What is CE marking?• The CE marking affixed to products is adeclaration by the person responsible that– the product conforms to all applicable Communityprovisions , and– the appropriate conformity assessment procedureshave been completed.• Member States are obliged to take appropriatemeasures to protect the CE marking.

CE marking is a passport• Member States are notallowed to restrict theplacing on the market andputting into service of CEmarked products, unlesssuch measures can bejustified on the basis ofevidence of the noncomplianceof the product.

Facts about CE marking• Since all products covered by NewApproach directives bear CE marking, thismarking is not intended to servecommercial purposes.• Neither is the CE marking a mark of origin,as it does not indicate that the product wasmanufactured in the Community.

To be CE marked• all new lifts and safety components,whether manufactured in the Member Statesor in third countries;• used and second hand lifts and safetycomponents imported from third countries;and• substantially modified lifts and safetycomponents that are subject to directives asnew products.

Size of CE and ID numbers• vertical dimension should not be less than 5mm.• should be followed by the identificationnumber of the notified body when this isinvolved in the production phase of thesafety component (Art 8(1) (ii) or (iii)) orinstallation of a lift (Art 8(2)).(ANNEX III)

Commission Working group on lifts(February 2004)Should the lifts directive apply if everything isreplaced in a lift but not the guides (rails):• NO - claim some Member States: this isonly a maintenance and the directive doesnot apply.• YES - claims vast majority of MemberStates: this is substantial modification andthe lifts directive applies.

Must the CE marking be affixedto every lift car?• Yes. CE marking must be affixed to everylift car distinctly and visibly in accordancewith Section 5 of Annex I and shall beaffixed on each of the safety componentslisted in Annex IV or, where that is notpossible on a label inseparably attached tothe safety component (Art 10(2))

Must CE marking be on the product• The CE marking shall be, as a rule, affixed tothe product or to its data plate.• In addition, it can be affixed, for instance, to thepackaging or to the accompanying documents.• It may exceptionally be moved from the productor its data plate if this rule cannot be followed(justified where affixing it to the product wasimpossible, for example on certain type ofexplosives, or not possible under reasonabletechnical or economic conditions, or where theminimum dimensions could not be respected.

CE marking and the number• The CE marking shall only be followed by theidentification number of the notified body if it isinvolved in the production phase.• The identification number of a notified bodyinvolved in conformity assessment according tomodule B does not follow the CE marking.• The CE marking and the identification numbercan also be affixed separately, as long as theyremain combined.

May CE marking be affixed inthird country?• The CE marking and the identificationnumber of the notified body do notnecessarily have to be affixed within theCommunity.• They may be affixed in a third country, forexample if the product is manufacturedthere and the notified body carried outconformity assessment in accordance withthe directive in that country.
