6. PREPARATION OF PROPOSALS<br />
All blank spaces in the proposal form must be filled in, preferably in BLACK ink, in both words and figures<br />
where required. <strong>No</strong> changes shall be made in the phraseology of the forms. Written amounts shall<br />
govern in case of discrepancy between the amounts stated in writing and the amounts stated in figures.<br />
In case of discrepancy between unit prices and totals, unit prices will prevail. Proposals containing<br />
omissions, erasures, alterations or additions of any kind, or prices uncalled for, or in which any of the<br />
prices are obviously unbalanced, or which in any manner shall fail to conform to the conditions of the<br />
published Request for Firm Proposals may be rejected by <strong>AVEC</strong>.<br />
The bidder shall sign his proposal in the blank space provided. If the bidder is a corporation, the legal<br />
name of the corporation shall be set forth above together with the signature of the officer or officers<br />
authorized to sign contracts on behalf of the corporation. If the bidder is a partnership, the true name of<br />
the firm shall be set forth above, together with the signature of the partner or partners authorized to<br />
sign contracts on behalf of the partnership. If the signature is by an agent other than an officer of a<br />
corporation or a member of a partnership, a notarized power-of-attorney must be on file with <strong>AVEC</strong><br />
prior to opening of proposals or submitted with the proposal. Otherwise the proposal may be regarded<br />
as not properly authorized.<br />
<strong>AVEC</strong> shall not be liable for any costs incurred by the bidder in proposal preparation.<br />
7. BASIS OF AWARD<br />
<strong>AVEC</strong> may consider as factors in deciding the award of the Contract, the price quoted in the Proposal,<br />
the delivery schedule, best overall value, and the specific features included in the Proposal as the best<br />
interest of <strong>AVEC</strong> may require.<br />
<strong>AVEC</strong> reserves the right to reject any and all proposals, to waive deviations from the specifications and<br />
to waive any informality in proposals received whenever such rejection or waiver is in the best interest<br />
of <strong>AVEC</strong>, and unless otherwise specified by the bidder, to accept any items in the proposal. A proposal<br />
may be rejected if <strong>AVEC</strong> determines such rejection to be in its best interests, and in particular, when:<br />
a. The bidder has failed to perform satisfactorily on a previous contract with <strong>AVEC</strong> or in <strong>AVEC</strong>’s<br />
opinion, is not in a position to perform the contract.<br />
b. The bidder fails to furnish required bonds, plans, specifications, samples, etc., if specifically<br />
called for in the Request for Firm Proposals.<br />
c. The bidder has failed to use the proposal form attached hereto.<br />
d. The bidder makes a material change in the specifications or terms or conditions of the Request<br />
for Firm Proposals.<br />
8. FIRM PROPOSALS<br />
For the purpose of award, offers made in accordance with this Request for Firm Proposals shall be good<br />
and firm for a period of thirty (30) days from the date of proposal opening unless the bidder specifically<br />
limits their offer to a shorter period by written notification on the proposal documents. However,<br />
proposals so modified may be declared non-responsive.<br />
