Session 4: CE Marking - Applying the CE Mark
The views expressed in this publication do not necessarily reflect the views of the European Commission.

LVD Session 4 Agenda
Concept - What is the CE Mark?
Application to Products
International Certification Schemes
The European Keymark

Concept
CE MARKING IS ABOUT FREE TRADE
Only Equipment That Satisfies the Requirements
Of All Relevant Directives Is Entitled to Free Circulation
Throughout the EU

CE?
No definition found, generally taken to mean:
“Communauté Européene”

What is the CE Mark?
By applying the CE Mark the Manufacturer or
Authorized Representative is claiming compliance with
all relevant directives

A New Approach:
Making the Manufacturer responsible for affixing the
CE-Mark
“New Approach Directives” are current:
Single European Act 1987, Article 100A
CE Marking Directive, 93/68/EEC, unified several
directives

Some European Directives
1990 Simple Pressure Vessels
1992 Personal Protective Equipment
1993 Medical Active Implants
Gas Appliances 90/396/EEC - Weighing Equipment
1995 Machinery Directive 89/392/EEC
1996 EMC 89/336/EEC
1997 Low Voltage Directive 73/23/EEC
1997 Provision & Use of Work Equipment
Etc.

1 Do risk assessment, apply either MD or LVD, if the risk is
predominantly electrical then use LVD
2 If applying MD, then use EN 60204 standard
LVD&EMC procedures available as alternatives to the
R&TTE Directive procedure for EMC and safety. Note:
1 The R&TTE has no voltage limits for compliance safety
2 The LVD procedure may only be used for equipment that
falls within the scope of the LVD

The CE Mark
All the directives require it to be not
less than 5 mm high
(This minimum may be waived for
small-scale machinery under that
directive)

The CE Mark -Detail
Specification from The Amending Directive 93/68/EEC.
If it is enlarged the proportions must be respected.

The CE Mark
Based on a grid of 41 x 24 squares; the
top and bottom arms of C and E
extended by one ‘square’ beyond a semicircle,
& the middle arm of the E stops
one square short
Does this detail matter?

Application of the CE Mark
CE Marking for:
EMC
LVD
There are small differences . . .

Application –EMC (1)
The Manufacturer or his Authorized Representative shall
fix the CE Mark to:
The Apparatus, or
The Packaging, or
The Instructions, or
The Guarantee certificate
Reference EMC Directive 89/336/EEC, Article 10(1)

Application –EMC (2)
Member States shall take the necessary measures to
prohibit the affixing to - apparatus, its packaging, the
instructions & guarantee certificate
Markings which are likely to deceive third parties as
to the meaning & form of the CE marking.
Any other Marking may be affixed . . . provided that the
visibility & legibility of the CE marking is not thereby
reduced
Reference Amending Directive 93/68/EEC Article 5(3)

Application –LVD (1)
The Manufacturer or his Authorized Representative shall
fix the CE Mark to:
The Electrical Equipment
or, failing that, to
The Packaging
The Introduction Sheet {Instructions}, or
The Guarantee certificate
So as to be visible, easily legible and indelible
(indelibility is usually covered in the standards anyway
-the requirements are essentially the same as for EMC)
Reference Amending Directive 93/68/EEC, Article 13(4)

Application –LVD (2)
The affixing on electrical equipment of any
Markings liable to deceive third parties as to the
meaning & form of the CE marking – shall be
prohibited –similar to EMC
Any other marking may be affixed . . . provided that the
visibility & legibility of the CE marking is not thereby
reduced –identical to EMC
Reference Amending Directive 93/68/EEC Article 13(4)

International Certification Schemes (1)
European Scheme test results have been recognized for
over 20 years – Mutual Recognition; Compare Global IEC
Schemes
Based on Testing in 1 st Country Using Commonly Agreed
Standards
Additional Tests Cover National Deviations in 2 nd
Country
1 st Test Report Forms Acceptance Basis in Additional
Countries

International Certification Schemes (2)
Use is to provide Client Confidence
Manufacturer Benefits From An Independent Report
For CE Marking Independent Report Adds Value To The
Manufacturer’s Technical File
The Quality Measures Required Will Normally Meet Or
Exceed CE Requirements
Existing Schemes Cover Both Equipment & Components

The European Keymark (2)
Launched 1997, based on EN 60335
Application through participating bodies
It is a Mark of Conformity with the Standards
Continuous basis
Not a Substitute for CE Marking
Which must be applied when required
Provides Consumer Confidence – Independence
Provides Manufacturer Confidence - Compliance

Other Directives
Voluntary Energy Labelling Schemes
The Community Eco-Label Award Scheme
OJ ref. L 237 21 September 2000
Doesn’t use CE marking
Uses Energy Star

Remember LV Components
E.G. products intended to be incorporated into other
electrical equipment
SHOULD BE CE MARKED

LVD Own Use
UK regulations:
Equipment must comply with the safety objectives
CE Marking need not be applied
Unless it is subsequently placed on the market

Second Hand (Used) Apparatus
UK Rules, Regulation 12: Used Equipment already in
the Community:-
LVD does not apply to used equipment circulating
in the Community which still conforms to the
requirements in force when it was first placed on the
market - DoC & CE marking not required
If used equipment is reconditioned or modified
before return to the Community, the LVD must be
applied - CE marking required
Used Equipment entering or re-entering the EU:
Regardless of origin, is treated as being placed on the
market for the first time, & the LVD applies - CE
marking required

Hired Apparatus
UK Statutory Instrument No. 3260 1994, Consumer
Protection, The Electrical Equipment (Safety) Regulations
1994, Regulation 12.
CE marking not applied
Provided it has been previously supplied to any end user (as
per second hand equipment)

CE Marking is about
Free Trade

Summary
Free Trade is the Motive for CE Marking
CE Marking is NOT a Quality Mark
But Independent Quality Marks are Available Through
International Certification Schemes
Testing is often not Mandatory – But Always Desirable
Apply CE to Product, Packaging, Instructions & Guarantee
The requirements are very similar for EMC & LVD |
