Telephone misuse: Vandalism <strong>of</strong> any <strong>University</strong> owned/<br />
<strong>University</strong> controlled telephone or telephone line is prohibited. In<br />
addition, <strong>at</strong>tempting to place a local or long distance call through<br />
any method with intent to avoid payment is prohibited.<br />
Elev<strong>at</strong>or misuse: Vandalizing, damaging, abusing, or interfering<br />
with the oper<strong>at</strong>ion <strong>of</strong> an elev<strong>at</strong>or in any <strong>University</strong> owned/<br />
<strong>University</strong> controlled property is strictly prohibited.<br />
Exit/Entryway: Obstructing any entry or exit in any <strong>University</strong><br />
owned or <strong>University</strong> controlled facility/property is prohibited.<br />
Use <strong>of</strong> personal portable sound amplific<strong>at</strong>ion equipment, including,<br />
but not limited to: radios, stereos, tape players, CD players, ipods,<br />
televisions, etc…th<strong>at</strong> disturbs the privacy <strong>of</strong> other individuals and/<br />
or the instructional program <strong>of</strong> the <strong>University</strong> is prohibited on <strong>University</strong><br />
owned/<strong>University</strong> controlled property, or <strong>at</strong> any <strong>University</strong><br />
sponsored event, including <strong>of</strong>f-campus sponsored events th<strong>at</strong> have<br />
been approved by the Office <strong>of</strong> Student Affairs or another <strong>University</strong><br />
Office.<br />
Lewd, Indecent or Obscene Conduct: Behavior th<strong>at</strong> is<br />
lewd, indecent, or obscene is prohibited. Such behavior includes,<br />
but is not limited to: Priv<strong>at</strong>e behavior/acts in residence hall rooms/<br />
apartments/common areas; campus space which is reserved, rented,<br />
leased, or used by student organiz<strong>at</strong>ions; and/or behavior in public<br />
performances in any <strong>University</strong> owned/<strong>University</strong> controlled facility<br />
or property, or <strong>at</strong> any <strong>University</strong> sponsored event, including <strong>of</strong>f campus<br />
<strong>University</strong> sponsored events approved by the Office <strong>of</strong> Student<br />
Affairs or another <strong>University</strong> Office.<br />
Failure to Meet Financial Oblig<strong>at</strong>ions to the <strong>University</strong>:<br />
Presenting an insufficient check or forging a document in<br />
payment to the <strong>University</strong> or member <strong>of</strong> the <strong>University</strong> community<br />
acting in an <strong>of</strong>ficial capacity is prohibited. In addition, failure to<br />
make s<strong>at</strong>isfactory arrangements for the settling <strong>of</strong> accounts with the<br />
<strong>University</strong> is prohibited.<br />
Furnishing False Inform<strong>at</strong>ion: Providing inform<strong>at</strong>ion<br />
which is false or untrue to the <strong>University</strong> is prohibited. False inform<strong>at</strong>ion<br />
includes, but is not limited to: misrepresent<strong>at</strong>ion <strong>of</strong> test scores,<br />
transcript work, admissions documents, citizenship, criminal record, or<br />
testimony/st<strong>at</strong>ements regarding the viol<strong>at</strong>ion <strong>of</strong> a <strong>University</strong> policy.<br />
Campus elections and referendums: Casting more than<br />
one ballot in any campus election or referendum or trying to circumvent<br />
the prescribed procedures in an election process is prohibited.<br />
Refusal to vac<strong>at</strong>e: Refusing to vac<strong>at</strong>e any <strong>University</strong> owned or<br />
controlled space, loc<strong>at</strong>ed either on or <strong>of</strong>f campus, including, but not<br />
limited to: any building, residential room, <strong>of</strong>fice, storage space, or<br />
organiz<strong>at</strong>ional space when directed to do so by an authorized <strong>of</strong>ficer<br />
<strong>of</strong> the <strong>University</strong> is prohibited.<br />
Stalking: The stalking <strong>of</strong> a student(s), faculty/staff member(s),<br />
or campus visitor(s) is strictly prohibited on <strong>University</strong> owned/<strong>University</strong><br />
controlled property, or <strong>at</strong> any <strong>University</strong> sponsored function,<br />
including <strong>of</strong>f campus <strong>University</strong> sponsored events th<strong>at</strong> have been<br />
approved by the Office <strong>of</strong> Student Affairs <strong>of</strong> another <strong>University</strong> Office.<br />
Stalking includes, but is not limited to: Persistent and unwanted<br />
phone calls, electronic messages, letters, gifts, <strong>at</strong>tention, or physical<br />
touch and/or physical presence. In addition, cyber-stalking is strictly<br />
prohibited.<br />
Responsibility for Guests: The viol<strong>at</strong>ion <strong>of</strong> any Board<br />
<strong>of</strong> Trustee, System, <strong>University</strong>, or Residence Life policy by a guest,<br />
visitor, or family member <strong>of</strong> any student is prohibited. Students are<br />
responsible for informing their guests, student or non-student, <strong>of</strong><br />
<strong>University</strong> policies and will be held responsible for the behavior <strong>of</strong><br />
their guests. A guest is defined as: (1) any person who is present <strong>at</strong><br />
the invit<strong>at</strong>ion <strong>of</strong> a student or (2) any person who is received by a student,<br />
or (3) any invited or uninvited individual who is accompanied<br />
by a student. All guests must be registered with the appropri<strong>at</strong>e<br />
<strong>University</strong> <strong>of</strong>fice and <strong>of</strong>ficial.<br />
Weapons, Firearms, and Explosives: The unauthorized<br />
use, possession, distribution, or transport<strong>at</strong>ion <strong>of</strong> any object with<br />
potential to cause bodily harm to self or others is strictly prohibited<br />
on <strong>University</strong> owned/<strong>University</strong>-controlled property, or <strong>at</strong> any<br />
<strong>University</strong> sponsored function, including <strong>of</strong>f campus <strong>University</strong><br />
sponsored events th<strong>at</strong> have been approved by the Office <strong>of</strong> Student<br />
Affairs or another <strong>University</strong> Office.<br />
Such objects include, but are not limited to: firearms, ammunition,<br />
fireworks, chemical dispensing advices, explosive m<strong>at</strong>erials, devices<br />
capable <strong>of</strong> casting a projectile such as bows and/or slingshots,<br />
swords, brass knuckles, num-chucks, or any type <strong>of</strong> gun, including,<br />
but not limited to: handguns, BB guns, stun guns, air guns, paint guns,<br />
pellet guns, or look-a-like guns. The Office <strong>of</strong> Public Safety will store<br />
firearms, bows, and other weapons specifically designed for hunting<br />
purposes. Exception: This policy shall not apply to duly authorized<br />
law enforcement <strong>of</strong>ficials in the lawful discharge <strong>of</strong> their duties.<br />
A student found carrying a weapon on his/her person, waving<br />
a gun, thre<strong>at</strong>ening to use or using a weapon on another student, faculty<br />
member, staff member, or campus visitor on <strong>University</strong> owned/<br />
<strong>University</strong> controlled property or <strong>at</strong> any <strong>University</strong> sponsored<br />
event, including <strong>of</strong>f campus <strong>University</strong> sponsored events th<strong>at</strong> have<br />
been approved by the Office <strong>of</strong> Student Affairs or another <strong>University</strong><br />
Office can be removed, suspended and/or expelled from the<br />
<strong>University</strong>. Viol<strong>at</strong>ors <strong>of</strong> this code forfeit their option and/or right to<br />
a <strong>University</strong> Judicial Board Hearing and will receive an administr<strong>at</strong>ive<br />
hearing adjudic<strong>at</strong>ed by the Dean <strong>of</strong> Students. Viol<strong>at</strong>ors <strong>of</strong> this code<br />
can be separ<strong>at</strong>ed from the <strong>University</strong> in a variety <strong>of</strong> ways until an<br />
administr<strong>at</strong>ive hearing can be executed. Temporary separ<strong>at</strong>ion can<br />
be sanctioned by the Vice Chancellor for Student Affairs, Dean <strong>of</strong><br />
Students or the Office <strong>of</strong> Public Safety.<br />
Request by the student for temporary and/<strong>of</strong> future m<strong>at</strong>ricul<strong>at</strong>ion<br />
(if applicable) will be determined by the Vice Chancellor for<br />
Student Affairs in consult with the <strong>University</strong>’s Behavior Intervention<br />
Team. The <strong>University</strong> reserves the right to deny current or future<br />
m<strong>at</strong>ricul<strong>at</strong>ion.<br />
Should a student be incarcer<strong>at</strong>ed due to legal charges filed, an<br />
administr<strong>at</strong>ive hearing will be performed with the student in abstention.<br />
A determin<strong>at</strong>ion will be made based upon the preponderance<br />
<strong>of</strong> evidence.<br />
Verbal Abuse: Verbal abuse on any <strong>University</strong> owned/<br />
<strong>University</strong> controlled property, or <strong>at</strong> any <strong>University</strong> sponsored<br />
function, including <strong>of</strong>f campus <strong>University</strong> sponsored events th<strong>at</strong> have<br />
been approved by the Office <strong>of</strong> Student Affairs or other <strong>University</strong><br />
department/<strong>of</strong>ficial is strictly prohibited. Verbal abuse includes, but
