3. Shop Drawings. It is agreed that drawings will be completed by the
following dates:
(a) Completion and Submission of Shop Drawings. Shop Drawings will
be completed and submitted to AVEC for approval:
_____________________ calendar days after receipt of order.
(b) Completion of Equipment. Final Equipment completion date
following approval of Shop Drawings:
_____________________ calendar days after approval of shop drawings.
4. Completion of Work. It is agreed that the time limit for completion of the
Contract, based upon Contractor’s proposal, shall be the day of , 201 . The
work shall be deemed complete upon delivery of the fully completed Equipment FOB destination as
called for under this Contract.
5. Liquidated Damages for Contractor’s Failure to Meet Deadlines.
(a) Shop Drawings. In the event that Contractor shall fail to submit a
completed set of any required shop drawings by the deadline prescribed in Paragraph 3 of this
Article or any extended deadline agreed upon by the Parties, the Parties agree that liquidated
damages shall be paid at the rate of $100 per day per item not completed. The Parties agree that
such amounts have been estimated as a realistic estimate of the damages which may be suffered as a
result of unexcused delay. Sundays and legal holidays shall be excluded in determining the number
of days in default.
(b) Contract Completion. In the event that Contractor shall fail to
complete the work described in Article I, Section 1, by the deadline provided in Section 4, above,
or any extended deadline agreed upon by the Parties, the Parties agree that liquidated damages shall
be paid at the rate of $500 per day. The Parties agree that such amounts have been estimated as a
realistic estimate of the damages which may be suffered as a result of unexcused delay. Sundays
and legal holidays shall be excluded in determining the number of days in default.
6. Unavoidable Delays and Extensions of Time. If the Contractor is delayed in
the progress of the work by any act or neglect of AVEC, or by any separate contractor employed by
AVEC; or by strikes, lockouts, fire, unusual weather conditions or unavoidable casualties, the
Contractor shall, within 48 hours of the start of the occurrence, give notice to AVEC of the cause of
the potential delay and estimate the possible time extension involved. Within seven (7) days after
the cause of delay has been remedied, the Contractor shall give notice to AVEC of any actual time
extension requested as a result of the aforementioned occurrence.
