7. Time for Receiving Bids<br />

Sealed bids shall be deposited at the address specified on the <strong>IFB</strong> of the sponsor no later than the exact time and date indicated<br />

on the face of this <strong>IFB</strong>. Bids received prior to the time of opening will be securely kept, unopened.<br />

8. Error in Bids<br />

Bidders or their authorized representatives are expected to fully inform themselves as to the conditions, requirements and<br />

specifications before submitting bids; failure to do so shall be at the bidder’s own risk and he/she cannot secure relief on the plea<br />

of error.<br />

9. Bonding Requirements<br />

A. Bid Bond: Bidder shall submit with his bid a bid bond in the amount of *_5 percent__ of the value of the contract. Bid<br />

bonds will be returned to the successful bidder upon execution of such further contractual documents.<br />

B. Performance Bond: The successful contractor shall provide the Sponsor with a performance bond in the amount of 10<br />

percent of the contract price. The bond shall be furnished not later than ten days following the award of the contract.<br />

The bid bond and performance bond must be obtained from one of the companies listed in the Department of<br />

Treasury Circular 570.<br />

* (This amount must be not less than 5 percent nor more than 10 percent. The actual percentage must be determined by the<br />

Sponsor.)<br />

10. Award of Contract<br />

A. The contract will be awarded to the lowest responsible bidder conforming to all material terms and conditions of the Invitation<br />

for Bid. Consideration shall be given to such matters as contractor integrity, compliance with public policy, record of past<br />

performance and financial and technical resources. See the Bidder Responsibility and Bid Responsiveness Criteria included<br />

in this bid packet.<br />

B. The Sponsor reserves the right to reject any or all bids when there are sound documented business reasons in the best<br />

interest of the <strong>Program</strong> and to waive informalities and minor irregularities in bids received.<br />

C. The Sponsor reserves the right to reject the bid of a bidder who has previously failed to perform properly or complete on time<br />

contracts of a similar nature, or the bid of a bidder who investigation shows is not in a position to perform the contract.<br />

11. Late Bids, Modifications of Bids or Withdrawals of Bids<br />

A. Any bid received after the exact time specified for receipt will not be considered.<br />

Bids must be delivered to the Department of Purchasing, 3 rd Floor, on or before the date and time specified. The bidder is<br />

responsible for ensuring timely delivery to the Department of Purchasing. Proposals sent via United States mail or other<br />

delivery services will be considered only if they are received in the Department of Purchasing before the specified time on the<br />

due date. The <strong>Chicago</strong> <strong>Park</strong> <strong>District</strong> does not guarantee that bids received in the building by mail or other delivery services<br />

will be delivered to the Department of Purchasing before the 1:00 p.m. deadline. The Department of Purchasing’s clock<br />

controls the time, not the bidder’s.<br />

B. Any modification or withdrawal of bid is subject to the same conditions as in (A) above. A bid may also be withdrawn in<br />

person by a bidder or his/her authorized representative, provided his/her identity is made known and he/she signs a receipt<br />

for the bid, but only if the withdrawal is made prior to the exact time set for receipt of bids.<br />
