9) The Developer shall pay to the <strong>City</strong> the amount <strong>of</strong> Two Thousand Thirty Five Dollars and<br />

Eighty Nine Cents (6,035.89) for the Waterford Valley Relief Trunk Sewer Assessment,<br />

which amount shall be paid prior to the execution <strong>of</strong> this Agreement.<br />

10) The Developer covenants and agrees to carry out all work on the Development in accordance<br />

with the requirements <strong>of</strong> the Development Regulations.<br />

11) The Developer shall carry out all work on the Development in accordance with the applicable<br />

conditions <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>St</strong>. <strong>John's</strong> Engineering Department Design and Construction<br />

Procedure Manual.<br />

12) The Developer shall carry out all work on the Development in accordance with the <strong>City</strong> <strong>of</strong><br />

<strong>St</strong>. <strong>John's</strong> Specification Book.<br />

13) The Developer shall carry out all work on the Development in accordance with all<br />

requirements <strong>of</strong> the <strong>City</strong>'s Department <strong>of</strong> Building and Property Management and all other<br />

applicable requirements <strong>of</strong> the <strong>City</strong>.<br />

14) The Developer shall acquire clear title to all lands which form the Development.<br />

15) The Developer shall not carry out any work on the Development until this Agreement has<br />

been properly executed.<br />

16) The Developer shall ensure that all work performed by or on behalf <strong>of</strong> the Developer on the<br />

Development is covered by commercial general liability insurance for a minimum limit <strong>of</strong><br />

Two Million Dollars ($2,000,000.00). The <strong>City</strong> <strong>of</strong> <strong>St</strong>. John’s shall be named as additional<br />

insured on all policies. Pro<strong>of</strong> <strong>of</strong> such insurance shall be provided by the Developer to the<br />

<strong>City</strong> prior to the execution <strong>of</strong> this Agreement.<br />
