or a report <strong>of</strong> the x-ray. but the report must be available for submittal on request'<br />

(d) A chiropractor may also provide serv'ices in the nature <strong>of</strong> physical therapy under<br />

the direction <strong>of</strong> a qualified physician.<br />

Sec. 10.312 \\&at are the special rules forthe services <strong>of</strong> clinical ps1'choiogists<br />

A clinical ps.vchologist may sen'e as a phl'sician only within the scope <strong>of</strong> his or her<br />

practice as defined by State larv. Therefore. a clinical psychologist may not sen'e as a<br />

ph1'sician for conditions that include a ph-vsical component unless the appiicable State<br />

ia1v allo*,s clinicel ps1'chologists to treat ph,u-sical conditions. A clinical ps1'chologist<br />

ma-v also perform teiting, evaluation and other sen'ices under the direction <strong>of</strong> a qualified<br />

ph1'sician.<br />

Sec. 10.313 Will OWCP pay for preventive treatment<br />

The FECA does not authorize pa,vment for preventive measuresuch as vaccines and<br />

inoculations. and in general. prevcntir,e treatment may be a responsibility <strong>of</strong> the<br />

emplol,'ing asencv under the provisions <strong>of</strong> 5 U.S.C. 790i (see Sec. i0.303). Horvever.<br />

OWCP can authorize trearn.ient for the following conditions. even though such treatment<br />

is designed. in part, to prevent further injury:<br />

(a) Complications <strong>of</strong> preventive measures rvhich are provided or sponsored by the<br />

agency. such as an adverse reaction to proph,vlactic immunization.<br />

(b) Actual or probable exposure to a known contaminant due to an injury'. thereby<br />

requiring disease:specific measures against infection. Examples include the provision <strong>of</strong><br />

tetanus antitoxin or booster toxoid injections for puncfure u'ounds: administration <strong>of</strong><br />

rabies vaccine for a bite from a rabid or potentially rabid animal: or appropriate<br />

measures rvhere exposure to human immunodeficiency virus (HIV) has occurred.<br />

(c) Conversion <strong>of</strong> tuberculin reaction from negative to positive following exposure to<br />

tuberculosis in the performance <strong>of</strong> duty. In this situation, the appropriate therapy may be<br />

authorized.<br />

(d) Where injury to one e1'e has resulted in loss <strong>of</strong> vision. periodic examination <strong>of</strong> the<br />

uninjured e-ye to detect possible s)'mpathetic involvement <strong>of</strong> the uninjured eve at an<br />

earil'' stage.<br />

Sec. 10.314 Will O\\ICP pav for the services <strong>of</strong> an attendant<br />

Yes. OWCP u,ill pa,v for the sen'ices <strong>of</strong> an attendant up to a maximum <strong>of</strong> $ 1 .500 per<br />

month. u,here the need for such serr,ices iras been medicaliy documented. ln the exercise<br />

<strong>of</strong> the discretion afforded by 5 U.S.C. 8111(a). the Director has determined that. excepl<br />

-,vhere pa),menrs rvere being made prior to January 1.1999, direct pa)'ments to the<br />

claimant to cover such sel,ices rvill no ionger be made. Rather. the cost <strong>of</strong> providing<br />

attendant sen'ices will be paid under section 8103 <strong>of</strong> the Act. and medical bills forthese<br />
