WATER INDUSTRY ACT 1991: SECTION 19(1)(b)<br />

THE SECRETARY OF STATE FOR ENVIRONMENT, FOOD, AND RURAL<br />

AFFAIRS:<br />

1) 1) is satisfied that Severn Trent <strong>Water</strong> Ltd "the Company" is supplying water<br />

from the <strong>Shiffords</strong> <strong>Bridge</strong> <strong>Water</strong> Treatment Works which may be at risk of<br />

exceeding the standards for Nitrate. This means that the Company is likely to<br />

contravene its duty in respect of supplying water which meets the Regulations<br />

under Section 68(1)(a) of the <strong>Water</strong> Industry Act 1991 and meets the<br />

requirement set in regulation 4(2)(c) of the <strong>Water</strong> Supply (<strong>Water</strong> Quality)<br />

Regulations 2000.<br />

2) 2) has notified Severn Trent <strong>Water</strong> Ltd on 28 August 2009 that he is considering<br />

making in relation to the Company an enforcement order under Section 18 of<br />

the <strong>Water</strong> Industry Act 1991.<br />

3) 3) notes that Severn Trent <strong>Water</strong> Ltd has on 09 March 2010 given an<br />

undertaking under Section 19(1)(b)of the <strong>Water</strong> Industry Act 1991 to take the<br />

following steps by the dates shown:<br />

Ensure that the nitrate parameter has been assessed as a hazard as part of<br />

the regulation 27 Risk Assessment for the supply system supplied by <strong>Shiffords</strong><br />

<strong>Bridge</strong> <strong>WTW</strong> according to a <strong>Drinking</strong> <strong>Water</strong> Safety Plan approach.<br />

By 1 October 2008<br />

Submit a specific action plan identifying short, medium and long term mitigating<br />

steps to address the risk of the nitrate parameter associated with the<br />

connected supply system supplied by <strong>Shiffords</strong> <strong>Bridge</strong> <strong>WTW</strong>. To include as a<br />

minimum the requirements within (c), (d) and (e) and review regularly.<br />

By 1 April 2010 and after changes made as a result of review, for the<br />

duration of the Undertaking.<br />

Short term measures:<br />

Develop and implement an appropriate risk based monitoring strategy to<br />

supplement specified regulatory monitoring and to include raw water<br />

monitoring.<br />

By 31 December 2010 and after changes made as a result of review, for<br />

the duration of the Undertaking.<br />

If the concentration in any water sample exceeds the maximum deviation of<br />

quality value set out in section 3, take all appropriate measures to protect public<br />

health in consultation with the Local Authority and Health Protection Unit/Team.<br />

For the duration of the undertaking.<br />

Report regulatory exceedances of the standard for the nitrate parameter to<br />

DWI as part of current monthly exception reporting process.<br />

For the duration of the undertaking.<br />

Medium term measures:

Submit a summary of the appropriateness of the remedial measures proposed.<br />

Confirm the forward programme for steps (e) and (f) including the duration of<br />

the work.<br />

By 30 September 2010<br />

Complete planning, design and procurement arrangements to provide a high<br />

recovery ion exchange nitrate treatment process to secure compliance with the<br />

nitrate standard in water supply zones supplied by <strong>Shiffords</strong> <strong>Bridge</strong> <strong>WTW</strong>.<br />

By 30 June 2011<br />

Complete construction, installation and commissioning of the high recovery ion<br />

exchange nitrate treatment process.<br />

By 31 December 2012<br />

Take all steps necessary to optimise existing treatment at <strong>Shiffords</strong> <strong>Bridge</strong><br />

<strong>WTW</strong> as far as practicable for nitrate parameter reduction for the duration of<br />

the Undertaking.<br />

For the duration of the Undertaking<br />

Long term measures:<br />

Continually appraise the risk of the nitrate parameter as a hazard as part of the<br />

regulation 27 Risk Assessment for the supply system associated with <strong>Shiffords</strong><br />

<strong>Bridge</strong> <strong>WTW</strong> according to a <strong>Drinking</strong> <strong>Water</strong> Safety Plan approach, and ensure<br />

that Regulation 28 documents are reviewed and updates provided as<br />

necessary.<br />

Reporting:<br />

At regular intervals provide DWI with reports on progress made with carrying<br />

out the steps set out in the Action Plan.<br />

Reports to include at least the following details:<br />

i) All data from the monitoring of raw and final water and in the distribution<br />

system associated with <strong>Shiffords</strong> <strong>Bridge</strong> <strong>WTW</strong> including any trend<br />

analysis as appropriate;<br />

ii) Details of the remedial steps that comprise the programme of work<br />

including commencement and completion dates for investigations, design,<br />

tendering, construction and commissioning;<br />

iii)<br />

iv)<br />

Current state of progress with the steps referred to in (i) above;<br />

A statement of implications of any slippage of the programme and details<br />

of activities planned to bring programme back on target;<br />

v) Whether the Company has any other reason to believe it may not be able<br />

to meet any of the key dates set out in this Schedule of Work.<br />

At 6 monthly intervals for the duration of the undertaking. Reporting<br />

periods are January to June and July to December.<br />

Continue to monitor at the frequency set out in the monitoring strategy<br />

developed for step 4(c) for nitrate for a period of 12 months following


commissioning of any work associated with the Action Plan to demonstrate the<br />

effectiveness of the remedial measures taken.<br />

By 31 December 2013.<br />

(k)<br />

Provide a final report to DWI on the efficacy of the remedial measures taken as<br />

part of the Action Plan. Include as evidence of closure for this scheme<br />

appropriate documentation to confirm that the actions set out in this Schedule<br />

of Work have been taken.<br />

By 31 January 2014.<br />

4) is satisfied that Severn Trent <strong>Water</strong> Ltd has given and is complying with an<br />

undertaking to take all such steps as appear to the Secretary of State for the<br />

time being to be appropriate to secure or facilitate compliance with the<br />

requirement of regulation 4(2)(c) of the <strong>Water</strong> Supply (<strong>Water</strong> Quality)<br />

Regulations 2000.<br />
