PRIVACY<br />
Application <strong>of</strong> <strong>the</strong><br />
privacy pr<strong>in</strong>ciples<br />
When confronted with a privacy issue with<strong>in</strong> a school, <strong>the</strong> fi rst step <strong>in</strong><br />
address<strong>in</strong>g <strong>the</strong> problem is to identify whe<strong>the</strong>r or not it is a question about<br />
<strong>the</strong> collection, storage, use or disclosure <strong>of</strong> personal <strong>in</strong>formation.<br />
This part <strong>of</strong> <strong>the</strong> book is an attempt to identify some <strong>of</strong> <strong>the</strong> common<br />
privacy issues for schools and <strong>the</strong>n apply <strong>the</strong> pr<strong>in</strong>ciples to <strong>the</strong> situation<br />
to assist schools <strong>in</strong> mak<strong>in</strong>g <strong>the</strong>ir own decisions. It is not meant to be a<br />
statement <strong>of</strong> <strong>the</strong> law or a defi nitive legal op<strong>in</strong>ion and if you have any<br />
doubt, you should contact <strong>the</strong> school’s legal advisers or <strong>the</strong> Offi ce <strong>of</strong><br />
<strong>the</strong> <strong>Privacy</strong> <strong>Commissioner</strong>.<br />
The Board <strong>of</strong> Trustees is empowered under <strong>the</strong> Education Act to<br />
manage its school while meet<strong>in</strong>g its statutory obligations. In terms <strong>of</strong><br />
<strong>the</strong> <strong>Privacy</strong> Act, <strong>the</strong> Board will have to consider <strong>the</strong> follow<strong>in</strong>g issues.<br />
Appo<strong>in</strong>tment <strong>of</strong> a privacy <strong>of</strong>ficer<br />
Each school is required to appo<strong>in</strong>t a privacy <strong>of</strong>fi cer. Once appo<strong>in</strong>ted,<br />
<strong>the</strong> privacy <strong>of</strong>fi cer should:<br />
• Attend a tra<strong>in</strong><strong>in</strong>g course and make contact with <strong>the</strong> Offi ce <strong>of</strong> <strong>the</strong><br />
<strong>Privacy</strong> <strong>Commissioner</strong> (see www.privacy.org.nz for contact details<br />
and <strong>in</strong>formation on tra<strong>in</strong><strong>in</strong>g/sem<strong>in</strong>ars).<br />
• Undertake an audit <strong>of</strong> <strong>the</strong> way <strong>the</strong> school is handl<strong>in</strong>g personal<br />
<strong>in</strong>formation <strong>in</strong>clud<strong>in</strong>g collection, storage, use and disclosure.<br />
• Undertake a review <strong>of</strong> forms used by <strong>the</strong> school to ensure compliance<br />
with <strong>the</strong> collection pr<strong>in</strong>ciples (1-4).<br />
• Undertake a review <strong>of</strong> <strong>the</strong> way <strong>in</strong>formation is collected <strong>in</strong> <strong>the</strong> school<br />
to ensure fairness <strong>in</strong>clud<strong>in</strong>g:<br />
• opportunities for parents to discuss <strong>the</strong> forms or obta<strong>in</strong><br />
assistance;<br />
• opportunities for parents/students to discuss matters <strong>in</strong> private,<br />
away from <strong>the</strong> front reception desk; and<br />
• videotap<strong>in</strong>g, audio tap<strong>in</strong>g or photograph<strong>in</strong>g any person<br />
(<strong>in</strong>clud<strong>in</strong>g students) on school grounds with consent or on<br />
notice (eg security cameras).<br />
• Undertake an audit <strong>of</strong> <strong>the</strong> way <strong>in</strong>formation is stored <strong>in</strong> <strong>the</strong> school<br />
and shared amongst staff. There should be reasonable safeguards<br />
to avoid unauthorised access, use, modifi cation or disclosure.<br />
Access to <strong>in</strong>formation should be limited to staff who need <strong>the</strong><br />
<strong>in</strong>formation for <strong>the</strong>ir job.<br />
• Develop policies or checklists to deal with <strong>in</strong>formation requests from<br />
<strong>in</strong>dividuals, guardians/parents or o<strong>the</strong>r parties.<br />
• Develop a process for updat<strong>in</strong>g records to ensure <strong>the</strong>y are accurate<br />
(eg a half-yearly check with parents to ensure contact details are<br />
correct).<br />
• Undertake a review <strong>of</strong> <strong>in</strong>formation held to determ<strong>in</strong>e if it should still<br />
be reta<strong>in</strong>ed.<br />
Board meet<strong>in</strong>gs<br />
Board meet<strong>in</strong>gs are usually open meet<strong>in</strong>gs at which observers can<br />
attend. There are also m<strong>in</strong>utes from <strong>the</strong> meet<strong>in</strong>gs, which are publicly<br />
available documents.<br />
If <strong>the</strong>re is to be discussion about an <strong>in</strong>dividual at a board meet<strong>in</strong>g, <strong>the</strong>n<br />
it is acceptable practice for a resolution to be passed that observers/<br />
non-board members be excluded from all or part <strong>of</strong> <strong>the</strong> meet<strong>in</strong>g <strong>in</strong><br />
order to protect <strong>the</strong> privacy <strong>of</strong> that <strong>in</strong>dividual.<br />
The relevant part <strong>of</strong> <strong>the</strong> m<strong>in</strong>utes needs to be separated from <strong>the</strong> public<br />
copy <strong>of</strong> <strong>the</strong> m<strong>in</strong>utes and identifi ed as a confi dential document.<br />
Forms<br />
A sample enrolment form is set out <strong>in</strong> Appendix B, page 47.<br />
As a matter <strong>of</strong> practicality, <strong>in</strong>formation about students and <strong>in</strong>formation<br />
about parents/guardians will ord<strong>in</strong>arily be collected from <strong>the</strong> parents/<br />
guardians. On occasion, <strong>in</strong>formation will be collected from <strong>the</strong> student<br />
directly.<br />
In consider<strong>in</strong>g questions on an enrolment form, schools should look at<br />
each question to work out <strong>the</strong> <strong>in</strong>formation be<strong>in</strong>g sought and whe<strong>the</strong>r<br />
or not it is necessary for <strong>the</strong> school’s purposes (see pr<strong>in</strong>ciple 1).<br />
