3. Shop Drawings. It is agreed that drawings will be completed by the<br />

following dates:<br />

(a) Completion and Submission of Shop Drawings. Shop Drawings will<br />

be completed and submitted to <strong>AVEC</strong> for approval:<br />

_____________________ calendar days after receipt of order.<br />

(b) Completion of Equipment. Final Equipment completion date<br />

following approval of Shop Drawings:<br />

_____________________ calendar days after approval of shop drawings.<br />

4. Completion of Work. It is agreed that the time limit for completion of the<br />

Contract, based upon Contractor’s proposal, shall be the day of , 201 . The<br />

work shall be deemed complete upon delivery of the fully completed Equipment FOB destination as<br />

called for under this Contract.<br />

5. Liquidated Damages for Contractor’s Failure to Meet Deadlines.<br />

(a) Shop Drawings. In the event that Contractor shall fail to submit a<br />

completed set of any required shop drawings by the deadline prescribed in Paragraph 3 of this<br />

Article or any extended deadline agreed upon by the Parties, the Parties agree that liquidated<br />

damages shall be paid at the rate of $100 per day per item not completed. The Parties agree that<br />

such amounts have been estimated as a realistic estimate of the damages which may be suffered as a<br />

result of unexcused delay. Sundays and legal holidays shall be excluded in determining the number<br />

of days in default.<br />

(b) Contract Completion. In the event that Contractor shall fail to<br />

complete the work described in Article I, Section 1, by the deadline provided in Section 4, above,<br />

or any extended deadline agreed upon by the Parties, the Parties agree that liquidated damages shall<br />

be paid at the rate of $500 per day. The Parties agree that such amounts have been estimated as a<br />

realistic estimate of the damages which may be suffered as a result of unexcused delay. Sundays<br />

and legal holidays shall be excluded in determining the number of days in default.<br />

6. Unavoidable Delays and Extensions of Time. If the Contractor is delayed in<br />

the progress of the work by any act or neglect of <strong>AVEC</strong>, or by any separate contractor employed by<br />

<strong>AVEC</strong>; or by strikes, lockouts, fire, unusual weather conditions or unavoidable casualties, the<br />

Contractor shall, within 48 hours of the start of the occurrence, give notice to <strong>AVEC</strong> of the cause of<br />

the potential delay and estimate the possible time extension involved. Within seven (7) days after<br />

the cause of delay has been remedied, the Contractor shall give notice to <strong>AVEC</strong> of any actual time<br />

extension requested as a result of the aforementioned occurrence.<br />
