to set up one <strong>en</strong>try point in the state border of Ukraine for imported second hand apparel;<br />

introduction of indicative prices, the level of which would correspond to actual price of respective domestic<br />

goods;<br />

elaboration of measures to counterfight cases of reduced customs value of imported light industry<br />

commodities, in particular an issue of Ukraine’s joining the international Agreem<strong>en</strong>t on Post Shipm<strong>en</strong>t<br />

Inspection.<br />

All efforts from domestic “sewing lobby” aimed at protection of national market from second<br />

hand led to no results till date. In spite the governm<strong>en</strong>tal degree from 2008, targeted at<br />

blocking second hand apparel import, which is frequ<strong>en</strong>tly being declared as raw material for<br />

processing and recycling, and follow up Resolution of the Cabinet of Ministers from 2009,<br />

which has limited the number of state border crossing custom points to 16 for second hand<br />

apparel, the amount of imported second hand goods keeps growing from year to year.<br />

9. MARKET ACCESS REQUIREMENTS<br />

Market access requirem<strong>en</strong>ts are specified in relevant Ukrainian legislation, regulating<br />

external economic relations, issues of consumer protection and taxation.<br />

Foreign trade regime betwe<strong>en</strong> Republic of Moldova and Ukraine is additionally regulated by<br />

Free Trade Agreem<strong>en</strong>t betwe<strong>en</strong> Cabinet of Ministers of Ukraine and Governm<strong>en</strong>t of<br />

Moldova N 2581-IV 2581-15 ratified on 19.05.2005 with update according to Protocol<br />

(498_142) from 21.04.2009.<br />

As regulated by this legal act, countries of the agreem<strong>en</strong>t do not apply any duties and fees<br />

on export and import of apparel commodities.<br />

The above regulations are based on principles of WTO and are being harmonised with<br />

relevant legislation of EU.<br />

In more details the requirem<strong>en</strong>ts and market <strong>en</strong>try procedures are specified in related<br />

instructions, orders, technical regulations, etc. which are available for free access in the full<br />

text format on the web links, listed in the Annex 6.<br />

In addition to above m<strong>en</strong>tioned regulations, a pot<strong>en</strong>tial exporter to Ukraine may need to<br />

consider further requirem<strong>en</strong>t of a business partner (if any), specified during negotiation<br />

process and fixed in the contract betwe<strong>en</strong> parties.<br />
