What is <strong>CE</strong> <strong>marking</strong>?• The <strong>CE</strong> <strong>marking</strong> <strong>affixed</strong> <strong>to</strong> products is adeclaration by <strong>the</strong> person responsible that– <strong>the</strong> product conforms <strong>to</strong> all applicable Communityprovisions , and– <strong>the</strong> appropriate conformity assessment procedureshave <strong>be</strong>en completed.• Mem<strong>be</strong>r States are obliged <strong>to</strong> take appropriatemeasures <strong>to</strong> protect <strong>the</strong> <strong>CE</strong> <strong>marking</strong>.
<strong>CE</strong> <strong>marking</strong> is a passport• Mem<strong>be</strong>r States are notallowed <strong>to</strong> restrict <strong>the</strong>placing on <strong>the</strong> market andputting in<strong>to</strong> service of <strong>CE</strong>marked products, unlesssuch measures can <strong>be</strong>justified on <strong>the</strong> basis ofevidence of <strong>the</strong> noncomplianceof <strong>the</strong> product.
Facts about <strong>CE</strong> <strong>marking</strong>• Since all products covered by NewApproach directives <strong>be</strong>ar <strong>CE</strong> <strong>marking</strong>, this<strong>marking</strong> is not intended <strong>to</strong> servecommercial purposes.• Nei<strong>the</strong>r is <strong>the</strong> <strong>CE</strong> <strong>marking</strong> a mark of origin,as it does not indicate that <strong>the</strong> product wasmanufactured in <strong>the</strong> Community.
To <strong>be</strong> <strong>CE</strong> marked• all new <strong>lift</strong>s and safety components,whe<strong>the</strong>r manufactured in <strong>the</strong> Mem<strong>be</strong>r Statesor in third countries;• used and second hand <strong>lift</strong>s and safetycomponents imported from third countries;and• substantially modified <strong>lift</strong>s and safetycomponents that are subject <strong>to</strong> directives asnew products.
Size of <strong>CE</strong> and ID num<strong>be</strong>rs• vertical dimension should not <strong>be</strong> less than 5mm.• should <strong>be</strong> followed by <strong>the</strong> identificationnum<strong>be</strong>r of <strong>the</strong> notified body when this isinvolved in <strong>the</strong> production phase of <strong>the</strong>safety component (Art 8(1) (ii) or (iii)) orinstallation of a <strong>lift</strong> (Art 8(2)).(ANNEX III)
Commission Working group on <strong>lift</strong>s(February 2004)Should <strong>the</strong> <strong>lift</strong>s directive apply if <strong>every</strong>thing isreplaced in a <strong>lift</strong> but not <strong>the</strong> guides (rails):• NO - claim some Mem<strong>be</strong>r States: this isonly a maintenance and <strong>the</strong> directive doesnot apply.• YES - claims vast majority of Mem<strong>be</strong>rStates: this is substantial modification and<strong>the</strong> <strong>lift</strong>s directive applies.
<strong>Must</strong> <strong>the</strong> <strong>CE</strong> <strong>marking</strong> <strong>be</strong> <strong>affixed</strong><strong>to</strong> <strong>every</strong> <strong>lift</strong> <strong>car</strong>?• Yes. <strong>CE</strong> <strong>marking</strong> must <strong>be</strong> <strong>affixed</strong> <strong>to</strong> <strong>every</strong><strong>lift</strong> <strong>car</strong> distinctly and visibly in accordancewith Section 5 of Annex I and shall <strong>be</strong><strong>affixed</strong> on each of <strong>the</strong> safety componentslisted in Annex IV or, where that is notpossible on a la<strong>be</strong>l inseparably attached <strong>to</strong><strong>the</strong> safety component (Art 10(2))
<strong>Must</strong> <strong>CE</strong> <strong>marking</strong> <strong>be</strong> on <strong>the</strong> product• The <strong>CE</strong> <strong>marking</strong> shall <strong>be</strong>, as a rule, <strong>affixed</strong> <strong>to</strong><strong>the</strong> product or <strong>to</strong> its data plate.• In addition, it can <strong>be</strong> <strong>affixed</strong>, for instance, <strong>to</strong> <strong>the</strong>packaging or <strong>to</strong> <strong>the</strong> accompanying documents.• It may exceptionally <strong>be</strong> moved from <strong>the</strong> produc<strong>to</strong>r its data plate if this rule cannot <strong>be</strong> followed(justified where affixing it <strong>to</strong> <strong>the</strong> product wasimpossible, for example on certain type ofexplosives, or not possible under reasonabletechnical or economic conditions, or where <strong>the</strong>minimum dimensions could not <strong>be</strong> respected.
<strong>CE</strong> <strong>marking</strong> and <strong>the</strong> num<strong>be</strong>r• The <strong>CE</strong> <strong>marking</strong> shall only <strong>be</strong> followed by <strong>the</strong>identification num<strong>be</strong>r of <strong>the</strong> notified body if it isinvolved in <strong>the</strong> production phase.• The identification num<strong>be</strong>r of a notified bodyinvolved in conformity assessment according <strong>to</strong>module B does not follow <strong>the</strong> <strong>CE</strong> <strong>marking</strong>.• The <strong>CE</strong> <strong>marking</strong> and <strong>the</strong> identification num<strong>be</strong>rcan also <strong>be</strong> <strong>affixed</strong> separately, as long as <strong>the</strong>yremain combined.
May <strong>CE</strong> <strong>marking</strong> <strong>be</strong> <strong>affixed</strong> inthird country?• The <strong>CE</strong> <strong>marking</strong> and <strong>the</strong> identificationnum<strong>be</strong>r of <strong>the</strong> notified body do notnecessarily have <strong>to</strong> <strong>be</strong> <strong>affixed</strong> within <strong>the</strong>Community.• They may <strong>be</strong> <strong>affixed</strong> in a third country, forexample if <strong>the</strong> product is manufactured<strong>the</strong>re and <strong>the</strong> notified body <strong>car</strong>ried outconformity assessment in accordance with<strong>the</strong> directive in that country.
