Delay Not Caused By A Party<br />

Delay not caused by a party is often referred to as excusable (as opposed to inexcusable) delay,<br />

or non-compensable (as opposed to compensable) delay:<br />

• An excusable delay is one that will serve to justify an extension of the contract<br />

performance time – it excuses the party from meeting a contractual deadline;<br />

• Inexcusable delay is one for which the party assumes the risk of the cost and<br />

consequences, including the resulting impact on others, such as delay due to a<br />

contractor’s own mismanagement;<br />

• Generally, whether a delay is excusable or inexcusable is a matter of contract.<br />
