INTRODUCTION<br />

<strong>John</strong> <strong>Amos</strong> & <strong>Co</strong> are delighted to have been<br />

instructed to offer approximately 237 acres of<br />

productive agricultural land suitable for pasture or<br />

arable cropping available to Let for a period of 3<br />

years from the 15 th September 2013.<br />

DESCRIPTION<br />

This is a superb block of land which lies just to the<br />

West of the A466 Hereford to Monmouth road.<br />

The majority of the land is gently undulating with<br />

some sloping land parcels. The land has been<br />

farmed well and contains a number of recently<br />

reseeded and temporary grass leys. At present,<br />

there are three fields of arable with the remainder<br />

in a pasture rotation used for the purpose of<br />

grazing livestock. It should be stressed that the<br />

majority of the land is available for arable cropping.<br />

The land is generally well fenced throughout.<br />

Fields 8565, 9343, 1098 and 8527 will retain a<br />

small area for use as a game cover crop and the<br />

Landlord will retain a right of unrestricted access to<br />

these areas.<br />

All of the land has been in either an arable or<br />

pasture rotation for a number of year Please note<br />

the area stated in these particulars are based on<br />

the present croppable area and the cover crops<br />

have been deducted from the schedule<br />

accordingly.<br />

ACCESS<br />

The land is relatively easy to access off the A466<br />

and also via its privately owned secondary track<br />

located to the rear of Llancloudy Chapel (as<br />

indicated on the plan). Please note when viewing<br />

the land, to use the secondary track located to the<br />

rear of the Chapel and not the private driveway<br />

located at the top of Llancloudy hill.<br />

SINGLE FARM PAYMENT<br />

The Single Farm Payments will be retained by the<br />

Landowner and claimed by the Landowner.<br />

SPORTING, TIMBER AND MINERAL RIGHTS<br />

All sporting rights, including fishing, timber and<br />

mineral rights as they may be owned are retained<br />

by the Owner.<br />

EASEMENTS, WAYLEAVES & RIGHTS OF WAY<br />

The land will be let subject to and with the benefit<br />

of all existing rights, whether public or private<br />

including rights of way, supply, drainage, electricity<br />

supplies and other rights, covenants, restrictions<br />

and obligations, quasi-easements and all<br />

wayleaves whether referred to in these particulars<br />

or not.<br />

TERM<br />

This is a three year Agreement from the 15 th<br />

September 2013.<br />

CROPPING RESTRICTIONS<br />

There are largely no arable cropping restrictions on<br />

the land. A crop of potatoes is permitted subject to<br />

prior consent with the Landlord within the rotation.<br />

SERVICES<br />

We are informed that the land benefits from mains<br />

water supply, to be metered.<br />

METHOD OF LEASE<br />

The land is offered To Let by Tender with Tenders<br />

closing by 12 noon on Monday 19 th August 2013.<br />

All Tenders are to be completed and delivered to<br />

PAYMENT<br />

The rental will be payable in two equal installments<br />

in advance on the 15 th September and 1 st March in<br />

DIRECTIONS<br />

From Hereford – take the A49 South towards Ross on Wye / Monmouth. At the top of Callow Hill, turn right onto<br />

the A466 signposted Monmouth, Wormelow. <strong>Co</strong>ntinue along the A466 for approximately 8 miles passing through<br />

the village of Llancloudy and continuing up a steep hill, where the land is located on your right hand side as<br />

indicated by the Agent’s To Let boards.<br />

CONDITIONS OF SALE<br />

1. All tenders must be submitted in writing to <strong>John</strong> <strong>Amos</strong> at <strong>John</strong> <strong>Amos</strong> & <strong>Co</strong>., Lion <strong>Co</strong>urt, Broad Street,<br />

Leominster, Herefordshire, HR6 8LE. Tel: 01568 610007 ~ Fax: 01568 611555. Tenders must arrive<br />

at the above office NO LATER THAN 12 noon prompt on Monday 19 th August 2013 and should be<br />

marked “To Let By Tender ~Land at Hill Farm, Llancloudy.”<br />

2. Please note that, where appropriate, Purchasers may suggest Special Terms or variances to the<br />

<strong>Co</strong>ntract. (Please bear in mind these may affect the decision of the Vendor).<br />

3. The Vendors do not have to accept the highest or any Tender for each Lot respectively.<br />

4. The Purchaser shall be required to insure their crops against damage and loss. The Vendor shall<br />

accept no responsibility whatsoever for any loss, or damage caused due to the occupancy of the land.<br />

5. The Purchaser shall be responsible for any damage to the Vendors’ property caused during the<br />

occupation, accidental or otherwise, including gates, posts, fences, hedges, drains, roads, etc., and<br />

the Purchaser will make good any damage at his expense.<br />

6. The Purchaser shall take all reasonable steps to avoid pollution or nuisance from acts of husbandry<br />

and shall be responsible for any damages or third party claims.<br />

7. The Purchaser agrees to pay the agreed rent at the times specified in the Tenancy Agreement. Failure to<br />

do so may lead to penalty payments or forfeiture of the Lot(s). The Purchaser shall also be responsible for<br />

any shortfall on a re-let, (including costs and commission), but shall not be entitled to any surplus.<br />

8. The Landlords’ rent will not be subject to VAT.<br />

9. If there is a footpath that crosses the land then it is the Tenants responsibility to keep this clear.<br />

10. The Purchaser agrees to leave the land in good heart and in a state fit to replant by the Vendors, (or<br />

his Agents) thereafter.<br />

11 In the event of non-payment of rent as per the agreed time-scales, the Landlord shall reserve the right<br />

to recover the loss of rent and any other reasonable expenses, including legal costs.<br />

12. All Tenderers will be notified in writing within SEVEN DAYS of the closing date. Successful<br />

Purchasers will be required to pay 50% on acceptance and 50% on 1 st March each year.<br />

13. Unless stated otherwise, ALL field sizes given are GROSS area and Purchasers should satisfy for<br />

themselves the area available to be planted, and therefore tender on this basis.<br />

14. The land is available from the 15 th September 2013 terminating on the 31 st August 2016 unless<br />

otherwise stated. Prior entry can be obtained by agreement.<br />

15. The land is let for the growing of pasture or arable crops as defined in the particulars.<br />

16. The Single Farm Payment will remain with the Landowner. A full <strong>Co</strong>ntract will be issued for both<br />

parties to sign prior to commencement.
