allowed to continue as provided in KPB 21.18.090.<br />
Section (E) makes the public aware of how to obtain the Appendix.<br />
KPB 21.18.027- Updates to the Atlas and Catalog ofWaters Important for Spawning. Rearing.<br />
or Migration of Anadromous Fish.<br />
This new section refers the public to the state process for updating the Catalog.<br />
KPB 21.18.030- Periodic review.<br />
Provides that additions to the Catalog will be reviewed for inclusion in the borough's appendix<br />
every three years. Deletions will be reviewed as they occur. This will assist in ensuring that all<br />
anadromous waters in a district are regulated, and those which are not anadromous are not<br />
regulated.<br />
KPB 21.18.040- Habitat protection district established.<br />
This section adds an abbreviation for anadromous waters habitat protection district, i.e., habitat<br />
protection district.<br />
KPB 21.18. 065 - Activities not requiring a permit.<br />
Section (A) is amended to declare the advantages of maintaining natural vegetation on lands<br />
abutting anadromous waters. The extent of vegetation management allowed in the habitat<br />
protection district has long been misunderstood. This section clarifies what is allowed by<br />
defming the routine maintenance that is allowed. It further clarifies how much vegetation may<br />
be removed and under what conditions downed trees may be removed. The section specifically<br />
allows for the planting of native vegetation without a permit as long as runoff and erosion are<br />
controlled.<br />
KPB 21.18.071- Staffpermits.<br />
Section (A) is amended to provide a staff permit for tree removal when the tree is dead, a safety<br />
hazard, or diseased.<br />
Subsection (A)(5) allows certain impervious coverage for lakefront lots to allow for structures<br />
such as gazebos, barbecues, walkways, fire pits, decks and saunas. The section also provides for<br />
mitigation measures to be part of the permit process to offset the loss of vegetation resulting<br />
from the permitted structure.<br />
KPB 21.18.081 -Conditional use permit.<br />
Section (B) is amended to allow certain structures common to lakefront ownership through the<br />
conditional use permit process, specifically watercraft landings and float plane landings and<br />
haulouts. Boat launches are also allowed where no public boat launch exists on a lake subject to<br />
the conditions stated in the ordinance. The planning commission may place additional<br />
conditions on the permit to preserve and protect the habitat protection district consistent with<br />
21.18.081(E).<br />
