sett<strong>in</strong>g up a test trial where a 'gross <strong>of</strong>fender' is either sued or, with the aid <strong>of</strong> the prosecutor, brought to court. Some<br />

awareness campaigns especially aimed at lawyers <strong>and</strong> judges might also help <strong>in</strong> try<strong>in</strong>g to make them aware <strong>of</strong> how they<br />

can contribute to stopp<strong>in</strong>g the decl<strong>in</strong>e <strong>of</strong> wildlife throughout <strong>In</strong>donesia (or alternatively, how they, by not act<strong>in</strong>g,<br />

actively contribute to its decl<strong>in</strong>e). Furthermore, the law-enforcement hierarchy needs to be targeted to persuade <strong>of</strong>ficials<br />

to convict <strong>trade</strong>rs, owners, etc., <strong>and</strong> attention needs to be given towards devis<strong>in</strong>g <strong>in</strong>centives for law enforcers to carry<br />

out their duties with greater efficiency.<br />

CITES Resolution Conf 13.4 - Conservation <strong>of</strong> <strong>and</strong> <strong>trade</strong> <strong>in</strong> great apes<br />

<strong>In</strong> October 2004, the 13th Conference <strong>of</strong> the Parties to CITES adopted Resolution Conf. 13.4 (see Annex 2) regard<strong>in</strong>g<br />

the Conservation <strong>of</strong> <strong>and</strong> Trade <strong>in</strong> Great Apes (<strong>in</strong>clud<strong>in</strong>g <strong>orang</strong>-<strong>utans</strong>). Res Conf. 13.4 calls for all CITES Parties to be<br />

concerned that illegal <strong>trade</strong> at <strong>in</strong>ternational <strong>and</strong> national levels has been stimulated by open<strong>in</strong>g up <strong>of</strong> forest habitats,<br />

<strong>in</strong>creas<strong>in</strong>g dem<strong>and</strong> for ape meat, especially from urban populations both <strong>in</strong> range <strong>and</strong> non-range States <strong>and</strong> cont<strong>in</strong>u<strong>in</strong>g<br />

global dem<strong>and</strong> for live specimens, particularly juveniles. <strong>In</strong> addition, it called for all parties to recognize the need for<br />

technical guidance to assist all Parties <strong>in</strong> prevent<strong>in</strong>g illegal <strong>trade</strong> <strong>in</strong> live specimens, <strong>and</strong> parts <strong>and</strong> derivatives <strong>of</strong> great<br />

apes.<br />

It is therefore assumed, that as a range State concerned with the conservation <strong>of</strong> <strong>orang</strong>-<strong>utans</strong>, the <strong>In</strong>donesian Government<br />

will support the implementation <strong>of</strong> Resolution Conf. 13.4, <strong>in</strong>ter alia:<br />

a) adopt <strong>and</strong> implement comprehensive legislation to protect great apes, which <strong>in</strong>cludes:<br />

i) a prohibition <strong>of</strong> all <strong>in</strong>ternational <strong>trade</strong> for primarily commercial purposes, <strong>in</strong>clud<strong>in</strong>g sale, display,<br />

purchase, <strong>of</strong>fer to purchase <strong>and</strong> acquisition for commercial purposes <strong>of</strong> wild-caught specimens <strong>of</strong> great<br />

apes; <strong>and</strong><br />

ii)<br />

deterrent penalties aimed at elim<strong>in</strong>at<strong>in</strong>g illegal <strong>trade</strong> <strong>in</strong> great apes <strong>and</strong> parts <strong>and</strong> derivatives there<strong>of</strong>;<br />

(NB: <strong>In</strong> <strong>In</strong>donesia, a penalty <strong>of</strong> IDR100 000 000 already exist if a person is found guilty <strong>of</strong> trad<strong>in</strong>g an<br />

<strong>orang</strong>-utan, however, as stated <strong>in</strong> the Law Enforcement recommendation above, this law lacks<br />

consistent enforcement <strong>and</strong> only a small proportion <strong>of</strong> <strong>of</strong>fenders are penalized.)<br />

b) strengthen enforcement controls, <strong>in</strong>clud<strong>in</strong>g anti-poach<strong>in</strong>g measures <strong>in</strong> great ape habitats <strong>and</strong> anti-smuggl<strong>in</strong>g<br />

measures at <strong>in</strong>ternational borders (an example <strong>of</strong> <strong>in</strong>ternational border is the West Kalimantan - Sarawak<br />

border);<br />

c) limit the <strong>in</strong>ternational use <strong>of</strong> great apes to nationally approved zoological <strong>in</strong>stitutions, educational centres,<br />

rescue centres <strong>and</strong> captive-breed<strong>in</strong>g centres <strong>in</strong> accordance with CITES; <strong>and</strong><br />

d) promote the protection <strong>of</strong> great ape habitats, <strong>in</strong>clud<strong>in</strong>g cross-border cooperation between neighbour<strong>in</strong>g range<br />

States for the management <strong>of</strong> contiguous habitat, <strong>and</strong> to take appropriate action to restore such habitats where<br />

they have become fragmented or dim<strong>in</strong>ished <strong>in</strong> quality.<br />
