax treatment<br />

between S<strong>in</strong>gapore and <strong>Hong</strong> <strong>Kong</strong>, which favours S<strong>in</strong>gapore.<br />
