Term & Conditions 1. After the completion of the project, the developed Software for the same with Source Code alongwith details of development tools MUST be handed over to MC, Jalandhar authorities 2. All the software’s provided and its relevant License is the sole responsibility of the Vendor. 3. Each Module in the software MUST be capable of Any Time Reporting for the convenience of the MC, Jalandhar staff. 4. The rates quoted by the tendering agency should be inclusive of all statutory/taxation liabilities at the time of entering into the contract. Regarding manpower, the tenders submitted with less than minimum wages as prescribed by Government of Punjab, shall be rejected without any notice. 5. All Scope of work MUST be completed in stipulated time, any delays MUST be penalized @ Rs. 2000/- per week shall be levied after the delay in execution of the assignment at various stages. Delay of more than 30 day at any stage may result in forfeiting the EMD and Cancellation of the project. 6. The conditional bids shall not be considered and will be out rightly rejected in very first instance. 7. The Bids shall be opened on the scheduled date and time in the Office of Mayor Municipal Corporation Jalandhar in the presence of the representatives of the Companies/Firms/Agencies, if any, who are present on the spot at that time. 8. The competent authority of the Municipal Corporation Jalandhar reserves the right to annul any or all bids without assigning any reason. 9. The contract shall be subject to the Indian Laws and the jurisdiction of the courts, located in the Jalandhar 10. The tender shall remain valid for acceptance up to six months from the date of opening of tender 11. The t e n d e r i n g C o m p a n y /Firm/Agency s h a l l r e p l a c e i m m e d i a t e l y a n y o f i t s personnel, who are found unacceptable to MCJ because of security risks, incompetence, conflict of interest, improper conduct etc. upon receiving a notice from the Municipal Corporation Jalandhar. 12. The agency shall depute a coordinator who would be responsible for weekly interaction with the MCJ so that optimal services of the persons deployed by the agency could be availed without any disruption. 13. It will be the responsibility of the service providing agency to meet transportation, food, medical and any other requirements in respect of the persons deployed by it (Agency) in MCJ and MCJ will have no liability in this regard. 14. The MCJ shall not be responsible for any damages, losses. Claims- financial or otherwise, injury to any person deployed by service providing agency in the course of their performing the functions/duties, or for payment towards any compensation. 15. The person deployed by the service providing agency shall not have any claim or be entitled to pay, perks and other facilities admissible to casual, ad-hoc, regular/confirmed employees of the Municipal Corporation Jalandhar during the currency or after expiry of the contract. 16. In case of termination of this contract on its expiry or otherwise, the persons deployed by the service providing agency shall not be entitled to and will have no claim for absorption in the regular/otherwise capacity in the Municipal Corporation Jalandhar. 17. All Taxes has to be borne by the Vendor and the price quoted MUST include all taxes. 18.
