MINUTES OF THE SPECIAL COUNCIL MEETING OF THE BREEDE VALLEY 

MUNICIPALITY HELD ON 18 DECEMBER 2012 IN THE COUNCIL CHAMBER, 

First Floor, Civic Centre, Baring Street, WORCESTER.

1. OPENING 

P.N. 411 / 1988 Standard By-law Relating to the Procedure and the Maintenance of Order at Meetings 

2. Commencement of meeting council 

At each meeting of council the chair shall be taken precisely at the time for which the meeting is convened and the 

business of the meeting shall be proceeded with immediately. 

37. Quorum 

Whenever during a meeting of the council there is no quorum, the chairman shall cause the division bells to be rung for 

one minute, and if within four minutes thereafter there is still no quorum, the names of the councillors present shall be 

called by the town clerk and entered in the minutes, and the chairman shall declare the meeting to be closed. 

At 9:30 the Speaker called the meeting to order and asked Cllr. P.G. Smith to open 

in prayer.

2. CONSIDERATION OF APPLICATIONS FOR LEAVE OF ABSENCE FROM 

COUNCIL MEETINGS RECEIVED FROM COUNCILLORS 


5. Attendance at meetings 

(1) Every councillor present at a meeting of the council shall sign his name in the attendance register which shall be 

available for that purpose. 

(2) The names of all councillors present at any council or committee meeting and of all councillors to whom leave of 

absence from any such meeting has been granted shall be recorded in the minutes of report or reports relating to 

such meeting. 

2.1 The Attendance Registers will be available at the meeting; 

2.2 A blank Application for Leave of Absence form is enclosed.

6. Minutes 

6.(1) Minutes of the proceedings of every meeting of Council shall be drawn up and printed or typewritten and shall be 

submitted for confirmation at the next ordinary meeting of the council; 

6.(2) The minutes shall be taken as read for the purposes of confirmation if a copy thereof was sent to each councillor at 

least forty-eight hours previously; 

6.(3) Except as to accuracy, no motion or discussion on the minutes shall be permitted; and 

6.(4) A motion of course to correct the minutes shall be permissible and, if carried, the minutes shall be corrected accordingly 

and signed.

The Chairman may without notice make any statement or read any communication at any meeting.

5. INTERVIEWS WITH DEPUTATIONS 


7. Deputations 

(1) A deputation wishing to interview the council shall give the council at least three days’ notice of its intention to do so 

and shall send a memorial to the town clerk setting out briefly the representations to be made and the source of the 

deputation. 

(2) The town clerk shall submit the memorial to the chairman and if the chairman is of the opinion that it should be 

brought before the council, the deputation shall be notified to attend the council meeting. 

(3) The chairman may allow any deputation to wait upon the council without written notice having been given if in his 

opinion the matter to be presented is of an urgent nature. 

(4) A deputation shall not consist of more than ten members. 

(5) Except with the consent of the councillor in reply to questions from councillors, only two members of a deputation 

shall address the council. 

(6) Except with the consent of the council, a member of a deputation shall not address the council for more than ten 

minutes.

7. CONSIDERATION OF AGENDA ITEMS (REPORTS BY COMMITTEES, 

DELEGATES, DEPUTATIONS OR OFFICERS OF THE COUNCIL) 


36. Unopposed business 

(1) When the meeting of the council has been in progress for not less than two hours, the chairman may interrupt the 

proceedings and direct that the council proceed forthwith to dispose of unopposed business. 

(2) After the disposal of such business, the proceedings shall resume at the point at which they were interrupted, unless 

all other remaining business has been adjourned until a future meeting. 

(3) For the purpose of this by-law, an item on the agenda shall be deemed to be opposed business if a councillor 

signifies his intention to discuss such item immediately after the chairman has intimated to the meeting that such item is 

open for discussion; provided that no item shall be deemed to be opposed by reason only of questions being put in 

connection therewith. 

CONFIDENTIAL MATTERS 

In terms of: - 

Section 20. Admission of public to meetings. – (1) (a) & (b) of the Local 

Government: Municipal Systems Act No. 32 of 2000; and Item 4.2.1 of the 

Delegation of Powers and Duties approved by Council on 27 July 2006; 

the Municipal Manager is of the opinion that the disclosure of the items 

marked “Confidential” and or printed on blue paper in the agenda, will not be 

in the interest of the Municipality. 

The public and the press shall therefore be excluded from the proceedings 

while these items are considered. Such ruling may only be overturned by 

Council in-committee. The resolutions regarding these items will be minuted 

separately.
