Sri V.Chiranjeevi Rao, S/o.late Jaggappa, Pedda Banapuram, Kavitagraharam post, B.Tharla
Mandal, Srikakulam District has filed a 2nd appeal dated 21-12-2009 which was received by this
Commission on 29-12-2009 for not getting the information sought by him from the PIO / Tahsildar,
Nandigama Mandal, Srikakulam District and Appellate Authority / Revenue Divisional Officer,
Tekkali Division, Srikakulam District.
The brief facts of the case as per the appeal and other records received along with it are that the
appellant herein filed an application dated 17-09-2009 before the PIO requesting to furnish copies of
the following references relating to entries made in Pattadar Pass Books of Sy. No. 229-10, for 2.22
acres of land of Pedda Banapuram Village.
1. SR No. 462/99/H9, dated 28-02-2000 of the Collector, Srikakulam.
2. Your office report in DDis 506/99, dated 11-09-2000 submitted to Collector, Srikakulam.
3. Notice u/s 80 of CPC issued by Sri D.Vivekananda, Advocate Tekkali dated 29-03-2002.
4. RC No. 723/02/A, dated 19-04-2002 of the Revenue Divisional Officer, Tekkali.
5. Report of the Mandal Surveyor, Nandigama dated 12-03-2003 (Kumaraswamy Surveyor) for
Rs.5,100/- vide challan No.306, dated 22-01-2003 for getting sub-division work in Sy.No.229-10)

The Tahsildar, Nandigama Mandal through endorsement No. LDis’ 1/2009/B, dated 02-08-
2009 informed to the Appellant that the connected file is not available and hence not possible to
furnish information. Earlier the Tahsildar, Nandigama through notice No. 467/2001, dated 21-10-2001
informed to the appellant to attend before his office on 15-10-2001.
Stating that as the Appellant did not get any reply from the Public Information Officer, the
appellant filed an appeal dated 02-11-2009 u/s 19(1) before the Appellate Authority/ Revenue
Divisional Officer, Tekkali Division, Srikakulam District requesting to arrange to supply the
information.
The Revenue Divisional Officer, Tekkali through letter No. 1103/2009/J, dated 22-10-2009 has
sent a copy of the Tahsildar’s letter No. 1/2009, dated 02-08-2009 to the appellant which was sent by
the Tahsildar.
The appellant stated that as he did not get the information even after 30 days of filing his
appeal, he filed this 2nd appeal before this Commission requesting to arrange to furnish the
information sought by him.
The 2nd appeal was taken on file and notices were sent to the parties concerned directing them
to appear before the Commission for hearing on 25-02-2011.

The Tahsildar through letter No. 247/2010/B, dated 16-07-2010 submitted that through
endorsement No. 219/2009/A, dated 19-10-2009 the information sought for was furnished. The details
are as follows:-
Item No. 1 : This reference was not issued from MRO's office. Hence not available.
Item No. 2 : Not known whether this was closed as DD’s or not. 2000 personal Register not
traced since the record was damaged. Hence information not available.
Item No. 3 : The appellant has not mentioned to whom the notice dated 29-03-2002 was
issued. Hence not come under RTI Act.
Item No. 4 : This reference was not issued from MRO's office. Hence not available.
Item No. 5 : No such report is available.
The Revenue Divisional Officer, Tekkali Division through letter No. 1426/2009/J, dated
02-08-2010 filed an affidavit stating the following facts on each item of the information sought by the
appellant.
Item No. 1 : Through letter No.1426/2009/J dated 18-11-2009 requested the appellant to
obtain from Collector’s office.
Item No. 2 : Informed the same fact that was sent to the Appellant by the Tahsildar.
Item No. 3 : Through letter No.1426/2009/J, dated 18-11-2009 copy of the notice was
supplied to the Appellant.
Item No. 4 : Through letter No.1426/2009/J, dated 18-11-2009 copy of the letter
No.723/2002/E, dated 19-04-2002 supplied.
Item No. 5 : Informed the same fact that was informed by the Tahsildar through letter dated
19-10-2009.
On 25-02-2011 the case was called. The appellant and respondent/ Tahsildar, Nandigama
Mandal were present.
The respondent submitted that the then Tahsildar had informed the appellant through
Lr.No.L.Dis.1/2009/B, dated 02-08-2009 that the connected file was not available and hence it was not
possible to furnish the information. He also submitted that through Lr.No.247/2010, dated 19-10-2009
a detailed reply was furnished by the PIO /Tahsildar. The Revenue Divisional Officer Tekkali Division
of Srikakulam District., through Lr.No.1426/2009/J, dated 18-11-2009 furnished copies of information
on items 3 and 4 and on item No.1, advised the appellant to approach the Collector. On item 2 and 5,
RDO confirmed the information provided by the Tahsildar.
In view of the foregoing this appeal is closed.
