GENERAL IN<strong>FOR</strong>MATION<br />

The purpose of these Rules and Regulations (these “Rules”) is to establish the basic<br />

standards of conduct required of all residential property owners in Lake Las Vegas Resort<br />

in order that every owner may enjoy to the fullest his individual rights, while respecting the<br />

rights of others to the quiet and peaceful occupancy of their property and the use of<br />

common areas and facilities. These Rules do not govern conduct in non-residential areas,<br />

nor do they apply to construction activities.<br />

These Rules have been developed with consideration given to providing each property<br />

owner with the greatest enjoyment of the Resort without infringing on other owners and<br />

their rights to quiet enjoyment of their property and community.<br />

Although these Rules are consistent with the Master Declaration of Covenants, Conditions<br />

and Restrictions for Lake Las Vegas Resort (the “Master Declaration”), they do not<br />

address all matters covered by the Master Declaration. Please be sure to read the Master<br />

Declaration carefully. If there is any conflict or inconsistency between these Rules and<br />

Regulations and the Master Declaration, the terms and provisions of the Master<br />

Declaration shall control.<br />

ADMINISTRATION<br />

1. Lake Las Vegas Master Association (the “Master Asociation”) and the various<br />

sub-associations are non-stock, non-profit corporations established to maintain and<br />

administer the common areas and recreational facilities in the Resort and enforce<br />

the Master Declaration and any project declarations recorded against property in<br />

the resort.<br />

Every owner of a lot or unit in Lake Las Vegas is a member of the Master<br />

Association. Owners may also be members of one or more sub-associations. The<br />

Bylaws of the Master Association provide that the affairs of the Master Association<br />

be managed by a duly elected Board of Directors and further articulate the powers<br />

and duties of the Board.<br />

2. These Rules may be amended by the Master Board. No rule or regulation or<br />

amendment shall be enforced against a residential owner until 30 days after written<br />

notice of the rule, regulation or amendment has been given to such owner.<br />

3. A copy of these Rules will be maintained in the office of the Master Association for<br />

inspection during regular office hours.<br />

4. Each residential owner is liable for the conduct of their families, guests, agents and<br />

tenants while within the Resort or using the common areas or facilities.<br />

5. These Rules are supplemental to the Master Declaration, the Articles of<br />

Incorporation and Bylaws of the Master Association and the sub-associations (the<br />

“Governing Documents”).<br />

6. A violation of any provision of the Governing Documents will be considered a<br />

violation of these Rules. However, any failure by any Board of Directors, its officers<br />

or employees, to enforce the Governing Documents or these Rules does not<br />

constitute a waiver of the right to do so in the future, or deprive any Association,<br />

sub-association, or other person or entity of any remedy otherwise available in the<br />

Governing Documents.<br />

GENERAL <strong>RULES</strong> <strong>AND</strong> <strong>REGULATIONS</strong><br />

1. The lake is subject to Lake Rules and Regulations, which are different from and in<br />

addition to these Rules.<br />

2. Residential owners are prohibited from destroying, removing, or altering the<br />

landscaping in the common areas, regardless of the condition of the plantings.<br />

3. No noise or other nuisance is permitted to exist upon or emanate from any<br />

residential lot, residence or common area so as to be offensive or detrimental to any<br />

other lot, residence or common area or to its occupants. For example, no exterior<br />

speakers, horns, whistles, bells or other sound devices (other than security devices<br />

used exclusively for security purposes), live bands, noisy or smoky vehicles, large<br />

noisy power equipment tools, off-road vehicles or other items which may disturb<br />

others, is permitted. Security alarms must be prevented from frequent false alarms.<br />

4. Littering is prohibited in the Resort. No rubbish or debris of any kind may be<br />

placed or permitted to accumulate anywhere within the Resort except in sanitary<br />

containers located in appropriate areas screened from view, and no odor is<br />

permitted to arise from such containers so as to render any portion of the Resort<br />

unsanitary, unsightly, or offensive from any public or private street or from any<br />

other lot, residence or common area in the vicinity or to its occupants.<br />

5. Trash containers in residential areas may be exposed to the view of neighboring lots,<br />

residences or common area only when set out the day of scheduled trash collection<br />

and must be brought in no later than midnight of the trash collection day.<br />

6. No unsightly articles, including but not limited to clotheslines and trash dumpsters,<br />

are permitted to remain on any portion of the residential areas or so as to be visible<br />

from any public or private street or from any other lot, residence or common area.<br />

7. Nothing may be done or kept in the residential areas which would increase the rate<br />

of insurance on any lot, residence or common area, or other portion of the Resort<br />

without the approval of the appropriate Board of Directors, nor may anything be<br />

done or kept in the residential areas which would result in the cancellation of<br />

insurance on any lot, residence, common area, or other portion of the Resort or<br />

which would be in violation of any law.<br />

8. A responsible adult must accompany children under the age of 14 years of age when<br />

using any Master Association or sub-association facilities.<br />

9. No fireworks are allowed in the Resort, not any discharge of firearms, except as<br />

permitted by the Declarant or Master Board.<br />

10. Access to the golf courses is restricted to designated entry points.<br />

11. Tennis courts are not allowed in residential areas without the permission of the<br />

Declarant or the Master Board. Sports and recreational facilities and equipment<br />

must not be visible from any street unless permission is obtained.<br />

12. Residential owners hosting gatherings at their homes must notify Community Patrol<br />

at least one week in advance if twenty-five (25) or more persons are invited. A guest<br />

list must be supplied to Community Patrol prior to the gathering. In the event that<br />

Community Patrol determines one or more additional security guards will be<br />

necessary, the owner is required to pay the cost of the guard(s) in advance.<br />

13. No residential lot or residence may ever be used in any way, directly or indirectly,<br />

for any business, commercial, manufacturing, mercantile, storage, vending, or other<br />

such non-residential purposes, other than model homes and sales offices of<br />

Declarant and residential developers, and limited professional and administrative<br />

home occupations expressly permitted in the Master Declaration.<br />

TENTANT <strong>RULES</strong> <strong>AND</strong> <strong>REGULATIONS</strong><br />

1. All leases and rental agreements for lost or residences in the SouthShore<br />

Residential Area must be for a term of at least six (6) months, and must require the<br />

lessee or tenant to comply with the Governing Documents as a condition of the<br />

tenancy. The owner of any lot or residence in any residential area of the Resort,<br />

including the SouthShore Residential Area, is responsible for the behavior of his<br />

lessees and tenants, and any fine or other charge levied by an Association against a<br />

lessee or tenant of any lot or residence in any residential area of the Resort, as a<br />

result of failure by such lessee or tenant to comply with the Governing Documents,<br />

will be the responsibility of the owner of such lot or residence, regardless of any<br />

provision in the lease or rental agreement to the contrary. If a residential owner<br />

rents or leases his lot or residence and gives the right of use of the common areas to<br />

his tenant or lessee, then the owner relinquishes his use rights during the period of<br />

such delegation of rights.<br />

2. Rental apartments, time share residential use, rental pool arrangements, leases for<br />

les than six (6) months duration, “bed & breakfast” accommodations and other<br />

similar short-term rental or part-time transient residential uses are not permitted in<br />

the SouthShore Residential Area. Such uses may be permitted in other areas of the<br />

Resort, including areas other than the SouthShore Residential Area.<br />

PARKING <strong>AND</strong> TRAFFIC <strong>RULES</strong><br />

1. No overnight parking of vehicles owned by property owners or tenants is permitted<br />

on the streets in the residential areas of the Resort.<br />

2. Parking within fifteen (15) feet of any fire hydrant within the Resort is at all times<br />

prohibited.<br />

3. The City of Henderson is allowed to impose and enforce all provisions of the<br />

applicable vehicle code sections or local ordinances on any private streets within the<br />

Resort.<br />

4. Mopeds and motor bikes are subject to vehicle code restrictions (i.e., both driver<br />

and motor bike must be licensed).<br />

5. Golf carts as defined in Nevada Revised Statute (NRS) 482.398 are permitted on<br />

Lake Las Vegas Resort streets. Golf carts must conform to all requirements in NRS<br />

including, but not limited to, that which requires the golf cart to be operated by a<br />

licensed driver.<br />

6. Low speed vehicles as defined in NRS 484.527 are permitted on Lake Las Vegas<br />

Resort streets. Low speed vehicles must conform to all requirements in NRS<br />

including, but not limited to, that which requires the vehicle to be operated by a<br />

licensed driver.<br />

7. The folowing vehicles (colectively “Prohibited Vehicles”) may not be parked,<br />

stored or kept on any street (public or private) within the residential areas: any<br />

commercial type vehicle (including, but not limited to, any dump truck, cement<br />

mixer truck, oil or gas truck or delivery truck); any recreational vehicle (including,<br />

but not limited to, any camper unit, house/car or motor home); any limousine, any<br />

bus, trailer or trailer coach, camp trailer, boat, aircraft or mobile home; any vehicle<br />

or equipment, mobile or otherwise, deemed to be a nuisance. Helicopters may be<br />

permitted to land in areas expressly designated for such use by Declarant.<br />

8. No Prohibited Vehicle may be parked, stored, or kept on any lot or common areas,<br />

or any street (public or private) in a residential area, except for the purposes of<br />

loading, unloading, making deliveries, or emergency repairs and except for<br />

specifically designated Prohibited Vehicle parking areas, if any.<br />

9. Vehicles that are owned, operated or within the control of a property owner, or of<br />

an occupant of such owner’s residence, must be parked in the garage or other<br />

assigned parking space to the extent of the maximum designed capacity of such<br />

garage or parking space.<br />

10. Each garage or other parking area shall, at all times, have the ability to<br />

accommodate at least the number of vehicles for which it was originally constructed.<br />

11.Driveways may not be used for parking purposes if the owner’s garage is not being<br />

utilized to the maximum designed capacity for the parking of authorized vehicles, or<br />

if to do so obstructs free traffic flow, constitutes a nuisance, violates these Rules, or<br />

otherwise creates a safety hazard.<br />

12. Garage doors must be kept closed at all times, except as reasonably required for<br />

ingress to and egress from the interiors of the garages.<br />

13. No repairs or restorations of any motor vehicle, boat, trailer, aircraft or other<br />

vehicle or equipment may be conducted upon any street (public or private), any<br />

portion of any common area, lot or residence, or elsewhere in a residential area,<br />

except wholly within an enclosed garage; provided, however, that such activity<br />

within an enclosed garage may not be undertaken as a business, and provided<br />

further that such activity may be prohibited entirely if it is determined by the<br />

applicable Board to be a nuisance.<br />

14. Posted speed limits may not be exceeded; traffic citations may be issued by<br />

Community Patrol for violations.<br />

PET <strong>RULES</strong><br />

1. No animals, fowl, reptiles, poultry, fish or insects of any kind may be raised, bred<br />

or kept on any lot, common area or in any residence within the residential areas of<br />

the Resort, except that a reasonable number of birds, fish, dogs, cats or other<br />

customary household pets may be kept on a lot or in any residence, provided that<br />

they are not kept, bred or maintained for any commercial purpose, nor in<br />

unreasonable quantities ordinarily means more than two (2) household pets per lot<br />

or residence; provided; however, that the applicable Board of Directors may<br />

determine that a reasonable number in any instance is more or less. Desert<br />

Tortoises are a protected species in the Resort.<br />

2. The applicable Board may limit the size of pets and may prohibit maintenance of<br />

any pet which,in the Board’s opinion, constitutes a nuisance to others.<br />

3. Animals belonging to property owners, occupants, tenants or guests must be either<br />

kept within an enclosure or an enclosed yard or on a leash or other restraint being<br />

held by a person capable of controlling the animal.<br />

4. Any property owner is absolutely liable to each and all other owners, their families,<br />

guests, tenants and invitees, for an unreasonable noise or damage to person or<br />

property caused by any pets brought or kept by such owner or such owner’s family,<br />

tenants or guests and it is the absolute duty and responsibility of each property<br />

owner to clean up after such pets.<br />

5. Excessive dog barking or other animal noise will be deemed a nuisance.<br />

SIGN <strong>RULES</strong><br />

1. No sign, poster, billboard, balloon or other advertising device may be displayed on<br />

any portion of any residential area of the Resort except (i) such signs (regardless of<br />

size or configuration) as may be used by Declarant or a residential developer in<br />

connection with the development of the Resort and the sale, lease or other<br />

disposition of lots and residences, (ii) entry monuments and similar community<br />

identification signs maintained by an Association, (iii) subject to Development<br />

Regulations governing the location, size, materials and other such criteria, one (1)<br />

nameplate or similar property owner name identification, and one (1) sign advising<br />

of the existence of security services protecting a lot or residence; and (iv) such signs<br />

as may be permitted by the Master Board or the SouthShore Board, as applicable,<br />

including one (1) “For Sale” or “For Lease” sign.<br />

2. All signs must conform with all applicable governmental ordinances.<br />
