2.12 Every Municipal Corporation and Special Improvement District which is supplied by the<br />

<strong>Authority</strong> shall enact, enforce and maintain a cross-connection control program and<br />

warrant to the <strong>Authority</strong> that such program complies with the requirements of the <strong>County</strong><br />

of <strong>Erie</strong>, the State Health Department and the requirements of the Environmental<br />

Protection Agency. A copy of the cross-connection control program and a list of installed<br />

backflow prevention devices shall be provided to the <strong>Authority</strong>.<br />

SERVICE OF WATER TO PUBLIC CORPORATIONS AND<br />

SPECIAL IMPROVEMENT DISTRICTS AS A<br />

SUPPLEMENTAL WATER SUPPLY<br />

2.13 The <strong>Authority</strong> will furnish a supply of water to Municipal Corporations and Special<br />

Improvement Districts which own or are connected to an independent source of water<br />

supply. The water supply furnished by the <strong>Authority</strong> may be used to supplement the<br />

applicants independent sources.<br />

2.14 The applicant for a supplemental source of water from the <strong>Authority</strong> must satisfy all<br />

requirements listed in paragraphs 2.06 to 2.12 inclusive, plus those listed in paragraphs<br />

2.15 and 2.16.<br />

2.15 The applicant's independent water supply system which is connected to the <strong>Authority</strong><br />

system must satisfy all requirements of the <strong>County</strong> of <strong>Erie</strong>, State Health Department and<br />

the Environmental Protection Agency.<br />

2.16 The Contract between the applicant and the <strong>Authority</strong> shall contain a minimum monthly<br />

payment. The minimum monthly payment shall be payment at Service Classification No.<br />

1 for the amount of water usage computed by assuming that the minimum water used<br />

each month is at least 50 percent of the maximum amount of water used during any one<br />

of the 24 months next preceding the month for which the minimum monthly payment is<br />

being computed.<br />

OF FACILITIES OF SPECIAL IMPROVEMENT DISTRICTS<br />

2.17 When determined by the <strong>Authority</strong> to be economically feasible, the <strong>Authority</strong> will,<br />

subject to the provisions of Sections 197A and 198 of the Town Law, enter into a contract<br />

with the governing board of Special Improvement Districts to lease and operate the water<br />

distribution system and other facilities of the District, upon such terms and conditions and<br />

subject to such rates and charges as may be mutually agreed upon, not inconsistent with<br />
