PEOPLE IN THE <strong>PARK</strong>S: (3)<br />

Cecelia Butler, Washington Park Advisory Council, updated the Board on the conditions of the locker<br />

rooms in the field house, and asked for enforcement of parking regulations. Ms. Butler also asked for<br />

permission to post petitions in park district field houses.<br />

Anthony Iniquez, Touhy Park Advisory Council, offered an update on Touhy Park, explaining that the<br />

park looked to be on track. He informed the board of activities planned for the park, including<br />

Shakespeare in the park productions.<br />

Libby Reed, Kilbourn Park Advisory Council, thanked the Board for including the greenhouse upgrades<br />

as part of 2013 Capital Projects. Ms. Reed asked that new fans be installed before the scheduled plant<br />

sale as to not disrupt its fundraising potential.<br />

Mark Carroll, Chicago Rowing Group, suggested that the Park produce a master plan for rowing<br />

development in the park. Mr. Carroll suggested the universities in the city could field rowing teams<br />

and use the Lake Calumet Region or the Lincoln Park lagoon as possible rowing venues.<br />

Elise Denard, Skinner Park Advisory Council, asked the park to consider using concrete rather than<br />

artificial turf in the design of the proposed dog park as turf can become too hot for dogs in the summer.<br />

George Blakemore suggested that Brookfield Zoo, Forest Preserve District, and the Park District form<br />

an agreement to offer a free day to residents to view the elephants.<br />

Vera Louise McCurry, Jackson Park Advisory Council, expressed her concerns for safety in the area<br />

surrounding the Jackson Park Fieldhouse.<br />

Erma Trainer, Friends of the Parks, congratulated the Board on its NRPA certification and also<br />

expressed her concerns for transparency in the negotiations to resurface the artificial turf field in River<br />

Park.<br />

May Toy, Skinner Park Advisory Council, expressed her concerns over the parks assistance with the<br />

design of the proposed dog park.<br />

ORDERED, that the Board of Commissioners of the Chicago Park District (the “Board”) recommends<br />

that the General Superintendent and CEO or his designee enter into a contract with McGladrey, LLP<br />

for the purpose of providing auditing services to the Chicago Park District. The contractor was selected<br />

pursuant to a publicly advertised Request for Proposals (“RFP”). No work may commence and no<br />

payment shall be made to vendor prior to the execution of a written agreement.<br />

That pursuant to requests for proposals or sealed competitive bids heretofore advertised, received, and<br />

opened, publicly read aloud, or Non-Competitive Procurement, Chapter XI, Section D (1), of the Chicago<br />

Park District Code and referred to the Committee for recommendation of award, in accordance with the<br />

provisions of the Code of the Chicago Park District, the following are hereby determined to be either<br />

the lowest responsible bidder, or the most qualified proposer, proposing to furnish the supplies,<br />

materials, equipment and services provided for in the respective specifications and in accordance with<br />

the prices, terms, and conditions of the awardee’s proposal or bid.<br />

Vice President Armstrong moved that the matter be adopted.<br />

AUTHORITY TO ENTER INTO INTERGOVERNMENTAL AGREEMENTS WITH THE CITY OF<br />

<strong>CHICAGO</strong> TO ACCEPT THE TRANSFER OF VARIOUS FUNDS FOR <strong>PARK</strong> PROJECTS: (6)<br />

ORDERED, that the Board of Commissioners of the Chicago Park District (the “Board”) enter an order<br />

authorizing the acceptance of funds from the City of Chicago from various funding sources, including<br />

but not limited to those funds derived from: Tax Increment Financing (TIF), Open Space Impact Fees<br />

(OSIF), the Aldermanic Menu Program, (Menu), bonds, settlements or judgments, or grants,<br />

(collectively referred to as the “City Funds”). These City Funds will be applied toward the payment or<br />

reimbursement of the development, renovation and acquisition costs of various Park District property<br />

or projects. It is further recommended that the Board authorize the General Superintendent, or his<br />

designee, to negotiate, enter into, and execute any such agreements, amendments, indemnities, and<br />

instruments necessary to obtain these City Funds and to perform any and all acts as shall be necessary<br />

or advisable in connection with the transactions described herein for the remainder of 2013 calendar<br />

year.<br />

AMENDMENT TO CHAPTER III OF THE CODE OF THE <strong>CHICAGO</strong> <strong>PARK</strong> DISTRICT: (7)<br />

ORDERED, that the Board of Commissioners of the Chicago Park District (the “Board”) grant authority<br />

to amend Section C of Chapter III of the Code of the Chicago Park District to allow electronic filing of<br />

economic financial statements directly with the Cook County Clerk and to eliminate the filing<br />

requirement to the Chicago Park District Ethics Officer.<br />

Ordinance can be found attached to this document as Exhibit A on pages 150-156 of the Regular<br />

Meeting held on January 16, 2013.<br />

The Committee on Programs and Recreation met on January 16, 2013 to discuss matters referred from<br />

AUTHORITY TO AMEND THE GRANT AGREEMENT WITH THE GARFIELD <strong>PARK</strong><br />

CONSERVATORY ALLIANCE: (8)<br />

ORDERED, that the Board of Commissioners of the Chicago Park District (the “Board”) recommends<br />

that the General Superintendent and CEO or his designee negotiate and enter into an amendment to<br />

the existing grant agreement with the Garfield Park Conservatory Alliance (the “Alliance”). The<br />

Alliance was established to raise private funds to support the creation, restoration and conservation of<br />

Park District facilities at Garfield Park Conservatory and the expansion of associated programs. The<br />

proposed amendment will: (i) increase the amount of the annual grant from $180,000 to $200,000 per<br />

year starting in 2014; (ii) extend the term of the current agreement by three years; (iii) permit the<br />

annual exhibit maintenance allowance to be used for exhibit preparation work; and (iv) increase the<br />

operations funding for greeter and janitorial services to $227,000 annually with an annual increase of<br />

2% or the equivalent of the CPI percent increase, whichever is smaller. The amendment will also<br />

include any provisions necessary to comply with applicable tax-exempt bond regulations.<br />

The proposed general admission fee increase is to take effect on January 23, 2013. The museum has<br />

not increased its fees since January 2010.<br />

adopt an order authorizing an increase in the general admission fees of the Art Institute of Chicago<br />

(AIC). The proposed general admission fee increase is to take effect on February 1, 2013. This will be<br />

the third change in admission pricing over the past ten years, and it has been nearly four years since<br />

the last increase.<br />

AUTHORIZATION TO ISSUE FINAL PAYMENT FOR WORK COMPLETED IN CONNECTION<br />

WITH EUGENE FIELD AND WELLES <strong>PARK</strong>S ADA TRANSITION PLAN: (11)<br />

ORDERED, that the Board of Commissioners of the Chicago Park District (the “Board”) recommends<br />

that the General Superintendent and CEO or his designee to approve Final Payment in favor of<br />

Burling Builders, Inc. Burling Builders Inc. on December 5, 2012 completed in a satisfactory manner<br />

and in full compliance with the terms and conditions of the contract, all work in connection with<br />

Eugene Field and Welles Parks-ADA Transition Plan.<br />

ORDINANCE<br />

WHEREAS, the Chicago Park District (the “Park District”) is a body politic and<br />

corporate, and unit of local government created pursuant to the Chicago Park District Act, 70<br />

ILCS 1505/0.01 et seq., as amended (the “Act”); and<br />

WHEREAS, under the Act, the Park District may establish by ordinance all needful rules<br />

and regulations for the government and protection of parks; and<br />

WHEREAS, the Park District desires to amend Chapter III, Section C of the Code of the Chicago Park<br />

District to allow electronic filing of economic financial statements directly with the Cook County Clerk and to<br />

eliminate the filing requirement to the Chicago Park District Ethics Officer; and<br />

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE<br />

<strong>CHICAGO</strong> <strong>PARK</strong> DISTRICT:<br />

SECTION 1. The above recitals are expressly incorporated in and made part of this ordinance as<br />

though fully set forth herein.<br />

SECTION 2. Section C of Chapter III of the Code of the Chicago Park District is hereby amended by<br />

making the changes identified in the enclosed Exhibit A.<br />

SECTION 3. To the extent that the Code of the Chicago Park District or any ordinance, resolution,<br />

rule, order or provision of the Park District, or part thereof, is in conflict with the provisions of this ordinance,<br />

the provisions of this ordinance shall govern and control to the extent necessary to effectuate the purpose of this<br />

ordinance.<br />

SECTION 4. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the<br />

invalidity of such section, paragraph, clause or provision shall not affect any other provisions of this ordinance.<br />

SECTION 5. This ordinance shall take effect and be in full force from and after its passage.

EXHIBIT A<br />

C. 1. Statement of Financial Interests<br />

a. For purposes of this Code, the following persons shall be referred to as<br />

“Reporting Individuals”:<br />

(i) Each Commissioner;<br />

(ii) Each Employee who is compensated for services as an Employee at a<br />

rate of $50,000 per year, but not including those individuals who earn<br />

more than $50,000 per year due to compensation for overtime hours<br />

worked; and<br />

(iii) Any other person including Park District Employees who become<br />

reporting individuals because they are newly hired or are receiving a pay<br />

increase, or a newly appointed Commissioner.<br />

(ii) Persons who are employed by the Park District and are compensated<br />

for services as employees and not as independent contractors and who:<br />

(1) are or function as, the head of a department, division, bureau,<br />

authority or administrative unit within the Park District, or who<br />

exercise similar authority within the Park District;<br />

(2) have direct supervisory authority over, or direct responsibility for<br />

the formulation, negotiation, issuance or execution of contracts entered<br />

into by the Park District in the amount of $1,000 or greater;<br />

(3) have authority to approve licenses and permits by the Park District;<br />

this item does not include employees who function in a ministerial<br />

capacity;<br />

(4) adjudicate, arbitrate, or decide any judicial or administrative<br />

proceeding, or review the adjudication, arbitration or decision of any<br />

judicial or administrative proceeding within the authority of the Park<br />

District;<br />

(5) have authority to issue or promulgate rules and regulations within<br />

areas under the authority of the Park District; or<br />

(6) have supervisory responsibility for 20 or more employees of the<br />

Park District.

b. Each Reporting Individual shall file with the Park District’s Ethics Officer Cook<br />

County Clerk by May 1 of each year a verified written Statement of Financial<br />

Interests for the previous calendar year in accordance with the provisions of this<br />

section, unless he/she has already filed a statement in that calendar year. A<br />

Statement of Financial Interests is considered filed when it is properly completed<br />

and received by the Ethics Officer.<br />

c. Statements of Financial Interests shall also be filed by the following:<br />

(1) a person whose appointment to office is subject to approval or<br />

advice and consent by the Board at the time when his/her name is<br />

submitted to the Board for consideration; and<br />

(2) any other person at the time he/she becomes a Reporting<br />

Individual, including Park District Employees who become<br />

Reporting Individuals because they are newly hired or are<br />

receiving a job or title change.<br />

a. The Director of the Department of Human Resources, the Comptroller’s Office<br />

and the General Superintendent’s Office shall cooperate with the Ethics Officer in<br />

notifying persons listed in subsection (a) of this section of their obligation to file<br />

Statements of Financial Interests and in effecting the filing of such statements.<br />

C. 2. Designation of Reporting Individuals.<br />

On or before January 15 February 1 of each year, the Director of the Department of<br />

Human Resources chief administrative officer, or his or her designee, of the Park District<br />

shall deliver to the General Superintendent the appropriate county clerk a list, including<br />

name and title, of each Employee designated as a Reporting Individual. In preparing this<br />

list, the Director of the Department of Human Resources chief administrative officer, or<br />

his or her designee, shall set out the names in alphabetical order and shall file a copy of<br />

the list with the Ethics Officer.<br />

C. 3. Content of Statements.<br />

Statements of Financial Interests shall contain the following information:<br />

a. The name, address, and type of practice of any professional, business or other<br />

organization (other than the Park District) or individual professional practice in<br />

which the Reporting Individual was an officer, director, associate, partner,<br />

proprietor or employee, or served in any advisory capacity, and from which any<br />

income in excess of $2,500 $1,200 was derived during the preceding calendar<br />

year;<br />

b. The nature of any professional, business or other services rendered by the<br />

Reporting Individual or by his or her spouse, or by any entity in which the

Reporting Individual or his or her spouse has a Financial Interest, and the name<br />

and nature of the person or entity (other than the Park District) to whom or to<br />

which such services were rendered, if during the preceding calendar year:<br />

(1) compensation in excess of $5,000 was received for professional<br />

services by the Reporting Individual; and<br />

(2) the person was Doing Business with the Park District.<br />

c. The identity of any capital asset, including the address or legal description of real<br />

estate, from which the Reporting Individual realized a capital gain of $5,000 or<br />

more in the preceding calendar year other than from the sale of the Reporting<br />

Individual's principal place of residence.<br />

d. The name of any unit of government, other than the Park District, which<br />

employed the Reporting Individual during the preceding calendar year.<br />

e. The name of any person from whom the Reporting Individual received during the<br />

preceding calendar year one or more gifts or honoraria having an aggregate value<br />

in excess of $500, but not including gifts from Relatives.<br />

f. The name of an instrument of ownership in any legal entity conducting business<br />

within the geographic boundaries of Chicago, in which the Reporting Individual<br />

had a Financial Interest during the preceding calendar year. Ownership interests<br />

representing less than five percent of the stock in publicly held corporations need<br />

not be disclosed.<br />

g. The identity of any Financial Interest in real estate located within the geographic<br />

boundaries of Chicago, other than the principal place of residence of the<br />

Reporting Individual, and the address or, if none, the legal description of the real<br />

estate, including all forms of direct or indirect ownership such as partnerships or<br />

trusts of which the corpus consists primarily of real estate.<br />

h. The name of, and the nature of the Park District action requested by, any entity<br />

which has applied to the Park District for a concession or any permit to conduct<br />

any business activity during the preceding calendar year, if the Reporting<br />

Individual had a Financial Interest in such entity.<br />

i. The name of any person or entity Doing Business with the Park District in relation<br />

to which the Reporting Individual had a Financial Interest during the preceding<br />

calendar year, and the title or description of any position held by the Reporting<br />

Individual in such person or entity.<br />

j. The name and instrument of all debts in excess of $5,000 owed by the Reporting<br />

Individual, as well as the name and instrument of all debts in excess of $5,000<br />

owed to the Reporting Individual, but only if the creditor or debtor, respectively,

or any guarantor of the debt, had done work for or business with the Park District<br />

in the preceding calendar year. Debt instruments issued by financial institutions<br />

whose normal business includes the making of loans or the kind received by the<br />

Reporting Individual, and which are made at the prevailing rate of interest and in<br />

accordance with other terms and conditions standard for such loans at the time the<br />

debt was contracted need not be disclosed. Debt instruments issued by publicly<br />

held corporations, and purchased by the Reporting Individual on the open market<br />

at the price available to the public, need not be disclosed.<br />

C. 4. Form for Statements of Financial Interests<br />

The Statement of Financial Interests required to be filed with the Ethics Officer Cook<br />

County Clerk shall be completed by typewriting, legible hand printing, or in electronic<br />

form if available, and shall be verified, dated and signed by the Reporting Individual<br />

personally. It shall be submitted on a form prescribed by the Ethics Officer.<br />

C. 5. Filing of Statements.<br />

a. Not later than February May 1 of each year a statement must be filed by each<br />

person whose position at that time subjects him to the filing requirements of C.1.<br />

unless he has already filed a statement in relation to the Park District in that<br />

calendar year. the General Superintendent shall certify to the Ethics Officer a list<br />

(current as of the prior January 1) of the names and mailing addresses of the<br />

persons, and electronic mail addresses described in this chapter, Section C.1,<br />

above, who are required to file a Statement of Financial Interests.<br />

b. Not later than March 1 of each year, the Ethics Officer shall in writing, by hand<br />

delivery to the employee, or in electronic form to the employee’s reported<br />

electronic mail address notify all persons required to file Statements of Financial<br />

Interests under this section by properly stamped United States Mail to such<br />

persons' home address or electronic mail address.<br />

c. The Ethics Officer shall deliver a receipt to each person who files a statement<br />

under this section, indicating that the person has filed such statement and the date<br />

of such filing.<br />

d. All Statements of Financial Interests shall be available for examination and<br />

duplication by the public in the office of the Ethics Officer during the regular<br />

business hours of the Ethics Officer, except as otherwise provided by law. Each<br />

person examining or requesting duplication of a Statement of Financial Interests<br />

must first complete a request form prepared by the Ethics Officer. The request<br />

form shall include the name, occupation, employer, address, and telephone<br />

number of the examiner as well as the date of and reasons for such examination or<br />

duplication. A separate request form must be completed for each Statement of<br />

Financial Interests to be examined. Requests for the examination or duplication of<br />

a Statement of Financial Interests shall be available in the office of the Ethics<br />

Officer. The Ethics Officer shall promptly notify each person required to file a

Statement of Financial Interests of each examination or duplication of his/her<br />

statement by sending to such person a copy of the completed request form. Costs<br />

of duplicating the Statement of Financial Interests shall be paid by the persons<br />

requesting duplication.<br />

e. No person shall use for any commercial or fund raising purposes information<br />

contained or copied from Statements of Financial Interests required to be filed by<br />

this chapter or from lists compiled from such statements.<br />

C. 6. Failure to File Statement by Deadline<br />

a. If any person who is required to file a Statement of Financial Interest by May 1 of<br />

any year fails to file such a statement, the Ethics Officer shall by May 15, notify<br />

such person by certified mail, hand delivery, or electronic mail delivery of his/her<br />

failure to file by the specified date. Such person shall file his/her statement on or<br />

before May 31. Failure to file the statement by May 31 shall constitute a violation<br />

of this chapter, except as provided in this chapter, Section C.6.b, below.<br />

a. If any person who is required to file a Statement of Financial Interests fails to file<br />

such statement by May 1 of any year, the officer with whom such statement is to<br />

be filed shall, within 7 days after May 1, notify such person by certified mail of<br />

his or her failure to file by the specified date. Except as may be prescribed by rule<br />

of the Secretary of State, such person shall file his or her Statement of Financial<br />

Interests on or before May 15 with the appropriate officer, together with a $15<br />

late filing fee. Any such person who fails to file by May 15 shall be subject to a<br />

penalty of $100 for each day from May 16 to the date of filing, which shall be in<br />

addition to the $15 late filing fee specified above. Failure to file by May 31 shall<br />

result in a forfeiture.<br />

b. Any person who takes office or otherwise becomes required to file a Statement of<br />

Financial Interests within 30 days prior to May 1 of any year may file his or her<br />

statement at any time on or before May 31 without penalty. If such person fails to<br />

file such statement by May 31, the officer with whom such statement is to be filed<br />

shall, within 7 days after May 31, notify such person by certified mail of his or<br />

her failure to file by the specified date. Such person shall file his or her Statement<br />

of Financial Interests on or before June 15 with the appropriate officer, together<br />

with a $15 late filing fee. Any such person who fails to file by June 15 shall be<br />

subject to a penalty of $100 per day for each day from June 16 to the date of<br />

filing, which shall be in addition to the $15 late filing fee specified above. Failure<br />

to file by June 30 shall result in a forfeiture.<br />

c. All late filing fees and penalties collected pursuant to this Section shall be paid<br />

into the General Revenue Fund in the State treasury, if the Secretary of State<br />

receives such statement for filing, or into the general fund in the county treasury,<br />

if the county clerk receives such statement for filing. The Attorney General, with<br />

respect to the State, and the several State's Attorneys, with respect to counties,

shall take appropriate action to collect the prescribed penalties. Failure to file a<br />

Statement of Financial Interests within the time prescribed shall not result in a<br />

fine or ineligibility for, or forfeiture of, office or position of employment, as the<br />

case may be; provided that the failure to file results from not being included for<br />

notification by the appropriate agency, clerk, secretary, officer or unit of<br />

government, as the case may be, and that a statement is filed within 30 days of<br />

actual notice of the failure to file.<br />

b. Any person who first becomes subject to the requirement to file a Statement of<br />

Financial Interests within thirty days prior to May 1 of any year shall be notified<br />

at that time by the Ethics Officer of the obligation to file and shall file his<br />

statement at any time on or before May 31 without penalty. If such person fails to<br />

file such statement by May 31, the Ethics Officer shall, within 7 days after May<br />

31, notify such person by certified mail of his/her failure to file by the specified<br />

date. Such person shall file his Statement of Financial Interests on or before June<br />

15, along with a late filing fee of $20.00, with the Ethics Officer. Failure to file by<br />

June 15 shall constitute a violation of this chapter, except as provided in<br />

subsection 6.c.<br />

c. Any person who is required to file a Statement of Financial Interests may obtain<br />

one thirty-day extension of time for filing the statement by filing with the Ethics<br />

Officer, not less than ten days before the date on which the statement is due, a<br />

declaration of his/her intention to defer the filing of statement. Failure to file by<br />

that date shall constitute a violation of this chapter. A declaration of intention to<br />

defer filing is considered filed upon receipt by the Ethics Officer.
