Our message to the institutions is becoming<br />

increasingly direct, as both officials and<br />

politicians talk in vague terms about growth<br />

without ever mentioning the word industry<br />

and Brussels goes on in a 'business as<br />

usual mode': industry is not a dirty word!<br />

Industry is not smoke stacks, pollution and<br />

unacceptable face of capitalism. Industry<br />

provides jobs and the employees of<br />

manufacturing companies from the<br />

backbone of the European economy,<br />

including also of the service economy. It is<br />

time that politicians really made efforts to<br />

understand what makes industry attracted<br />

to the EU, invest and flourish!

4) European Parliament backs industry claims for ensuring the market<br />

relevance of European Commission standardisation mandates<br />

MEP Lara Comi’s report on the<br />

draft Regulation on European<br />

standardisation was approved on<br />

23 <strong>March</strong> by the European<br />

Parliament’s Internal Market<br />

Committee (IMCO) with 36 votes<br />

in favour and 2 abstentions. In<br />

general the outcome of the vote<br />

is positive for <strong>Orgalime</strong> - our<br />

efforts are now focusing on the<br />

Council to keep these positive<br />

changes to the Commission<br />

proposal, which include:<br />

• The rejection of voting or veto<br />

rights for societal stakeholders<br />

• The introduction of an obligation<br />

for the Commission to notify<br />

European business federations<br />

and ‘all relevant stakeholders’ to<br />

ensure the market relevance of<br />

European Commission annual<br />

work programmes and draft<br />

E u r o p e a n C o m m i s s i o n<br />

standardisation mandates. This<br />

was a strong plea from most<br />

stakeholders, most notably from<br />

industry<br />

• Deletion to the reference to fund<br />

Annex III organisations for ‘the<br />

verification of the quality, and<br />

conformity to the corresponding<br />

policies and legislation of the<br />

Union, of European standards<br />

and European standardisation<br />

deliverables’<br />

• Rejection of the idea to allow for<br />

free access to standardisation<br />

work for certain groups of<br />

‘weak’ stakeholders, namely<br />

micro-enterprises.<br />

The European Parliament will<br />

decide mid-April when to open<br />

formal negotiations with the<br />

Council, which is expected to<br />

finalise its common position by<br />

the end of May. If all the 3<br />

institutions manage to come to<br />

an agreement before the summer<br />

b r e a k , t h e R e g u l a t i o n o n<br />

European standardisation could<br />

be formally adopted by mid-July.<br />

2) Resource Efficiency – <strong>Orgalime</strong> concerned over EP draft report<br />

Following the publication of<br />

Rapporteur Gerbrandy’s Draft<br />

Report on the Roadmap for a<br />

Resource Efficient Europe,<br />

<strong>Orgalime</strong> expressed its concerns<br />

i n a l e t t e r i s s u e d t o t h e<br />

Rapporteur, Shadow Rapporteurs<br />

and MEPs in the Environment<br />

Committee (ENVI). In line with our<br />

earlier position, t h e l e t t e r<br />

articulated worries about the<br />

extension of the Eco Design<br />

Directive to non-energy related<br />

p r o d u c t s a n d f u r t h e r<br />

e n v i ro n m e n t a l p a r a m e t e r s .<br />

Alternative proposals have been<br />

submitted such as:<br />

• Introducing a zero-landfill policy<br />

without delay<br />

• Calling for the setting of waste<br />

collection and recycling targets,<br />

including reuse<br />

• Quality standards for secondary<br />

raw materials and harmonised<br />

treatment standards for priority<br />

waste streams.<br />

Not only do we call for full<br />

implementation of the EU waste<br />

acquis, but for even more efficient<br />

and effective market control and<br />

enforcement in order to stop<br />

illegal shipments of (valuable)<br />

waste fractions outside Europe. In<br />

a d d i t i o n , O r g a l i m e a l s o<br />

r e c o m m e n d p l a c i n g m o r e<br />

emphasis on the role of the<br />

consumer and promote the<br />

establishment of a roll out map for<br />

resource efficient technologies.<br />

Meanwhile, the 272 amendments<br />

tabled on Rapporteur Gerbrandy’s<br />

Draft Report are currently under<br />

assessment, in view of further<br />

actions ahead of the European<br />

P a r l i a m e n t E n v i r o n m e n t<br />

Committee (ENVI) vote scheduled<br />

for 25 April.<br />

2014 to 2020, is currently up for<br />

discussion by the European<br />

Parliament and the Council.! The<br />

Industry, Research and Energy<br />

Committee (ITRE) of the European<br />

Parliament, responsible for<br />

p r e p a r i n g t h e E u r o p e a n<br />

Parliament Report, has appointed<br />

Ms Teresa Riera Madurell MEP<br />

(S&D, Spain) as Rapporteur for<br />

the general Horizon 2020 dossier<br />

and Ms Maria Da Graça Carvalho<br />

MEP (EPP, Portugal) for the report<br />

o n t h e i m p l e m e n t a t i o n<br />

programmes of Horizon 2020. !<br />

The Parliament is not expecting to<br />

vote on the reports before<br />

October <strong>2012</strong>.<br />

As Horizon 2020 aims to be the<br />

first one to support the whole<br />

cycle of innovation, from basic<br />

research to market uptake, it<br />

poses new and demanding<br />

questions to stakeholders and<br />

policymakers.! The European<br />

Parliament held a public hearing<br />

focusing on the ways to estimate<br />

the impact of Horizon 2020 for<br />

growth and jobs in the EU, the<br />

right balance between supporting<br />

e x c e l l e n c e a n d s p r e a d i n g<br />

research capacities throughout<br />

the EU and ensuring a viable<br />

career for EU researchers to limit<br />

d o w n b r a i n d r a i n t o t h i rd<br />

7) Gas Appliances Directive (GAD) – Revision<br />

After more than two years of work<br />

on the new terms of a revision of<br />

the Gas Appliances Directive<br />

(GAD) through a Commission ad<br />

hoc group (in which <strong>Orgalime</strong> has<br />

a seat), the European Commission<br />

launched a public consultation on<br />

the revision of GAD at the end of<br />

last year.<br />

The main consultation issues to<br />

which stakeholders will contribute<br />

is dealing with the following<br />

issues:<br />

•Alignment of GAD with the New<br />

Legislative Framework<br />

•Clarification of the current<br />

provisions of GAD<br />

•Modification of the scope of<br />

G A D a n d t h e e s s e n t i a l<br />

requirements<br />

<strong>Orgalime</strong> finalised its contribution<br />

to the on-line consultation which<br />

closed on 11 <strong>March</strong> <strong>2012</strong>.<br />

I n p a r a l l e l , t h e E u r o p e a n<br />

Commission has also appointed a<br />

consultant (Risk & Policy Analysts<br />

Ltd) to carry out an impact<br />

assessment study on the revision<br />

of Directive 2099/142/EC on<br />

appliances burning gaseous fuels.<br />

O r g a l i m e i s a n s w e r i n g a<br />

questionnaire drafted by the<br />

consultant. The Commission<br />

proposal on a revision of the Gas<br />

Appliances Directive should be<br />

ready in the first quarter of 2013.<br />

2) Alignment Package: Steps towards a strict alignment<br />

The alignment of the 9 Directives<br />

w i t h t h e N e w L e g i s l a t i v e<br />

Framework is the hands of the<br />

Council and the Internal Market<br />

and Consumer Affairs Committee<br />

of the European Parliament.<br />

During the last discussion of the<br />

Committee, Ms Roithová MEP, the<br />

European Parliament Rapporteur,<br />

shared her belief that the<br />

objective of the Alignment<br />

Package is to simplify the<br />

application of law and to enhance<br />

m a r k e t s u r v e i l l a n c e . S h e<br />

mentioned <strong>Orgalime</strong> and focused<br />

on issues stated in our position<br />

paper (published 5 <strong>March</strong> <strong>2012</strong>),<br />

such as the single declaration of<br />

conformity and the application of<br />

new rules to products already<br />

placed on the market. The<br />

Shadow Rapporteurs also seem<br />

willing to achieve a strict and<br />

efficient alignment. Ms Roithová’s<br />

report is expected in the end of<br />

April and should normally be<br />

adopted at first reading in autumn<br />

<strong>2012</strong>.<br />

E u ro c o m m e rc e t o i d e n t i f y<br />

possible problems from the<br />

implementation of the Package<br />

throughout the distribution chain.<br />

<strong>Orgalime</strong> also met with the team<br />

of Ms Roithová, to elaborate on<br />

our position and on the outcome<br />

o f t h e a f o r e m e n t i o n e d<br />

collaboration. Furthermore, we<br />

v i s i t e d t h e p e r m a n e n t<br />

representation of Cyprus, which<br />

will hold the Presidency of the<br />

Council between July and<br />

December this year and will thus<br />

chair important meetings on the<br />

Package. Their objective is to<br />

avoid any discussion on the<br />

content of the Directives, which<br />

might result in diverging from a<br />

strict alignment. Mr McMillan,<br />

responsible for the Package<br />

within the European Commission,<br />

participated in the meeting of the<br />

NAMS task force on 2 April <strong>2012</strong>.<br />

2) Draft Energy Efficiency Directive – on the way for EP and Council<br />

negotiations<br />

Following the adoption of a Draft<br />

Report on the draft Energy<br />

Efficiency Directive (EED), The<br />

Industry, Research and Energy<br />

C o m m i t t e e ( I T R E ) g a v e a<br />

mandate to Rapporteur Turmes to<br />

start informal negotiations with<br />

the Council immediately after the<br />

ITRE Committee vote to reach a<br />

first reading agreement. In<br />

parallel, ongoing discussions at<br />

the Council are taking place to<br />

establish clear guidance for the<br />

Danish Presidency on the<br />

following key issues: targets,<br />

obligation schemes, public<br />

bodies & buildings and Green<br />

Public Procurement. In view of<br />

the finalisation of the Council<br />

position for the upcoming<br />

trialogue negotiations, <strong>Orgalime</strong><br />

submitted its recommendations<br />

to the Commission and the<br />

Danish Presidency.<br />

Essentially, <strong>Orgalime</strong> calls on the<br />

Council to support concrete<br />

energy efficiency measures rather<br />

than the setting of binding targets<br />

and to establish an energy<br />

efficiency obligation scheme that<br />

includes an opt-out clause and an<br />

exemption for small actors<br />

without lowering the overall<br />

ambition of the scheme. In<br />

addition, <strong>Orgalime</strong> also supports<br />

strengthening requirements on<br />

both, private and public building<br />

renovation, harmonising energy<br />

efficiency product criteria for<br />

public procurement, promoting<br />

smart metering and introducing<br />

demand response programmes.<br />

Meanwhile, <strong>Orgalime</strong>’s follow-up<br />

activities included taking the<br />

opportunity to promote its views<br />

on renovation in buildings at a<br />

BusinessEurope Energy Efficiency<br />

seminar and shortly exchanged<br />

views with Martin Lidegaard,<br />

Danish Minister for Climate,<br />

Energy and Building during a<br />

workshop on ‘Energy Efficiency in<br />

Buildings’ on 8 <strong>March</strong> <strong>2012</strong>.<br />

1) Recast of the Modernised Customs Code takes industry by surprise<br />

In February <strong>2012</strong> the Commission<br />

issued a proposal for a Regulation<br />

of the European Parliament and of<br />

the Council laying down the<br />

Union Customs Code (UCC).!The<br />

aim of the proposal is to amend<br />

the Regulation (EC) 450/2008<br />

(Modernised Customs Code<br />

( M C C ) ) b e f o re i t b e c o m e s<br />

applicable, and to adjust some<br />

provisions of the MCC which are<br />

no longer in line with changes<br />

introduced since 2008. One of the<br />

major changes in the recast is the<br />

introduction of delegated and<br />

implementing acts, following the<br />

Lisbon Treaty.<br />

The proposal has been submitted<br />

to the European Parliament and<br />

w i l l b e d e a l t w i t h i n t h e<br />

Committee on Internal Market<br />

and Consumer Protection (IMCO)<br />

as a lead committee under the<br />

ordinary legislative procedure (codecision),<br />

with the Committee on<br />

L e g a l A f f a i r s ( J U R I ) a n d<br />

International Trade (INTA) as<br />

opinion giving Committees.<br />

The first exchange of views in<br />

IMCO will be held by the end of<br />

April, and a public hearing in the<br />

European Parliament should be<br />

organised later this year. The<br />

Rapporteur for the dossier is Ms<br />

Constance Le Grip (EPP, France),<br />

and the draft report should be<br />

presented for discussion after the<br />

summer break.! Industry experts<br />

were caught by surprise by the<br />

250 page long recast document,<br />

<strong>Orgalime</strong> is now collecting<br />

feedback and comments from<br />

members.! T h e D a n i s h E U<br />

P r e s i d e n c y h a s r e c e n t l y<br />

requested Member States to<br />

submit comments on the recast<br />

by mid-April.<br />

7) RoHS II: Fight continues towards efficient implementation<br />

Judging by the number of letters<br />

and position papers provided to<br />

the Commission and Member<br />

States’ RoHS2 FAQ Working<br />

Group in the last two months,<br />

industry is indeed persisting in its<br />

fight to ensure both a timely and<br />

proper implementation of the<br />

Directive. Indeed, following the<br />

submission of the <strong>Orgalime</strong>’s<br />

political letter challenging the<br />

developments on the RoHS2<br />

Guidance/FAQ Working Group,<br />

we have been invited to present<br />

industry’s views to the RoHS2<br />

Working Group meeting on 1<br />

<strong>March</strong> on the issue of ‘large scale’<br />

in the context of Large Scale<br />

Fixed Installation /Large Scale<br />

Stationary Industrial Tool as well<br />

as a number of issues, e.g.:<br />

definition of EEE and dependent<br />

o r c o m p l i a n c e d e a d l i n e s .<br />

O r g a l i m e a l s o t o o k t h e<br />

opportunity to provide a technical<br />

letter commenting and proposing<br />

industry’s common understanding<br />

of these core elements.<br />

<strong>Orgalime</strong>’s participation in the<br />

working group meeting was a<br />

good opportunity to present<br />

industry’s alternative proposals<br />

and to explain market realities<br />

a n d t h e r o l e o f E E E<br />

manufacturers. However, the main<br />

concern lied in the (in our view)<br />

misleading interpretation of Large<br />

Scale Fixed Installations (LSFI)<br />

and the shifting of compliance<br />

r e s p o n s i b i l i t i e s f r o m t h e<br />

manufacturer/importer of EEE to<br />

the installer of ‘installations’.<br />

Thus, <strong>Orgalime</strong> took to initiative to<br />

r e s p o n d t o t h e Te c h n i c a l<br />

Adaptation Committee (TAC)<br />

focusing on the argument of the<br />

difference between ‘placing on<br />

the market’ and ‘putting into<br />

service’ which is fundamental to<br />

the whole logic of RoHS2 and the<br />

LSFI exclusion.<br />

In addition, <strong>Orgalime</strong> is in the<br />

process of elaborating its own<br />

guidance document providing a<br />

common understanding of the<br />

scope provisions, as well as a<br />

final industry guideline including a<br />

substantiated chapter on ‘large<br />

scale stationary industrial tools’.<br />

7) Pressure Equipment Directive (PED) – Update<br />

C o n t r a r y t o w h a t w a s<br />

announced at its publication, the<br />

Pressure Equipment Directive<br />

(PED) has not been integrated<br />

into the alignment package with<br />

the New Legislative Framework<br />

(NLF). This is due to the fact that<br />

Article 9 of PED (hazardous<br />

substances) had first to be<br />

aligned with the Classification,<br />

Labelling and Packaging (CLP)<br />

of hazardous substances and<br />

mixtures Regulation which will<br />

be applicable as from June<br />

2015. <strong>Orgalime</strong> wrote a letter of<br />

concern to the Commission<br />

regarding the non-alignment of<br />

the PED with the NLF.<br />

In parallel, the Commission has<br />

appointed a consultant to run an<br />

evaluation of the implementation<br />

of the Pressure Equipment<br />

D i re c t i v e i n t h e E U . T h e<br />

consultant had a meeting with<br />

the <strong>Orgalime</strong> members on 7<br />

M a rc h 2 0 1 2 . O rg a l i m e i s<br />

currently circulating the online<br />

survey to its members in order to<br />

have an extensive sample<br />

<strong>Orgalime</strong> is releasing the S <strong>2012</strong><br />

general conditions, ‘General<br />

conditions for the supply of<br />

mechanical, electrical and<br />

electronic products, <strong>March</strong> <strong>2012</strong>’,<br />

a revision of the S 2000 general<br />

conditions (August 2000), that<br />

has proven to be <strong>Orgalime</strong>’s best<br />

selling publication. Well over<br />

1,000,000 hard copies of the S<br />

2000 general conditions have<br />

been sold since their publication<br />

and they are the biggest pull to<br />

our licensing website, where we<br />

provide a licence for the use of<br />

our conditions in electronic<br />

format. There are, to date, 9 sets<br />

of <strong>Orgalime</strong> general conditions.<br />

To keep up with the increasing<br />

popularity and acceptance of our<br />

general conditions by companies<br />

throughout Europe, and in order<br />

to assist companies from our<br />

industries who wish to expand<br />

their horizons, <strong>Orgalime</strong> has<br />

broadened the scope of available<br />

language versions of its new S<br />

<strong>2012</strong> publication to include<br />

Danish, Slovak, Czech, Turkish,<br />

Arabic and Japanese languages.<br />

The previously other available<br />

versions (German, French,<br />

Spanish, Italian, Portuguese,<br />

Dutch, Swedish, Hungarian,<br />

Polish, Russian and Chinese)<br />

Following a visit of Vice President<br />

Antonio Tajani to Brazil in<br />

December 2011, the Commission<br />

will organise further missions for<br />

growth this year.! A visit to South<br />

A m e r i c a ( B r a z i l , U r u g u a y,<br />

Argentina and Chile) will take<br />

place in the end of April <strong>2012</strong>,<br />

a n d i s a i m e d a t b u s i n e s s<br />

federations and SMEs.! The<br />

delegation for this mission will be<br />

led by Mr Daniel Calleja Crespo,<br />

t h e D i r e c t o r G e n e r a l o f<br />

Directorate-General Enterprise<br />

and Industry.!The visit might be a<br />

good opportunity for companies<br />

to promote EU business interests<br />

and to pave the way for political<br />

support.! The mission will involve<br />

match-making events and should<br />

strengthen the ties between Latin<br />

American and EU companies. !<br />

Following the visit to São Paulo,<br />

the delegation will be led on a<br />

M i s s i o n f o r G r o w t h i n<br />

Montevideo, Uruguay, Buenos<br />

Aires, Argentina and Santiago de<br />

Chile, to discuss how to foster<br />

industrial cooperation with<br />

politicians and entrepreneurs of<br />

include green economy, key<br />

7) Industrial Emissions Directive (IED) – Implementation: a<br />

snapshot"<br />

On 21 November 2011, the<br />

Industrial Emissions Directive<br />

Member States Committee<br />

(Article 75 Committee) provided<br />

its opinion upon a set of IED<br />

implementation measures and put<br />

an end to a year of stakeholder<br />

c o n s u l t a t i o n m e e t i n g s . 3<br />

implementing decisions have<br />

been adopted via the Comitology<br />

procedure (implementing acts),<br />

notably the guidance document<br />

on the collection of data and on<br />

the drawing up of Best Available<br />

Technique reference documents,<br />

as well as the BAT conclusions for<br />

the Iron & Steel BREF and the<br />

Glass Manufacturing BREF (the<br />

first two revised guidance<br />

documents under the IED).<br />

Further to this Committee<br />

m e e t i n g , t h e C o m m i s s i o n<br />

reiterated its willingness to<br />

c o n t i n u e t o d e r i v e B A T<br />

Conclusions on the basis of<br />

existing BREFs. Accordingly, the<br />

expertise of the Seville Technical<br />

Working Group will remain<br />

essential to identify and ensure<br />

fair and appropriate development<br />

of BAT reference documents.<br />

<strong>Orgalime</strong> consider it therefore, a<br />

responsibility to maintain a strong<br />

network and coordination with<br />

and between Seville experts<br />

representing the engineering<br />

industry. For that purpose,<br />

<strong>Orgalime</strong> is organising an ‘open<br />

session’ IED Task Force with<br />

BREF experts to exchange views<br />

and experiences on their work<br />

carried out for the drawing up<br />

and/or revision of BREFs of<br />

concern to our industry.<br />

With respect to the Integrated<br />

Pollution Prevention and Control<br />

(IPPC) Bureau’s envisaged draft<br />

work programme for the period<br />

<strong>2012</strong>-2014 onwards, the<br />

Commission recently announced<br />

that the Monitoring BREF will now<br />

become a Reference Report<br />

(Commission guidance document<br />

without BAT conclusions).<br />

" Review of Trade Defence Instruments<br />

In <strong>March</strong> <strong>2012</strong> the European<br />

Commission published the results<br />

of an evaluation of the EU's trade<br />

defence instruments (TDI). ! The<br />

aim of the study was to examine<br />

the efficiency and effectiveness of<br />

trade defence mechanisms, and<br />

to prepare for a reform of TDI that<br />

is to be launched in the end of<br />

<strong>2012</strong>.!The evaluation covered the<br />

description of current practice in<br />

the field of TDI, an economic<br />

analysis of the arguments for TDI<br />

and their application in the<br />

international legal and economic<br />

context.! It also focused on the<br />

review of the relevant regulations<br />

in the light of administrative<br />

practice, the judgments of the<br />

C o u r t o f J u s t i c e a n d t h e<br />

recommendations of the WTO's<br />

Dispute Settlement Body, and it<br />

assessed the EU policy and<br />

practice compared to certain EU<br />

trading partners.! The previous<br />

revision of anti-dumping and antisubsidy<br />

measures took place in<br />

1995 and the main goal of the<br />

upcoming reform is to adapt the<br />

measures to the challenges of an<br />

increasingly globalised economic<br />

environment.! As a next step<br />

following the release of the<br />

evaluation the Commission will<br />

launch a public consultation on<br />

the modernisation of the EU's<br />

TDI.<br />

Risk management measures<br />

under the REACH Regulation<br />

have recently been updated with<br />

the adoption of the two following<br />

Regulations amending Annex XIV<br />

and Annex XVII REACH:<br />

•The Commission Regulation<br />

125/<strong>2012</strong> of 14 February <strong>2012</strong><br />

adding 8 substances to the<br />

Annex XIV REACH (list of<br />

s u b s t a n c e s s u b j e c t t o<br />

a u t h o r i s a t i o n ) , T h e s e 8<br />

substances will not be placed on<br />

the market or used within the<br />

next three years unless an<br />

authorisation has been granted<br />

for a specific use.<br />

•The Commission Regulation<br />

109/<strong>2012</strong> of 9 February <strong>2012</strong><br />

amending Annex XVII REACH,<br />

and restricting the manufacture,<br />

placing on the market and use of<br />

some CMR substances.<br />

F o l l o w i n g t h e u p d a t e i n<br />

December 2011 of the REACH<br />

candidate list (CL), which now<br />

contains 73 substances, a further<br />

13 substances were proposed in<br />

February <strong>2012</strong> to be added to the<br />

CL.<br />

In addition, European Chemicals<br />

Agency (ECHA) has published<br />

information on notification of<br />

Substance of Very High Concern<br />

(SVHC) in articles, on basis of the<br />

only 203 notifications received<br />

(from April to December 2011) as<br />

w e l l a s i d e n t i fi e d u s e s o f<br />

substances in articles provided in<br />

registration dossiers. ECHA has<br />

published information on the<br />

number of notifications, the article<br />

categories and the article types<br />

notified for use by consumers<br />

regarding possible reforms to the<br />

Regulation of dual use items. !The<br />

dual-use goods and technologies<br />

can be used for both civilian and<br />

military purposes, which is a<br />

reason why their exports and<br />

transit are subject to strict control. !<br />

The lists of dual-use goods and<br />

technologies are being updated<br />

regularly to limit the risk of<br />

sensitive items being used for<br />

m i l i t a r y p u r p o s e s o r i n<br />

proliferation programs.<br />

In February <strong>2012</strong>, the EU Council<br />

adopted its position on a draft<br />

regulation updating the EU’s list<br />

o f d u a l - u s e g o o d s a n d<br />

technologies, with the aim of<br />

a l i g n i n g t h e l i s t s t o t h e<br />

international rules.<br />

More specifically, the new<br />

R e g u l a t i o n a i m s t o b r i n g<br />

Regulation 428/2009/EC which<br />

g o v e r n s e x p o r t , t r a n s f e r s ,<br />

brokering and transit of dual use<br />

items, into line with latest<br />

developments of international<br />

regimes relevant to the control of<br />

exports of dual use goods and<br />

technologies.! There are 4 such<br />

regimes at the moment, the<br />

Wassenaar Arrangement on<br />

Export Controls for Conventional<br />

Arms and Dual-Use Goods and<br />
