17. DISPUTE AND SETTLEMENT:
In case of any dispute with respect to the terms of Agreement, the matter
may be represented to DG Tourism by the selected Consultant after giving a
notice of 30 days. The matter shall be examined and put up to Principal
Secretary, Tourism, Govt. of U.P. for decision. In case the dispute is not
resolved at the level of Principal Secretary, Tourism, Govt. of U.P. the
matter shall be referred to Infrastructure and Industrial Development
Commissioner (I.I.D.C).
If after 30 days from the commencement of such direct negotiations at the
level of I.I.D.C the dispute is not resolved it shall be settled by arbitrator
under the Arbitration and Conciliation Act, 1996 and his decision would be
final, binding on both the parties.
The Arbitration and Conciliation Act 1996 and the rules made there under
and any statutory modification or re-enactments thereof, shall apply to the
arbitration proceedings.
The venue of the arbitration shall be Lucknow, U.P.
Pending the submission of and/or decision on a dispute, difference or claim
or until the arbitral award is published; the Consultant shall continue to
perform all its obligations under this agreement without prejudice of final
adjustment in accordance with such award.
18. LEGAL JURISDICTION:
Any legal dispute arising out of the contract shall be settled at the Court of
Law located at Lucknow.
