Board of Education<br />

<strong>Commack</strong> has a five-member Board of Education. The Board of<br />

Education is frequently the closest link between the community and<br />

the school aside from the pupils in the district. Board members are<br />

elected for three-year terms and serve without pay. All regularly<br />

scheduled board meetings are open to the public, and it has always<br />

been the policy in <strong>Commack</strong> to encourage attendance at these<br />

meetings.<br />

The Board of Education sets school policies, approves the appointment<br />

of personnel, adopts budgets, approves courses of study and,<br />

in many instances, must be the final arbiter on many controversial<br />

issues. Both the Board and Superintendent are concerned about an<br />

effective program of communication, and keeping the community<br />

enlightened to the point that understanding and confidence are<br />

engendered in the school program.<br />

Board of Education Meetings<br />

Meetings of the Board of Education are generally held at the Hubbs<br />

Administration Center on Clay Pitts Road, unless otherwise noted<br />

in the calendar or on the Website. Open to the public, most meetings<br />

begin at 8:00 p.m.<br />

The public is invited to attend all Board of Education meetings to<br />

familiarize themselves with the operations of the school district.<br />

Time is allotted at these meetings for residents to directly address<br />

<strong>Directory</strong> <strong>Information</strong> Public Notice<br />

Unless objection to any of the following items of information is submitted<br />

in writing by parents or legal guardians, or by those students themselves<br />

who are over the age of 18 years, the <strong>Commack</strong> School District<br />

hereby gives notice of its intention to provide the release to parent/<br />

teacher associations and representatives of the district's insurance carriers,<br />

entities providing educational, occupational, or career opportunities,<br />

or to publish in the <strong>Commack</strong> Courier, school student newspapers,<br />

magazines, yearbooks, or other publications, daily or weekly newspapers,<br />

athletic programs, musical or theatrical programs, news releases, any and/<br />

or all of the following information pertaining to students as may be appropriate<br />

under the circumstances: name of student, address, age, height,<br />

weight, grade, major field of study, participation in recognized school<br />

activities, extracurricular activities and sports programs, academic honors,<br />

achievements, awards, scholarships and similar information.<br />

Pursuant to federal law, the District is required to provide military recruiters,<br />

upon request, with three directory information categories: name,<br />

address, and telephone listing, unless parents have advised the District<br />

that they do not want their student’s information disclosed without their<br />

prior written consent.<br />

Parents, guardians or students over 18 years of age who object to the<br />

release of directory information should give written notice to the<br />

Superintendent of Schools within 30 days hence. Failure to give written<br />

notice shall be deemed consent.<br />

<strong>Commack</strong> Courier<br />

District news is published during the school year in the <strong>Commack</strong><br />

Courier, which is posted on the <strong>Commack</strong> Website: http://www.commackschools.org,<br />

under Community News. The <strong>Commack</strong> Courier is<br />

also mailed to all District residents, although this year we will have some<br />

issues that will only be available online. Please sign up for Email<br />

Notification to be sure you receive notice when a new issue is posted.


Parents and students note District Regulation 6115 which states:<br />

1. On the days designated as religious holidays by the <strong>Commack</strong> Board<br />

of Education, when school is in session, no standardized tests are to be<br />

administered.<br />

2. A student shall be provided, upon request, with homework assignments,<br />

class instructional materials, etc., if the student intends to be<br />

absent for religious reasons.<br />

3. In the event that a student is absent due to religious reasons, make-up<br />

tests will be provided by the teacher.<br />

4. If a student is absent due to religious reasons, allowance must be<br />

made by the respective teacher for an extension of time to make up<br />

homework.<br />

5. Teachers and administrators shall extend the deadline for any homework<br />

projects or instructional activities when a student observes a religious<br />

holiday, whether it be a day when school is in session or a day<br />

when school is closed. On some religious holidays students are prohibited<br />

from doing homework and other activities and will require extended<br />

time to complete their projects, homework or instructional activities.<br />

<strong>Calendar</strong>. The <strong>Commack</strong> School District assumes parents agree to permit<br />

student’s access to the Internet, and also assumes parents agree to<br />

permit student’s work/photos to be posted on the District Website unless<br />

the parent sends a letter or email to Laura A. Newman (lnewman@commack.k12.ny.us)<br />

P.O. Box 150, <strong>Commack</strong>, NY 11725. The office will<br />

confirm receipt of your email or letter.<br />

Continuing Education<br />

The <strong>Commack</strong> Continuing Education program is offered twice a year,<br />

with classes held at various schools throughout the District. This is a<br />

District sponsored program regulated by the State Department of<br />

Education. A seasonal brochure describing the courses available and locations<br />

of sessions will be sent by mail to all district residents each term.<br />

Student Parking<br />

• Seniors must attend the Driver Safety Program offered by the High<br />

School, accompanied by a parent/guardian to be eligible to leave the<br />

campus either as a driver, passenger, or walker.<br />

• Seniors shall be permitted to park their cars in designated areas only<br />

at the High School.<br />

• Seniors shall be required to obtain a student parking pass from the<br />

• Principal's Office.<br />

• Seniors shall be required to show a sticker and student ID card to the<br />

security guard upon entering the student parking lot.<br />

• The Student Discipline Code shall fully apply to all parts of the High<br />

School campus, including the student parking area and students'<br />

vehicles.<br />

• Use or possession of tobacco, alcohol, drugs, or weapons is strictly<br />

prohibited anywhere on school grounds, including within students'<br />

vehicles while on school grounds.<br />

Voting Eligibility & Registration<br />

Citizens of the United States who are 18 years of age, and have been<br />

residents of the <strong>Commack</strong> School District for 30 days prior to the date of<br />

voting, and are registered on the voter rolls of either the <strong>Commack</strong> School<br />

District or the Suffolk County Board of Elections, may vote in the annual<br />

school district election on Tuesday, May 20, 2014.<br />

New residents who will have lived in the district at least 30 days prior to<br />

the day of voting and who have not voted in a regular or special school<br />

district election, or a general election covered by the Suffolk County<br />

Board of Elections in the past four years, must register in order to vote in<br />

the annual school district election. Registration is held at <strong>Commack</strong> High<br />

School and at <strong>Commack</strong> Middle School on May 8 and May 14, 2014.<br />

School District Voting<br />

All residents who are citizens of the United States and 18 years of age or<br />

older may vote in the annual school district election or special referendum<br />

if they are registered on the school district election rolls or hold current<br />

registration with Suffolk County Board of Elections and have resided<br />

within school district boundaries for 30 days prior to the date of voting.<br />

New residents and those who have not voted in a school district election<br />

or special referendum for four years prior to the date of any vote must<br />

register. Registration dates are published in advance and registration is<br />

conducted at a school site centrally located within each of the school election<br />

districts. Effective September 1, 1975, any person registered as a<br />

voter with the Suffolk County Board of Elections shall be entitled to vote<br />

at all school district meetings and elections without further registration<br />

(N.Y.S. Election Law-Section 352).<br />

Matters on which approval by district voters is required include the<br />

annual school budget, the election of members of the Board of Education,<br />

referendums for land acquisition, school construction or renovation, the<br />

sale of school property or buildings, and special propositions involving<br />

capital expenditures which require the approval of voters.<br />

The Board of Education is empowered by New York State Law to adopt<br />

a contingency budget and establish the necessary tax levy if a regular<br />

budget is not approved by district voters. Under a contingency budget the<br />

dollar increase in the budget is limited. The Board of Education has<br />

wide discretion in determining which items will be eliminated, but cannot<br />

exceed the dollar amount imposed by law.<br />

The estimated cost of a school district vote is approximately $18,000,<br />

which includes the cost of publishing legal notices, printing and postage<br />

for voter information material, rental of voting machines, and salaries for<br />

election clerks involved in registration and voting at each of the two election<br />

districts.

The School Budget & The Tax Rate<br />

The public schools of New York State receive their principal financial support<br />

from two sources: a tax at the local level and State aid. The amount of<br />

State Aid which each school district receives is determined by formulas<br />

having to do principally with the number of school children in average<br />

daily attendance, the value of the District's taxable property, and average<br />

per pupil earnings of District residents.<br />

The school tax levy is established by subtracting the estimated receipts<br />

from State aid and all other sources from the amount which the Board of<br />

Education estimates will be needed for the operation of the schools, and<br />

then computing the ratio at which real estate of the district would have to<br />

be taxed in order to raise the balance.<br />

The qualified voters of the district are asked to authorize the expenditure<br />

of the funds at the annual school district budget vote, which will be held<br />

on Tuesday, May 20, 2014, 6 a.m. - 9 p.m. at <strong>Commack</strong> High School for<br />

residents north of Jericho Turnpike, and at <strong>Commack</strong> Middle School for<br />

residents south of Jericho Turnpike.<br />

After-School Child Care Program<br />

The <strong>Commack</strong> School District and SCOPE (Suffolk County Organization<br />

for the Promotion of Education) provides a financially self-supporting<br />

after-school child care program for children in grades K-5, licensed by<br />

the New York State Department of Social Services. The program will<br />

operate on full school days from dismissal to 6 p.m. at Burr Intermediate<br />

and Mandracchia-Sawmill Intermediate Schools.<br />

Buses will transport children from North Ridge and Indian Hollow<br />

Primary Schools to the Burr site. Children from Rolling Hills and Wood<br />

Park Primary Schools will be transported to the Mandracchia-Sawmill<br />

site.<br />

This program offers a safe, supportive, caring environment for children<br />

of working parents where they may participate in a variety of age-appropriate<br />

activities, including arts and crafts, theme parties, stories, and<br />

games. Children will be given a snack each afternoon and will have an<br />

opportunity to work on homework assignments.<br />

(631) 360-0800 between 9 a.m. and 4:30 p.m. During program hours,<br />

parents may contact the Burr program by calling (631) 235-4722, or<br />

Sawmill at (516) 443-0546.<br />

Medical Services<br />

The school physician is responsible to provide or review physical examinations<br />

of all students participating in athletic activities, or requiring<br />

working papers. A school nurse is on duty at each school to render first<br />

aid. The nurse will contact parents in the event of an emergency in school.<br />

The nurse will also arrange appointments for all examinations. Parents of<br />

elementary (K-5) school students should call the nurse directly if their<br />

child is absent from school. Parents of middle school and high school<br />

students should call their attendance office.<br />

Medication<br />

New York State Law prohibits the taking of any medication by students<br />

during school hours unless the school nurse has been furnished with:<br />

1. Written request from parent, AND<br />

2. Doctor's note stating<br />

a. Name of prescription<br />

b. Reason for taking same<br />

c. Dosage and time to be administered<br />

3. Medication is properly labeled in a bottle from pharmacy.<br />

These requirements apply to aspirin and cough medicine as well as prescription<br />

medication. All medication will be safeguarded in the health<br />

office and dispensed by the school nurse according to written instruction<br />

only. A medication release may be obtained from the nurse's office.<br />

AIDS<br />

(Acquired Immune Deficiency Syndrome) Instruction Exemption<br />

Instruction will be provided about AIDS (Acquired Immune Deficiency<br />

Syndrome), a deadly disease which is transmitted by sexual activity, dirty<br />

syringes and contaminated bloody supplies.<br />

The State Education Department requires that this instruction be provided<br />

to children, K-12, during the school year and that it include information<br />

about the nature of the disease, methods of transmission, and methods of<br />

prevention.<br />

If you feel uncomfortable about having your child instructed in the methods<br />

of prevention of the disease, you may request in writing that your<br />

child be exempt from this portion only, provided that you assure the<br />

Superintendent that you will provide this instruction at home. You should<br />

submit a letter of request directly to your building principal and it must<br />

state how you intend to provide this kind of instruction - at home, or by<br />

some other agent or agency. For further information, please telephone the<br />

Director of Health, Physical Education and Recreation at 912-2080.


Code of Conduct -Condensed Version<br />

I. Introduction<br />

The Board of Education (the “Board”) of the <strong>Commack</strong> UFSD (the “District) is committed<br />

to providing a safe and orderly school environment where students may receive<br />

and District personnel may deliver quality educational services without disruption or<br />

interference. Responsible behavior by students, teachers, other District personnel, parents<br />

and visitors is essential to achieving this goal.<br />

The District has a long-standing set of expectations for conduct on school property and<br />

at school functions. These expectations are based on the principles of civility, mutual<br />

respect, citizenship, character, tolerance, honesty and integrity.<br />

The Board recognizes the need to clearly define these expectations for acceptable conduct<br />

on school property, to identify the possible consequences of unacceptable conduct,<br />

and to ensure that discipline when necessary is administered promptly and fairly. To<br />

this end, the District adopts this Code of Conduct (the “Code”). This document will be<br />

updated on a periodic basis.<br />

Unless otherwise indicated, this Code applies to all students, school personnel, parents<br />

and visitors while on school property or off-campus. Discrimination, harassment, hazing<br />

or bullying that takes place at off-campus locations, which can be reasonably<br />

expected to materially and substantially disrupt the educational process of the school<br />

environment or impinge on the rights of other students, may be subject to disciplinary<br />

consequences.<br />

II. Definitions (see official text)<br />

III. Student Rights and Responsibilities<br />

The District is committed to safeguarding the rights given to all students under state<br />

and federal law. In addition, to promote a safe, healthy, orderly and civil school environment,<br />

all District students have the right to:<br />

1. Take part in all District activities on an equal basis in accordance with the provisions<br />

of the New York State Dignity for All Students Act (DASA).<br />

2. Present their version of the relevant events to school personnel authorized to<br />

impose a disciplinary penalty.<br />

3. Access school rules and, when necessary, receive an explanation of those rules<br />

from school personnel.<br />

4. Students who make a complaint or participate in the investigation of a complaint<br />

in conformity with state law and district policies, who have acted reasonably and<br />

in good faith, have the right to be free from retaliation of any kind.<br />

The Dignity Act states that no student shall be subjected to harassment or discrimination<br />

by employees or students on school property or at a school function based on their<br />

actual or perceived race, color, weight, national origin, ethnic group, religion, religious<br />

practice, disability, sexual orientation, gender, or sex.<br />

The Dignity Act amended Section 801-a of New York State Education Law regarding<br />

instruction in civility, citizenship and character education by expanding the concepts of<br />

tolerance, respect for others, and dignity.<br />

The <strong>Commack</strong> Schools believes that no student shall be subjected to harassment,<br />

intimidation, discrimination or bullying by any school employee or student. All forms<br />

of harassment, intimidation, discrimination or bullying are strictly prohibited and will<br />

not be tolerated on school property and at school functions.<br />

Under the Dignity Act, there are currently 11 protected classes, groups or characteristics.<br />

The Dignity Act prohibits any discrimination based on actual or perceived characteristics.<br />

Individuals in Public Schools in New York State are protected from discrimination,<br />

harassment and persecution on the basis of actual or perceived:<br />

The <strong>Commack</strong> Schools are committed to providing an environment for all students,<br />

employees, volunteers and other stakeholders free from intimidation, harassment, bullying,<br />

cyberbullying, and retaliation, including, but not limited to, electronic, written,<br />

oral or physical acts, either direct or indirect, when such an act:<br />

• Race<br />

• Color<br />

• Weight<br />

• National Origin<br />

• Ethnic Group<br />

• Religion<br />

• Religious practice<br />

• Sex<br />

• Gender<br />

• Sexual Orientation<br />

• Disability<br />

• has or would have the effect of unreasonably and substantially interfering with<br />

a student's educational performance, opportunities or benefits, or mental, emotional<br />

and/or physical well-being; or<br />

• reasonably causes or would reasonably be expected to cause a student to fear for<br />

his or her physical safety. Such conduct shall include, but is not limited to,<br />

threats, intimidation or abuse.<br />

This commitment is an integral part of our comprehensive efforts to promote learning,<br />

and to prevent and eliminate all forms of harassment, intimidation, bullying and other<br />

harmful and disruptive behavior that can impede the learning process.<br />

The <strong>Commack</strong> Schools will not tolerate any unlawful or disruptive behavior, including<br />

any form of bullying, cyberbullying, retaliation, or harassment in our school buildings,<br />

on school grounds, or in school-related activities. We will investigate promptly all

reports and complaints of bullying, cyberbullying, retaliation, and/or harassment and<br />

take prompt action to end that behavior and restore the student’s sense of safety. We<br />

will support this commitment in all aspects of our school community, including within<br />

curricula, instructional programs, staff development, and extracurricular activities.<br />

V. Student Dress Code<br />

All students are expected to give proper attention to personal cleanliness and to dress<br />

appropriately for school and school functions. Students and their parents have the primary<br />

responsibility for acceptable student dress and appearance. Teachers and all other<br />

District personnel should exemplify and reinforce acceptable student dress and help<br />

students develop an understanding of appropriate appearance in the school setting.<br />

A student’s dress, grooming and appearance, including hair style/color, jewelry, makeup<br />

and nails, shall:<br />

1. Be safe, appropriate and not disrupt or interfere with the educational process.<br />

2. Reflect that extremely brief garments, strapless garments, see-through garments,<br />

pajama-like garments and plunging neck lines, front and or back, are not appropriate.<br />

3. Ensure that underwear is completely covered with outer clothing.<br />

4. Shall cover midriff.<br />

5. Include footwear at all times. Footwear that is a safety hazard will not be allowed.<br />

6. Not include the wearing of hats in the classroom, except at building level discretion,<br />

or for a medical or religious purpose. Hoods and sunglasses are prohibited<br />

in the building.<br />

7. Not include or imply items that are vulgar, obscene, or libelous or that denigrate<br />

others on account of race, color, religion, creed, national origin, gender, sexual<br />

orientation or disability.<br />

8. Not promote, endorse or display alcohol, tobacco or illegal drugs and/or encourage<br />

other illegal or violent activities.<br />

VI. Prohibited Student Conduct<br />

The Board of Education expects all students to conduct themselves in an appropriate<br />

and civil manner, with proper regard for the rights and welfare of other students,<br />

District personnel and other members of the school community, and for the care of<br />

school facilities and equipment.<br />

The best discipline is self-imposed, and students must learn to assume and accept<br />

responsibility for their own behavior, as well as the consequences of their misbehavior.<br />

District personnel who interact with students are expected to use disciplinary action<br />

only when necessary and to place emphasis on the students’ ability to grow in selfdiscipline.<br />

VII. Reporting Violations<br />

All students are expected to promptly report violations of the Code to a teacher, guidance<br />

counselor, the building principal or his or her designee. Any student observing a<br />

student possessing a weapon, alcohol or illegal substance on school property or at a<br />

school function shall immediately report this information immediately to a teacher, the<br />

deans’ office, the building principal, the principal’s designee or the superintendent.<br />

All District staff members that are authorized to impose disciplinary sanctions are<br />

expected to do so in a prompt, fair and lawful manner. District staff members that are<br />

not authorized to impose disciplinary sanctions are expected to promptly report violations<br />

of the Code to their supervisor, who shall in turn impose an appropriate disciplinary<br />

sanction, if so authorized, or refer the matter to a staff member who is authorized<br />

to impose an appropriate sanction.<br />

Any weapon, alcohol or illegal substance found shall be confiscated immediately, if<br />

possible. Such action will be followed by notification to the parent of the student<br />

involved and the appropriate disciplinary sanction if warranted, which may include<br />

permanent suspension and referral for prosecution. Administration may contact law<br />

enforcement (police) at their discretion.<br />

VIII. Disciplinary Penalties, Procedures and Referrals<br />

Discipline is most effective when it deals directly with the problem at the time and<br />

place it occurs, and in a way that students view as fair and impartial. School personnel<br />

who interact with students are expected to use disciplinary action only when necessary<br />

and to place emphasis on the students’ ability to grow in self-discipline.<br />

Disciplinary action, when necessary, will be firm, fair and consistent so as to be the<br />

most effective in changing student behavior.<br />

For students with disabilities or for students presumed to have a disability, refer to<br />

section X in this policy regarding discipline procedures (see official text).<br />

IX. Alternative Instruction<br />

When a student of any age is removed from class by a teacher, or a student of compulsory<br />

attendance age is suspended from school pursuant to Education Law §3214, the<br />

District will take immediate steps to provide alternative means of instruction for the<br />

student.<br />

X. Discipline of Students with Disabilities or Students Presumed to have a<br />

Disability for Discipline Purposes<br />

Student with a disability means a student with a disability as defined in section 4401(1)<br />

of the Education Law, who has not attained the age of 21 prior to September 1st and

who is entitled to attend public schools pursuant to section 3202 of the Education Law<br />

and who, because of mental, physical or emotional reasons, has been identified as having<br />

a disability and who requires special services and programs approved by the department<br />

(Part 200.1 (zz) of Part 200 Regulations of the Commissioner of the State of NY).<br />

Student presumed to have a disability for discipline purposes means a student who the<br />

school district is deemed to have knowledge was a student with a disability before the<br />

behavior that precipitated disciplinary action under the criteria in section 201.5(b) of<br />

this Part (Part 201.2 (n) of Part 200 Regulations of the Commissioner of the State of<br />

NY). (see official text)<br />

XI. Corporal Punishment<br />

Corporal punishment is any act of physical force upon a student for the purpose of<br />

punishing that student. Corporal punishment of any student by any District employee<br />

is strictly forbidden.<br />

XII. Student Searches and Interrogations<br />

The Board of Education is committed to ensuring an atmosphere on school property<br />

and at school functions that is safe and orderly. To achieve this kind of environment,<br />

any school official authorized to impose a disciplinary penalty on a student may question<br />

a student about an alleged violation of law or the District Code. Students are not<br />

entitled to any sort of “Miranda”-type warning before being questioned by school<br />

officials, nor are school officials required to contact a student’s parent before questioning<br />

the student. However, school officials will tell all students why they are being<br />

questioned. In addition, the Board authorizes the Superintendent, building principals,<br />

building principal’s designee, the school nurse and District security officials to conduct<br />

searches of students and their belongings if the authorized school official has reasonable<br />

suspicion to believe that the search will result in evidence that the student violated<br />

the law or the District Code (see official text).<br />

XIII. Visitors to the Schools<br />

The Board encourages parents and other District citizens to visit the District’s schools<br />

and classrooms to observe the work of students, teachers and other staff. Since schools<br />

are a place of work and learning, however, certain limits must be set for such visits.<br />

The building principal or his or her designee is responsible for all persons in the building<br />

and on the grounds (see official text).<br />

XIV. Public Conduct on School Property<br />

The District is committed to providing an orderly, respectful environment that is conducive<br />

to learning. To create and maintain this kind of an environment, it is necessary<br />

to regulate public conduct on school property and at school functions. For purposes<br />

of this section of the Code, “public” shall mean all persons when on school property<br />

or attending a school function including students, teachers and District personnel.<br />

The restrictions on public conduct on school property and at school functions contained<br />

in this Code are not intended to limit freedom of speech or peaceful assembly.<br />

The District recognizes that free inquiry and free expression are indispensable to the<br />

objectives of the District. The purpose of this is to maintain public order and prevent<br />

abuse of the rights of others.<br />

All persons on school property or attending a school function shall conduct themselves<br />

in a respectful and orderly manner. In addition, all persons on school property<br />

or attending a school function are expected to be properly attired for the purpose they<br />

are on school property.<br />

No Child Left Behind Act of 2001<br />

The enactment of the No Child Left Behind Act of 2001 requires that each local education<br />

agency (school District) ensure that all Title I Program teachers are highly qualified.<br />

Please be advised that all teachers employed within the Title I Program in the<br />

<strong>Commack</strong> School District meet the New York State qualifications uander Section 1119<br />

for being highly qualified to teach within the program. Parents whose children attend<br />

Program<br />

What are interscholastic sports activities?<br />

Interscholastic sports activities are those which offer enriched<br />

opportunities for the most highly skilled individuals to represent a<br />

school in competition with representatives from the school which<br />

involves season-long schedules, organized practices, league competition,<br />

and championships.<br />

Over the years, <strong>Commack</strong> teams have won league or county championships<br />

in almost every major sport, with a significant number of<br />

athletes individually selected for All-League, All-Conference, or<br />

All-County honors.<br />

The Pesticide Notification Law went into effect July 1, 2001. This<br />

law applies to all instructional and administrative buildings and<br />

grounds, including all playgrounds and athletic fields. All questions<br />

relating to pesticide- related issues should be addressed to Richard<br />

Schramm at 858-3600. The District follows the guidelines of<br />

Integrated Pest Management (IPM). These guidelines provide for<br />

the use of non-chemical procedures to address pest problems. In<br />

situations where IPM is not effective, the District will use chemical<br />

applications. All persons who wish to receive a 48-hour written<br />

advance notification of a pesticide application may register with<br />

the District by completing the 48-hour pesticide notification request<br />

form, located on the <strong>Commack</strong> School District website, and forwarding<br />

Protection of Pupil Rights Amendment<br />

The Protection of Pupil Right Amendment (PPRA) affords parents certain<br />

rights regarding our conduct of surveys, collection and use of information<br />

for marketing purposes, and certain physical exams. These include the<br />

right to:<br />

Consent before students are required to submit to a survey that<br />

concerns one or more of the following protected areas if the survey<br />

is funded in whole or in part by a program of the U.S. Department of<br />

Education:<br />

1. Political affiliations or beliefs of the student or student's parent;<br />

2. Mental or psychological problems of the student or student's<br />

family;<br />

3. Sex behavior or attitudes;<br />

4. Illegal, anti-social, self-incriminating, or demeaning behavior;<br />

5. Critical appraisals of others with whom respondents have close<br />

family relationships;<br />

6. Legally recognized privileged relationships, such as with<br />

lawyers, doctors, or ministers;<br />

7. Religious practices, affiliations, or beliefs of the student or<br />

parents; or<br />

8. Income, other than as required by law to determine program<br />

eligibility.<br />

Receive notice and an opportunity to opt a student out of:<br />

1. Any other protected information survey, regardless of funding;<br />

2. Any non-emergency, invasive physical exam or screening<br />

required as a condition of attendance, administered by the<br />

school or its agenda, and not necessary to protect the immediate<br />

health and safety of a student, except for hearing, vision, or<br />

scoliosis screenings, or any physical exam or screening<br />

permitted or required under State law; and<br />

3. Activities involving collection, disclosure, or use of personal<br />

information obtained from students for marketing or to sell or<br />

otherwise distribute the information to others.<br />

Inspect, upon request and before administration or use:<br />

1. Protected information surveys of students;<br />

2. Instruments used to collect personal information from students<br />

for any of the above marketing, sales, or other distribution<br />

purposes; and<br />

3. Instructional material used as part of the educational<br />

curriculum.<br />

These rights transfer from the parents to a student who is 18 years old or<br />

an emancipated minor under State law.<br />

The District will develop and adopt policies regarding these rights, as<br />

well as arrangements to protect student privacy in the administration of<br />

protected information surveys and the collection, disclosure, or use of<br />

personal information for marketing, sales, or other distribution purposes.<br />

<strong>Commack</strong> School District will notify parents of these policies at least<br />

annually at the start of each school year and after any substantive changes.<br />

<strong>Commack</strong> School District will also directly notify, through U.S. Mail<br />

or email, parents of students who are scheduled to participate in the specific<br />

activities or surveys noted below and will provide an opportunity for<br />

the parent or guardian to opt the student out of participation of the specific<br />

activity or survey. <strong>Commack</strong> Public Schools will make this notification<br />

to parents and guardians at the beginning of the school year if the<br />

District has identified in advance specific or approximate dates of the<br />

activities or surveys at that time. For surveys and activities scheduled<br />

after the school year starts, parents or guardians will be provided reasonable<br />

notification of the planned activities and surveys listed below and be<br />

provided an opportunity to opt the student out of such activities and surveys.<br />

Parents or guardians will also be provided an opportunity to review<br />

any pertinent surveys. Following is a list of the specific activities and<br />

surveys covered under this requirement:<br />

Collection, disclosure, or use of personal information for marketing,<br />

sales or other distribution;<br />

Administration of any protected information survey not funded in<br />

whole or part by the U.S. Department of Education;<br />

Any non-emergency, invasive physical examination or screening as<br />

described above.<br />

Parents or guardians who believe their right have been violated in this<br />

Family Educational Rights & Privacy Act<br />

The Family Educational Rights and Privacy Act (FERPA) affords parents<br />

and students over 18 years of age ("eligible students") certain rights<br />

with respect to the student's education records. These rights are:<br />

1. The right to inspect and review the student's education records<br />

within 45 days of the day the School receives a request for access.<br />

Parents or eligible students should submit to the District Clerk a<br />

written request that identifies the record(s) they wish to inspect. The<br />

District Clerk will make arrangements for access and notify the parent<br />

or eligible student of the time and place where the records may<br />

be inspected.<br />

2. The right to request the amendment of the student's education<br />

records that the parent or eligible student believes are inaccurate or<br />

misleading. Parents or eligible students may ask the School to<br />

amend a record that they believe is inaccurate or misleading. They<br />

should write the District Clerk, clearly identify the part of the record<br />

they want changed, and specify why it is inaccurate or misleading.<br />

If the School decides not to amend the record as requested by the<br />

parent or eligible student, the District clerk will notify the parent or<br />

eligible student of the decision and advise them of their right to a<br />

hearing regarding the request for amendment. Additional information<br />

regarding the hearing procedures will be provided to the parent<br />

or eligible student when notified of the right to a hearing.<br />

3. The right to consent to disclosures of personally identifiable<br />

information contained in the student's education records, except to<br />

the extent that FERPA authorizes disclosure without consent. One<br />

exception, which permits disclosure without consent, is disclosure<br />

to school officials with legitimate educational interests. A school<br />

official is a person employed by the District as an administrator,<br />

supervisor, instructor, or support staff member (including health or<br />

medical staff and law enforcement unit personnel); a person serving<br />

on the School Board; a person or company with whom the District<br />

has contracted to perform a special task (such as an attorney, auditor,<br />

medical consultant, or therapist); or a parent or student serving on<br />

an official committee, such as a disciplinary or grievance committee,<br />

or assisting another school official in performing his or her tasks.<br />

A school official has a legitimate educational interest if the official<br />

needs to review an education record in order to fulfill his or her professional<br />

responsibility. Upon request, the School discloses education<br />

records without consent to officials of another school district in which<br />

a student seeks or intends to enroll.<br />

4. The right to file a complaint with the U.S. Department of Education<br />

concerning alleged failures by the School to comply with the requirements<br />

Transportation<br />

In District -<br />

Children within the district are transported between home and school in<br />

accordance with the following schedule:<br />

Grades K-2: More than 1/4 mile<br />

Grades 3-8: More than 1/2 mile<br />

Grades 9-12: More than 1 mile<br />

Out of District -<br />

The district transports pupils to private and parochial schools for a distance<br />

not to exceed fifteen (15) miles. If a student lives beyond the 15<br />

mile limit and the district makes a bus run to that particular school, carrying<br />

other eligible students, transportation will be provided from a central<br />

pickup point. Transportation to and from a central pickup point,<br />

however, is the responsibility of the student. Requests for such transportation<br />

must be made before April 1 for the following school year. The<br />

application form and instructions can be found on the <strong>Commack</strong> Website,<br />

or obtained at the transportation office.<br />

Children riding buses are issued bus passes. Parents are urged to instruct<br />

their children in rules of proper behavior. The school district reserves the<br />

right to suspend the privilege of bus transportation for students who<br />

threaten the safety and well-being of themselves and/or of other children.<br />

Tax Code Number -125<br />

For your New York State Return, The <strong>Commack</strong> School District Code<br />

Number is 125.<br />

It is important that you include this information on your state tax returns.<br />

If your return lacks <strong>Commack</strong> School District's name and code, a large<br />

percentage of the income from the district would not be credited to us. If<br />

a sizable return lacks this information, it is possible that it could considerably<br />

distort the district's income picture, thereby causing the <strong>Commack</strong><br />

School District to receive less in State Aid than it would normally<br />

receive.<br />

In selecting a school district name to enter on your tax return be sure to<br />

distinguish between the name of the town in which you reside, the name<br />

of the post office which delivers your mail, and the name of the school<br />

district in which you reside. If you need help, please call the district at<br />

912-2005 or New York State tax information at (800) 225-5829.<br />

School Lunch Programs<br />

The <strong>Commack</strong> School District offers a regular school lunch program on<br />

a self-sustaining basis through Whitsons Culinary Group, with nutrition<br />

and menu guidance provided by the school district PTA Nutrition<br />

Committee.<br />

The Type A lunch price for the 2013-2014 school year (which includes<br />

milk) is $2.00 for primary school students, and $2.05 for intermediate and<br />

secondary students. Nutritional information, lunch menus, and lunch<br />

prices are posted on the <strong>Commack</strong> Website.<br />

A la carte items are also offered on the menu at varying prices. Breakfast<br />

can be purchased at the high school from 7:00 a.m. until 7:25 a.m. each<br />

school day. All information is posted on the Website.

Smoke-<strong>Free</strong> School Policy<br />

Under a policy implemented by the Board of Education, and in accordance<br />

with NYS law, smoking by students and staff is prohibited in all<br />

<strong>Commack</strong> School District buildings and facilities.<br />

This policy reflects the Board's concern following published studies that<br />

secondary smoke has adverse effects on non-smokers as well as smokers.<br />

The smoke-free schools policy is in keeping with the district's commitment<br />

to educate its students to the dangers of substance abuse, including<br />

alcohol and smoking, and the hope that such a policy will set an example<br />

for all students and staff.<br />

Inclement Weather<br />

A delayed school opening procedure on inclement weather days will be<br />

used when it appears that schools can open safely at a later time. Opening<br />

will be delayed for one or two hours later than the usual schedule.<br />

Schools shall adjust their school day accordingly, so that dismissal is at<br />

the usual time. Children will be transported back home on the usual<br />

transportation schedule.<br />

School closings or delayed openings will be posted on the <strong>Commack</strong><br />

Website, http://www.commackschools.org. The District will endeavor to<br />

place an automated telephone call to each household with school aged<br />

children. The District cannot guarantee that all households will be<br />

reached. If you have signed up for the Parent Portal or Email Notification,<br />

you will be notified by Email, as well.<br />

Parents are encouraged to listen to the stations listed below for closing<br />

and delayed opening information. In the absence of any announcement,<br />

call, Email, or posting, it should be assumed that schools are open.<br />

Residents are urged not to call the school or the District switchboard so<br />

that we may be permitted to handle the expected high volume of emergency<br />

calls.<br />

Reporting Absences<br />

Title IX<br />

For the protection of their children, elementary grade parents are urged to<br />

call the school nurse if their child is absent from school. To accommodate<br />

parents' early and late day schedules, calls to the nurse will be taken<br />

by an answering machine when school is not in session. The message will<br />

be as follows:<br />

"Thank you for calling the__________ attendance reporting number: To<br />

report a student's absence, at the "beep," please give the following information:<br />

1. The student's full name, date of absence and reason for absence.<br />

2. The name of the student's teacher.<br />

3. The students birth date by month, day, and year.<br />

4. Your home telephone number.”<br />

If you have any other message, please call the main office while school is<br />

in session. These details help the school staff know that the call is legitimate.<br />

The answering machines save the schools the task of having to call the<br />

home of each absent student. The procedure of having parental contact<br />

when a student is absent is a necessary safeguard to insure the health and<br />

safety of your children.<br />

Working papers are required by New York State before any student<br />

under the age of 18 is permitted to engage in part-time or summer<br />

employment. The law prescribes limits on the number of hours and<br />

areas of employment. In addition, a physical examination is<br />

required.<br />

Medical exams for students attending <strong>Commack</strong> Schools are conducted<br />

by the school physician and are arranged through the school.<br />

Students attending non-public schools must arrange for working<br />
