Term & Conditions<br />
1. After the completion of the project, the developed Software <strong>for</strong> the same with Source Code<br />
alongwith details of development tools MUST be handed over to MC, Jalandhar authorities<br />
2. All the software’s provided and its relevant License is the sole responsibility of the Vendor.<br />
3. Each Module in the software MUST be capable of Any Time Reporting <strong>for</strong> the convenience of the MC,<br />
Jalandhar staff.<br />
4. The rates quoted by the tendering agency should be inclusive of all statutory/taxation liabilities at<br />
the time of entering into the contract. Regarding manpower, the tenders submitted with less than<br />
minimum wages as prescribed by Government of Punjab, shall be rejected without any notice.<br />
5. All Scope of work MUST be completed in stipulated time, any delays MUST be penalized @ Rs. 2000/-<br />
per week shall be levied after the delay in execution of the assignment at various stages. Delay of<br />
more than 30 day at any stage may result in <strong>for</strong>feiting the EMD and Cancellation of the project.<br />
6. The conditional bids shall not be considered and will be out rightly rejected in very first instance.<br />
7. The Bids shall be opened on the scheduled date and time in the Office of Mayor <strong>Municipal</strong><br />
<strong>Corporation</strong> Jalandhar in the presence of the representatives of the Companies/Firms/Agencies, if<br />
any, who are present on the spot at that time.<br />
8. The competent authority of the <strong>Municipal</strong> <strong>Corporation</strong> Jalandhar reserves the right to annul any or all<br />
bids without assigning any reason.<br />
9. The contract shall be subject to the Indian Laws and the jurisdiction of the courts, located in the<br />
Jalandhar<br />
10. The tender shall remain valid <strong>for</strong> acceptance up to six months from the date of opening of<br />
tender<br />
11. The t e n d e r i n g C o m p a n y /Firm/Agency s h a l l r e p l a c e i m m e d i a t e l y a n y o f<br />
i t s personnel, who are found unacceptable to MCJ because of security risks, incompetence, conflict<br />
of interest, improper conduct etc. upon receiving a notice from the <strong>Municipal</strong> <strong>Corporation</strong> Jalandhar.<br />
12. The agency shall depute a coordinator who would be responsible <strong>for</strong> weekly interaction with<br />
the MCJ so that optimal services of the persons deployed by the agency could be availed without any<br />
disruption.<br />
13. It will be the responsibility of the service providing agency to meet transportation, food, medical<br />
and any other requirements in respect of the persons deployed by it (Agency) in MCJ and MCJ will<br />
have no liability in this regard.<br />
14. The MCJ shall not be responsible <strong>for</strong> any damages, losses. Claims- financial or otherwise, injury<br />
to any person deployed by service providing agency in the course of their per<strong>for</strong>ming the<br />
functions/duties, or <strong>for</strong> payment towards any compensation.<br />
15. The person deployed by the service providing agency shall not have any claim or be entitled to pay,<br />
perks and other facilities admissible to casual, ad-hoc, regular/confirmed employees of the <strong>Municipal</strong><br />
<strong>Corporation</strong> Jalandhar during the currency or after expiry of the contract.<br />
16. In case of termination of this contract on its expiry or otherwise, the persons deployed by the<br />
service providing agency shall not be entitled to and will have no claim <strong>for</strong> absorption in the<br />
regular/otherwise capacity in the <strong>Municipal</strong> <strong>Corporation</strong> Jalandhar.<br />
17. All Taxes has to be borne by the Vendor and the price quoted MUST include all taxes.<br />
18. The Commissioner MCJ reserves the right to reject any or all tenders without assigning any reason.<br />
