6. PREPARATION OF PROPOSALS
All blank spaces in the proposal form must be filled in, preferably in BLACK ink, in both words and figures
where required. No changes shall be made in the phraseology of the forms. Written amounts shall
govern in case of discrepancy between the amounts stated in writing and the amounts stated in figures.
In case of discrepancy between unit prices and totals, unit prices will prevail. Proposals containing
omissions, erasures, alterations or additions of any kind, or prices uncalled for, or in which any of the
prices are obviously unbalanced, or which in any manner shall fail to conform to the conditions of the
published Request for Firm Proposals may be rejected by AVEC.
The bidder shall sign his proposal in the blank space provided. If the bidder is a corporation, the legal
name of the corporation shall be set forth above together with the signature of the officer or officers
authorized to sign contracts on behalf of the corporation. If the bidder is a partnership, the true name of
the firm shall be set forth above, together with the signature of the partner or partners authorized to
sign contracts on behalf of the partnership. If the signature is by an agent other than an officer of a
corporation or a member of a partnership, a notarized power-of-attorney must be on file with AVEC
prior to opening of proposals or submitted with the proposal. Otherwise the proposal may be regarded
as not properly authorized.
AVEC shall not be liable for any costs incurred by the bidder in proposal preparation.
7. BASIS OF AWARD
AVEC may consider as factors in deciding the award of the Contract, the price quoted in the Proposal,
the delivery schedule, best overall value, and the specific features included in the Proposal as the best
interest of AVEC may require.
AVEC reserves the right to reject any and all proposals, to waive deviations from the specifications and
to waive any informality in proposals received whenever such rejection or waiver is in the best interest
of AVEC, and unless otherwise specified by the bidder, to accept any items in the proposal. A proposal
may be rejected if AVEC determines such rejection to be in its best interests, and in particular, when:
a. The bidder has failed to perform satisfactorily on a previous contract with AVEC or in AVEC’s
opinion, is not in a position to perform the contract.
b. The bidder fails to furnish required bonds, plans, specifications, samples, etc., if specifically
called for in the Request for Firm Proposals.
c. The bidder has failed to use the proposal form attached hereto.
d. The bidder makes a material change in the specifications or terms or conditions of the Request
for Firm Proposals.
8. FIRM PROPOSALS
For the purpose of award, offers made in accordance with this Request for Firm Proposals shall be good
and firm for a period of thirty (30) days from the date of proposal opening unless the bidder specifically
limits their offer to a shorter period by written notification on the proposal documents. However,
proposals so modified may be declared non-responsive.
