What is the <strong>CE</strong> Mark?<br />
By applying the <strong>CE</strong> Mark the Manufacturer or<br />
Authorized Representative is claiming compliance with<br />
all relevant directives
A New Approach:<br />
Making the Manufacturer responsible for affixing the<br />
<strong>CE</strong>-Mark<br />
“New Approach Directives” are current:<br />

predominantly electrical then use LVD<br />

R&TTE Directive procedure for EMC and safety. Note:<br />
1 The R&TTE has no voltage limits for compliance safety<br />
2 The LVD procedure may only be used for equipment that<br />
falls within the scope of the LVD

Application –EMC (1)<br />
The Manufacturer or his Authorized Representative shall<br />
fix the <strong>CE</strong> Mark to:<br />
The Apparatus, or<br />
The Packaging, or<br />
The Instructions, or<br />
The Guarantee certificate<br />
Reference EMC Directive 89/336/EEC, Article 10(1)
Application –EMC (2)<br />
Member States shall take the necessary measures to<br />
prohibit the affixing to - apparatus, its packaging, the<br />
instructions & guarantee certificate<br />
<strong>Marking</strong>s which are likely to deceive third parties as<br />
to the meaning & form of the <strong>CE</strong> marking.<br />
Any other <strong>Marking</strong> may be affixed . . . provided that the<br />
visibility & legibility of the <strong>CE</strong> marking is not thereby<br />
reduced<br />

Application –LVD (1)<br />
The Manufacturer or his Authorized Representative shall<br />
fix the <strong>CE</strong> Mark to:<br />
The Electrical Equipment<br />
or, failing that, to<br />
The Packaging<br />
The Introduction Sheet {Instructions}, or<br />
The Guarantee certificate<br />
So as to be visible, easily legible and indelible<br />
(indelibility is usually covered in the standards anyway<br />
-the requirements are essentially the same as for EMC)<br />

Application –LVD (2)<br />
The affixing on electrical equipment of any<br />
<strong>Marking</strong>s liable to deceive third parties as to the<br />
meaning & form of the <strong>CE</strong> marking – shall be<br />
prohibited –similar to EMC<br />
Any other marking may be affixed . . . provided that the<br />
visibility & legibility of the <strong>CE</strong> marking is not thereby<br />
reduced –identical to EMC<br />

UK Rules, Regulation 12: Used Equipment already in<br />
the Community:-<br />
LVD does not apply to used equipment circulating<br />
in the Community which still conforms to the<br />
requirements in force when it was first placed on the<br />
market - DoC & <strong>CE</strong> marking not required<br />
If used equipment is reconditioned or modified<br />
before return to the Community, the LVD must be<br />
applied - <strong>CE</strong> marking required<br />
Used Equipment entering or re-entering the EU:<br />
Regardless of origin, is treated as being placed on the<br />
market for the first time, & the LVD applies - <strong>CE</strong><br />
marking required
Hired Apparatus<br />
