B) The farmer, or, the customer of the Authority engaged in farming operations, must have on file, at the office of the tax assessor for the municipality or district, a current agricultural exemption provided for in Article 25AA of the New York State Agriculture and Markets Law. C) The customer seeking a refund, must make application to the Authority, between January 1 and March 1 of each year, for a refund of the previous year's summer use surcharge. In cases where the meter serves a dwelling, as well as farm fields, only that portion of the summer use surcharge which is in excess of forty ($40.00) dollars per year can be refunded. The refund will be in the form of a credit placed on the water bill of the applicant, in the year in which application is made. The application must be made on forms available at the Authority's Business Office. 4. In cases where the winter bill, as provided for in paragraphs 1 and 2 above, is less than the minimum charge based on the applicable meter size, the winter bill shall be considered to be the minimum charge. ADDITIONAL SURCHARGE(S) Effective with water billing after December 31, 2002 and pursuant to the provisions contained in agreement(s) between the Erie County Water Authority and Cities, Towns, Villages and/or Water Districts, the Erie County Water Authority may include in the water billing for the customers of such Cities, Towns, Villages and/or Water Districts, a surcharge, the amount of which surcharge shall be determined by the City, Town, Village and/or Water District. This surcharge shall be separate from the Summer Use Surcharge and when collected by the Erie County Water Authority, will be periodically remitted to the City, Town, Village, and/or Water District. MINIMUM CHARGE: The quarterly minimum charge is payable in advance or arrears at the discretion of the Authority. The monthly minimum charge is payable in arrears.
